Cargo Handling Operators Shipping Lines Companies Shippers/Consignees/Customs Brokers Importers/Exporters Others Concerned SUBJECT: Prescribed Storage Fees for Out-of-Gauge Containers at the Manila South Harbor, Manila International Container Terminal, and Batangas Port The Philippine Ports Authority (PPA) hereby prescribes the storage fees for Out-of-Gauge (00G) containers at the Manila South Harbor (SH), Manila International Container Terminal (MICT), and Batangas Port 1. LEGAL BASES a) Article IV, Section 6 b), (ix) of Presidential Decree No. 857, as amended or the Revised Charter of Philippine Ports Authority. b) PPA Board Resolution No. 2984 2. OBJECTIVE To prescribe storage fees for OOG containers at the Manila SH, MICT, and Batangas Port. 3. COVERAGE This Order shall cover the OOG containers stored at the Manila SH, MICT, and Batangas Port. 4. DEFINITION OF TERMS For purposes of this Order, the following terms shall be understood to mean, as indicated a) Out-of-Gauge (00G) Container -- refers to either a flatrack or open top container laden with a cargo that exceed the dimensions of a standard ISO container by height, widti or length and thus cannot be shipped using a closed ISO container. b) Storage ~ the storing of containers, bulk, and break bulk cargoes in ail storage areas at the port. ADJUSTMENT OF STORAGE FEES FOR OOG CONTAINERS Any adjustment of the storage fees for OOG containers shall follow the adjustment methodology and formula prescribed by the PPA. 7. REPEALING AND SEPARABILITY CLAUSE All issuances thereof inconsistent herewith are deemed repealed or modified accordingly. If any part of this Order is declared unconstitutional or invalid by competent judicial authority, the other parts of this Order shall not be affected and shall continue to be in full force and effect. 8, EFFECTIVITY This Order shall take effect after 15 calendar days following the completion of its publication in a newspaper of general circulation and a copy submitted to the UP Law Center. \ JAY DANIEL R.
