DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE (the “Deed”) is made, executed and


entered into this _______ 2019 in ________, Philippines, by and
between:

_______________, Filipino, of legal age, widower, and with


address at ______________ hereinafter referred to as the “SELLER”;

-AND-

_________________, Filipino, of legal age, married to


________________________, and with address at
_______________________, hereinafter referred to as the “BUYER”.

WITNESSETH;

WHEREAS, the SELLER is the registered owner of a parcel of land


with improvements located at _________________ _____Pasay City,
and covered by Transfer Certificate of Title No. ________containing a
total area of (Land Area of Property in Words) (000) SQUARE METERS,
more or less, and more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE NO. 0000

title) Example: A PARCEL OF LAND (Lot 20 Blk 54 of consolidation
subdivision plan (LRC) Pcs-13265, being a portion of the
consolidation of Lots 4751-A and 4751-B (LRC) Psd-50533, Lot 3, Psd-
100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos. N-27024, 51768, 89632,
N-11782, N-13466, and 21071 situated in the Bo. of San Donisio, Mun
of Paranaque, Prov of Rizal, Is. of Luzon. Bounded on NE., point 4 to 1
by Road Lot 22, on...to the point of beginning; containing an area of
(280)square meters more or less..."

WHEREAS, the BUYER has offered to buy and the SELLER has
agreed to sell the above mentioned property for the amount of
PESOS: TWO MILLION FIVE HUNDRED (Php 2.500,000.00).
The SELLER warrants that the aforesaid land is free from any
liens and encumbrances and that said SELLER would defend the title
and rights of the BUYER from any claims of whatever kind or nature
from third persons.

The BUYER shall be liable for payment of the Capital Gains Tax.
Documentary Stamp Tax, Transfer Tax, Registration Fees, Notarial Fee,
and other incidental expenses related to the transfer of the title to
the name of the BUYER.

The SELLER warrants that the Real Estate Taxes for the property
has been paid in full.

The SELLER hereby warrants to deliver to the BUYER the


following documents simultaneously with the execution of this
contract, to wit:

1. Original Owner’s Copy and certified true copy of TCT No.


___, free from all liens and encumbrance, lis pendens, option,
liabilities and encumbrances;
2. Original and certified true copy of tax declaration No. E-____
and E-____.;
3. Original official Receipts covering payments of real estate
taxes;
4. City Treasurer’s Tax Clearance;
5. Vicinity Map;
6. Lot Plan and architectural plans;
7. Official receipts of latest payment of utility bills such as
MERALCO, PLDT, Water Services;
8. Letter of assignment and transfer of ownership of PLDT and
MERALCO and water services.

The SELLER warrants that the subject property is not tenanted


and free from all claims of third person/s or entities and that the
provision of laws are satisfied to effect a valid and enforceable
transfer and conveyance on the said SUBJECT PROPERTY.

NOW THEREFORE, for and in consideration of the sum of PESOS:


TWO MILLION FIVE HUNDRED (Php 2,500,000.00) Philippine Currency,
hand paid by the vendee to the vendor, the SELLER DOES HEREBY
SELL, TRANSFER, and CONVEY by way of Absolute Sale unto the
said BUYER, his heirs and assigns, the certain parcel of land together
with all the improvements found thereon, free from all liens and
encumbrances of whatever nature including real estate taxes as of
the date of this sale.

IN WITNESS WHEREOF, the parties have herunto set their hands


on the date and at the place first abovewritten.

executed the foregoing instrument and acknowledged to me that
the same are their free act and voluntary deed.

This instrument, consisting of FOUR (4) pages, including the page on


which this acknowledgment is written, has been signed on the left
margin of each and every page thereof by the concerned parties
and their witnesses, and sealed with my notarial seal.
