Employment law

Contract of employment

A contract of employment will be provided for the employee on


commencement of a job. It is a legally binding agreement between
employer and employee. It will include:
 Names of employer and employee
 Date of commencement
 Job title and description
 Terms and conditions of service

Rights and duties of employers/employees

 Employees cannot be discriminated against on the grounds of gender,


race, religion or disability

Name the 3 laws?

 Employees must be paid the same rate as other employees doing the
same or similar work
 Employees have the right to maternity/paternity leave
 Employees have the right not to be dismissed unfairly (1 year qualification
period)
 PT and FT have the same rights
 Employers have the duty to provide a safe working environment – Health
and Safety at Work Act 1974
 Employees must conform to the contract of employment e.g. standards of
behaviour

Tasks:

1. Complete the table on P 96 – Trends in Work Patterns

3. Produce a table of fair and unfair dismissals
