We are writing to inform you that our consignment of 15 air- conditioners and 180 laptops under
the order No DH-MT/439 carried by the MV Golden Lotus arriving at Hai Phong port on 5th
December 2011 was in damage and missing condition.
Upon the arrival of the goods at the port, surveyors from Vinacontrol were invited to inspect the
goods and their Survey Report shows that the actual consignment contains 168 laptops rather
than 180 units, making a shortage of 12 units. Out of the laptops delivered, 60 units were
originated in China rather than Asean as ordered and 8 units were broken beyond repair due to
broken cases. There were 5 damaged air conditioners due to improper packing.
As we are in urgent need of the goods to complete our sales to local customers, please deliver
the undelivered laptops and send us replacements for damaged air-conditioners at your expense
as soon as possible, but not later than 22th January 2012. We would reserve the right to refuse
the goods delivered after that time and you would be required to pay us a compensation
equivalent to twice the total value of the goods. As for Chinese laptops, we are willing to accept
them as long as you reduce the price by 20% of the ordered price. Please send someone to pick
up the goods broken beyond repair and pay for their storage from arrival. This situatuon has
caused a delay in the opening of a represenative office in Ha noi. Therefore, we must ask you to
pay a compensation valued at 0.5% of the contract value for liquidated damages.

carried by the Red Lotus arriving at Hai Phong Port on 20th March 20.. were in damage and
missing condition.
Upon the arrival of the goods at the port, surveyors from Vinacontrol were invited to inspect the
goods and their Survey Report showed that the actual consignment contains 235 refrigerators
rather than 250 units as ordered, making a shortage of 15 units. Out of 150 cases of air
conditioners received, 20 cases were damaged and the air conditioners were broken beyond
repair. 20 units of Sony colored television which were ordered have not been delivered.
As we are in urgent need of the goods to complete our sales to local customers, we would like
you to send us the replacements for broken air conditioners and deliver the undelivered
refrigerators at your expense. Please not that they must arrive as soon as possible but not later
than 15th June 20... We would reserve the right to refuse the goods delivered after that time and
you will be required to pay the penalty of 200% of the contract value (bị phạt gấp đôi)
equivalent to twice the value of the goods. As for 200 units of Sony colored televisions ordered
for sales on 1st May, we regret that we would cancel the order as today is 29th May. We must

damaged - the shells were broken and the mechanisms were exposed. They cannot be sold even
at a discount.
As we are in urgent need of the goods to complete our sales to local customers, we would like
you to send us replacements for 10 broken units as soon as possible, but not later than ... As for
20 undelivered electronic fans, we would purchase them from another supplier in Thailand at
your expense.
We regret that unless the goods reach us until the above deadline, we would consider looking for
another supplier.
