ANALYTICAL QUESTIONS [Within 200 Words]

10 Marks each

1. What changes shall be incorporated in the present Mooting structure in the Indian
legal system? Answer as per your own understanding.

The cases are based on Indian laws so it's better if we cute name of the places of
India only rather than some imaginary place.

I also feel there should not be any bias and Indian legal should also include the
practice of mock trials in which the students can ask of evidence and collect the
required documents so as to make them familiar with the actual procedure where
you have to collect all the evidence by yourself.

2. What all Sources should you focus on while Researching for a Moot and what all
Sources should you discard?

Read the moot propostition 7–8 times.

After understanding the problem, now comes the research work. In reaearch work,
first comes the jurisdiction; how have the parties approached the court or whether it
is maintainable or not. Jurisdiction should be crystal clear as in some cases.
So after clearing the Jurisdiction, you have to frame your contention/ issues. Some
time the issues are given but in other case, while framing issues, you need to take
care that you cover all the major issues in around 4 contentions.

After framing the issues, starts the research work. Most of the times, the moot
problem is based on some real life case. So you need to find that case and study it,
for getting a basic idea of what all laws can be applied there. Find the laws
applicable, do a thorough research of case laws, find the disputable points in the
case and try to answer it yourself.
In order to make a decent memorial, you need to put at least 50 cases from each
side. Whatever important point your speaker is going to say should be cited by a
case law.

Avoid sources that are not credible and are not authentic.
