My Critical Analysis of “SOGIE Equality Bill”

The Sexual orientation and Gender Identity and Expression Equality Bill (SOGIE) which also

known as Anti-Discrimination Bill (ADB) is a proposed legislation of the Congress of the

Philippines, which prevent various economic and public accommodation related acts of

discrimination against people based on their sexual orientation, gender identity or expression.

Now within my further examination about this matter. I can provide a 10 Philosophical theories

connected about our main topic.

For My First Theoretical Philosophy it is going to be the Kantian Ethics. Implying this

theory with our proposed bill, a person is obliged to do what’s the country’s law rather than doing

what their desire/s. For example, a Transgender aren’t allowed to enter a woman’s public toilet

because it is only for a “real” woman or those who are woman since birth. But still in the end we

need to respect each other regardless of their choice because that’s what the person wanted to

be.

Now next for my second theory is The Machiavellian Principle. When sometimes bisexuals

are getting away with their thoughts and their desires, these bisexuals are almost doing anything

what they want so as a person you restrict them to their limits, which could affect or heightened

their emotions. But remember you are doing it to attain something good. For example, let’s say

this bisexual tried to enter a woman’s bathroom. You could restrict them even if it will make them

mad, because you know that it is for everyone’s sake.

For my third Theory, The Utilitarianism of John Bentham and John Stuart Mill.

Considering the fact that we are just connecting these theories to our main topic, we can assume

or gladly say that our Main topic is also a Utilitarianism itself. Why? Simply because this theory

says its mainly for “pleasure” and “Happiness”. We all know the feelings of relieved by those Trans
here in our country when they heard this bill. They will be far from such discrimination and other

form of bullying. Thus, I can say this does put a smile on their faces.

My fourth Theory is going to be the Moral Positivism. From around the country we have

heard, thought and witnessed a 4th bathroom specially made for those Trans. If you notice why

do, we have such things being built around and being tolerated by such high persons and other

famous persons; For me this is what we really call a Moral Positivism. They’re just extremely

pushing every little thing just to improve their POSITION as a Trans. I mean, for me they’re really

not that “special” or have some kind of inborn defects which needed some kind of special

treatment. They choose to be that way, we should not waste funds to this kind of things. We

respect them, YES! But they should do the same and understand what are the things we really

need.

Continuing to my Fifth Theory is the Ethical Egoism. My little explanation for this is that

almost every bisexual has this kind. For me they just love their “kind” too much that they are

willing to debate and fight for their beliefs for their “equality”, which little did they know that it

became more like an “empowerment”. It’s not really bad if they love who they truly are, but it is

becoming bad because they’re abusing some of their “rights”. Mostly they are just looking bad

because of their self-interests.

Moving on to our sixth Theory the Virtue Ethics. Here it says that the person must reflect

the appropriate Moral Virtues and Integrity in making decisions rather than focusing on some

reasons for doing the action. As for deeply connecting this theory to our bill, I will give the exact

statement of our own Senate President Sotto. He said that "Women cannot be compared to a

group like that because, I hate to say this but I have to, if you are a man, you will never be a

woman, no matter what you do, because you cannot reproduce. You cannot give birth; you do
not have ovaries". As you can see our senate president just bluntly reasons out instead of thinking

about the right actions he could do. Reasoning out like that is not a casual attitude for a senate

president. We should always be transparent for our words and actions; we do not own the rights

to ridiculed the "wrong" Even if they're "wrong". Sotto's statement could affect not only to the

LGBT community but also in society. If you got my point, you will clearly see how well this theory

connects to our bill.
