ANNEX “B”

Program of Works

1. The contractor will clean the site and prepare within one month from receiving the
advance payment a mock-up of the below element for the owner review and approval
a. Retaining wall
b. Riprapping
c. Marking point showing the land final floor level, subdivision and road
d. Sample of all material which will be used for owner review and approval

2. The contractor will proceed as per approve work program the work on site after approval
of mock-up by the owner.
3. Staff, Supervisors, Labor Force, Materials, Construction Plant and Equipment

The Contractor shall provide and be fully responsible for his staff, supervisors, skilled and
unskilled labor force in sufficient and necessary qualifications and numbers, materials
constructional plant and equipment, tools and things to complete the works with the required
quality and within the time (s) stipulated in this Agreement.

The Contractor shall be responsible for complying fully with all laws statutes ordinance,
regulations, ministerial decisions, being in force for the time being and from time inclusive of
but by no limitation to those appertaining to Labor Law in respect of engagement
registration, employment, accommodation, travel expenses, dismissals or any other matter.

4. Insurance

Insurance policies to cover Contractor’s works and workers, third parties liability and labors
shall be the sole responsibility of the Contractor.

5. Change in the Works

The Contractor may be ordered in writing by the Contractor, without invalidating this Sub-
Contract to make changes in the work within the general scope of this subcontract consisting
of additions, deletions or other revisions at the same rates and prices referred to herein where
applicable.

The Contractor shall not act upon an unconfirmed order for the Variation of the Contract
Works which is directly received by it from any third party and not confirm by writing for
the owner.

6. Health, Safety & Environmental Requirements

The Contractor agrees to comply with all state laws, codes and regulations, and all local and
municipal ordinances and regulations effective where the work is to be performed, and to pay
all costs and expenses attributable to such compliance for example safety hard hats, goggles,
coveralls, safety belts, scaffolding and the like failure of which will result in barring the
workers from site and result in a penalty clause after written documentation from the Owner.
The Owner will not be held responsible for any and all loss or damage occasioned by the
failure of the Subcontractor to comply with the terms of this paragraph.

7. Cleaning up

During all phases of the performance of this Agreement, The Contractor shall perform
appropriate clean-up debris of his services works free from the accumulation of waste and
trash materials caused by Contractor's operations, which shall be dumped to a particular point
at site, designated by the Contractor and shall leave the premises in a broom swept, raked and
reasonably clean condition. If Contractor fails to adequately comply with said clean-up
obligations, The Owner, may perform the required clean-up by whatever method the Owner
may deem expedient without informing the Contractor, and may charge the Contractor for
the reasonable costs of such clean-up.

8. Contract Termination

The Contractor’s employment under this Agreement is subject to termination, by the owner
under the relevant clauses of the Main Contract and or valid reason attributable to the
Contractor
