Agreement for Family Compromise Settlement
This family settlement is made on this 15th day December 2014 at Malvar,
Santiago City, by and between the following family members:
Mr. Angelo G. De Guzman, Ms. Beth G. De Guzman, Mr. Cardo G. De

Guzman, of legal ages, Filipinos, residents of Capirpirwan, Cordon, Isabela.
and
Mr. Dalisay G. De Guzman, of legal age, Filipino, a resident of Capirpirwan,

Cordon, Isabela.
The details of the properties with their ownership which shall be subject
matter of the present family settlement are as under:
WITNESSETH, THAT:
WHEREAS, Angelo De Guzman, Beth De Guzman, Cardo De Guzman,

referred to as the First Party and Dalisay De Guzman being the Second Party
who happened to the heirs of the late Sps. Ermeraldo De Guzman and Fatima
De Guzman who died on year 1999 and year 2007, respectively.
WHEREAS, the Sps. Esmeraldo De Guzman and Fatima Gracia had left
a parcel of land registered under their name, with TCT no. 12345 with an
area of 40,000 sqm., located at Capirpirwan, Cordon, Isabela.
WHEREAS, that the heirs who are the sons and daughter of the
deceased Sps. Esmeraldo De Guzman. That the dispute has arisen when the
first party found out that the said parcel of land was already transferred to
the name of Dalisay De Guzman through a deed of Donation singed by their
parents on December 15, 2010, without the knowledge of the former.
WHEREAS, the parties hereto have come to a settlement after the

aforesaid discussion with the help mutual friends to resolve the disputes and
differences. That this settlement is based on with certain terms and
conditions which was drawn to avoid any future disputes and/or differences
and also to achieve peace and harmony amongst the parties hereto.
NOW THEREFORE THIS MEMORANDUM OF FAMILY SETTLEMENT

WITNESSETH THE SAID TERMS AND CONDITIONS AS FOLLOWS:
1. In pursuance of the said agreement and in consideration of the

premises, the parties here to agree that Dalisay De Guzman, shall
waive his ownership to the said parcel of land to be able to give his
siblings their respective rights to the latter. Considering the fact that
Dalisay has transferred the title of the property to his name through
a Deed of Donation which was allegedly invalid, dated December
15, 2014.
2. That pursuant to this agreement, the property is to be divided in to

four. That half of the expenses that they may incur in the process of
partition and transfer of Title of the land will be charged to the
second party as a punishment for being acted in bad faith and the
other half is to be shoulder by the siblings equally.
3. That each of the siblings will be entitled with 10,000sqm as their

share to the property inherited from their deceased parents.
4. That it is hereby declared and agreed between the parties that this
agreement for family settlement ends all disputes between the parties
relating to the respective rights and claims of the latter to the
inherited family property.
5. That the present agreement for family settlement shall be considered

as final and conclusive and shall not be altered or changed at any
subsequent stage of the settlement.
6. All the conditions of the proposed agreement for family settlement

have been fully explained to all the parties, who are the signatories
to this agreement for family settlement and the said signatories have
in consultation fully examined and considered the said terms and
conditions and have given their free consent at their will without
any force, coercion and / or inducement.
7. That the present Settlement Deed will have a legal force and shall be
presented, forwarded before the Authorities concerned for the
transfer of the respective shares of properties between the parties.
IN WITNESS WHEREOF, the parties hereto have set and subscribed their
respective hands this 15th day of December, 2014 at Malvar, Santiago City.
