AFFIDAVIT OF ACKNOWLEDGMENT OF PATERNITY
I, NINO GERARD M. TULLAO, of legal age, Filipino and currently residing at

San Simon, Pampanga, after having been duly sworn in accordance with law, depose and
state that --
1. I am the biological father of FRANCHESCA YABUT RAMIREZ who

was born on 23 January 2003 at Ricardo P. Rodriguez Memorial Hospital, Bulaon, City
of San Fernando, Pampanga. Her biological mother is Leah Esperanza Yabut Ramirez;
2. I was not aware of the birth of my said child and was only given
knowledge of such fact after her birth and delivery. Hence, I did not give my conformity
to use my surname considering further that I am not married with her mother;
3. Currently, I am staying in the United States of America being a green card

holder. I have plans to petition my daughter to live and reside in the United States of
America;
4. Hence, in support of her petition, I am allowing her to use my surname in

her records specifically in her Certificate of Live Birth;
5. With this affidavit, I am expressly declaring Franchesca Yabut Ramirez as

my daughter and let this affidavit be annotated at her certificate of live birth;
6. I have executed this affidavit freely and voluntarily without any form or
coercion against my person and I also expressly give my consent to file the necessary
petition or action before any courts for the cancellation of the Certificates of Live Birth
and to issue a new Certificate of Live Birth that will reflect the correct the circumstances
of the child, for her best interest and welfare; and
7. I have also executed this affidavit to prove and establish the foregoing
facts, to attest to their truth and for all other legal intents and purposes it may serve.

1. We are the petitioners in the above-entitled petition;

allegations of facts contained therein are true and correct on our own
personal knowledge and based on authentic records;
3. We attest to the authenticity of the annexes attached thereto;
4. That we hereby certify under oath in this petition as follows:
a. We have not theretofore commenced any action or

filed any action or claim involving the same issue in any court,
tribunal or quasi-judicial agency and, to the best of our
knowledge, no such other pending action or claim is pending

complete statement of the present status thereof; and
c. If we should thereafter learn that the same or
similar action or claim has been filed or is pending, we shall
report that fact within five (5) days therefrom to the court
wherein the aforesaid complaint or initiatory pleading has been
filed.

1. To initiate and file petition/ action for the correction/ cancellation of the
Certificate of Live Birth of the minor Franchesca Yabut Ramirez before the proper courts;
2. To represent, testify before the courts and adduce evidences in my behalf in said petition;
3. To execute, sign, file, serve and deliver any and all papers, documents and pleadings
relative to the above-mentioned complaint, petition and/ or actions.
