RE: DEMAND LETTER

Dear Mr. Sison:
I am writing this letter with respect to my previous request from you to take down or otherwise
rectify a video1 uploaded on August 12, 2019 at 1:22 P.M, featuring the Premium Nano Ceramic Coating services of
Wash Authority2 uploaded in the Facebook Page of “Where in Pampanga”. This video depicted me, Mr. _________
as an employee/partner or otherwise appears to be in any way affiliated with Wash Authority, as I was the one who
demonstrated or explained the procedure on how to apply Premium Nano Ceramic Coating. I also discussed the
benefits of the mentioned service, and even invited potential video viewers to visit the shop and be connected with
Wash Authority in order to avail Its services.
However, due to circumstances beyond my control, I previously disaffiliated from Wash Authority, and I am
no longer connected to said company as of present.
In view of this, as a Data subject3, I am invoking my right under the Data Privacy Act of 20124, specifically
the right to erasure or blocking5, including the right to retract my consent from participating in the video stated above,
and the right to rectify6, as the said video is no longer updated, or otherwise does not represent the true status of my
affiliation with Wash Authority in view of my previous disengagement.
Considering said disaffiliation, any content of the video showing my participation will no longer be updated
and relevant, rather, untruthful and incorrect.
Under the law, data subjects have the right to suspend, withdraw or order the blocking, removal or
destruction of their personal data or information7. It can be exercised upon discovery and substantial proof, among
others, of the following8:

As aforementioned, I invoke my rights as enumerated herein, for the above-explained reasons, and legal
basis. It is my demand that representatives of “Where in Pampanga”, must delete the subject video or remove any
portion of the said video which shows my participation, in any social networking sites or other platforms where such
video is uploaded which include, but not limited to, Facebook, YouTube, Instagram.
I further request that this demand be done within five (5) days, from the date of this letter, otherwise, I will
be constrained to coordinate with the National Privacy Commission (NPC) to settle my complaint in accordance with
legal procedure which the Commission prescribes.
I humbly ask, and trust that you respect my rights as data subject, and participate accordingly as mandated
by the laws of the Philippines.
