A lawmaker has filed a measure exempting the elected local government officials from taking the
mandatory continuing legal education (MCLE).
In House Resolution 2478, Rep. Jerry P. Treñas (Lone District, Iloilo City) said elected
government officials are performing vital functions that require their full attention for the duration of
their term as elected officials.
Treñas said the House of Representatives recognizes the importance of mandating the members of the
Philippine BAR to continually update themselves with the latest developments in law and jurisprudence
through the MCLE.
"The Revised Rules on the Continuing Legal Education for Members of the Integrated Bar of the
Philippines was adopted by the Supreme Court through B.M. No. 850 to ensure that all members of
the Integrated Bar are kept abreast with law and jurisprudence, to maintain the ethics of the
profession and to enhance the standards of the practice of law," Treñas said.
Treñas said B. M. (Bar Matter) No. 850 provides for the exempted individuals from the coverage of the
MCLE, which includes, among others, the elected officials of the Republic including the President, Vice
President, Senators, members of the House of Representatives, governors and mayors.
Treñas, vice chair of the House Committees on Banks and Financial Intermediaries and Good
Governance and Accountability, said the House of Representatives also recognizes the indispensable
role of other elected officials in the provincial, city and municipal local government units, including the
Vice Governors, Vice Mayors, Members of the Sangguniang Panlalawigan and members of the
Sangguniang Panlungsod.
Treñas said the elected local government officials are also performing legislative functions similar to
Senators and Members of the House of Representatives.
"The vice governors and vice mayors sit as the presiding officers of the Sangguniang Panlalawigan and
Sangguniang Panlungsod respectively," said Treñas.
Treñas said the duties of local government officials who are also members of the Integrated Bar
preclude them from actively practicing their profession as lawyers.
Treñas said the exemption from compliance with the MCLE during their term as elected officials of the
provincial, city and municipal local governments will allow the concerned members of the Integrated
Bar to fully devote themselves to public service.
Treñas urged Congress to respectfully recommend to the Supreme Court of the Philippines to exempt
elected officers of provincial, city and municipal local government units from compliance with the
MCLE.
