We, the undersigned, declare that:

(a) We have examined and have no reservations to the Bidding Documents, including
Addenda issued in accordance with Instructions to Bidders (ITB) 8.

(b) We offer to execute in conformity with the Bidding Documents the following Works:
Upgradation of Major Roads along with Pathways, Construction of Underground
Electrical / Utility duct and Storm Water Drainage, Shifting of Underground Utilities,
Underground cabling, Street Lighting, Street Furniture and Miscellaneous works and
Post Completion maintenance of all Tendered works for a period of Five (05) years.

(c) The total price of our Bid is as uploaded in e-procurement portal,

(d) Our Bid shall be valid for a period 120 days from the date fixed for the bid submission
deadline in accordance with the Bidding Documents, and it shall remain binding upon us
and may be accepted at any time before the expiration of that period.

(e) If our Bid is accepted, we commit to obtain a performance security in accordance with
the Bidding Documents.

(f) We have paid, or will pay the following commissions, gratuities, or fees with respect to

(g) We understand that this bid, together with your written acceptance thereof included in
your notification of award, shall constitute a binding contract between us, until a formal
contract is prepared and executed.

(h) We understand that you are not bound to accept the lowest evaluated bid or any other
bid that you may receive.

(i) We agree to permit ADB or its representative to inspect our accounts and records and
other documents relating to the bid submission and to have them audited by auditors
appointed by ADB.

Preamble

1. The Bill of Quantities shall be read in conjunction with the Instructions to Bidders,
General and Particular Conditions of Contract, Technical Specifications, and Drawings.
2. The quantities given in the Bill of Quantities are estimated and provisional, and are given
to provide a common basis for bidding. The basis of payment will be the actual quantities
of work ordered and carried out, as measured and verified by the Engineer and valued at
the rates and prices bid in the priced Bill of Quantities, wherever applicable, and
otherwise at such rates and prices as the Engineer may fix within the terms of the
Contract.
3. The rates and prices bid in the priced Bill of Quantities shall, except as otherwise
provided under the Contract, include all required construction equipment, labour,
supervision, materials including loading & unloading charges, erection, maintenance,
transportation, insurance, profit, taxes, and duties, together with all general risks,
liabilities, and obligations set out or implied in the Contract.
4. As per Building and Other Construction Workers Welfare Cess Act 1996, an amount
@1% of gross amount shall be deducted at source from each bill.
5. A rate or price shall be entered against each item in the priced Bill of Quantities as
appearing in the various spreadsheets earmarked for respective works. All the prices
entered in the spreadsheets for various works are linked to the summary sheet named as
“BoQ1” which is locked. The cost of Items against which the Contractor has failed to
enter a rate or price shall be deemed to be covered by other item rates and prices
entered in the Bill of Quantities.
6. The whole cost of complying with the provisions of the Contract shall be included in the
Items provided in the priced Bill of Quantities, and where no Items are provided, the cost
shall be deemed to be distributed among the rates and prices entered for the related
Items of Work.
7. General directions and descriptions of work and materials are not necessarily repeated
nor summarized in the Bill of Quantities. References to the relevant sections of the
Contract documentation shall be made before entering prices against each item in the
priced Bill of Quantities.
8. Provisional Sums is a non-competitive price and the bidder shall only quote the figures as
appearing in the estimated rate field. For the purpose of financial evaluation the
estimated amount shall only be considered.
9. The method of measurement of completed work for payment shall be in accordance with
the relevant codes of practice.
10. Although a separate cost head for Environmental Management Plan is earmarked, the
rates and prices of various items in the Bill of Quantities shall be deemed inclusive of the
cost, if any other than the assessed cost, towards implementation of environmental
management and monitoring as specified in the Initial Environmental Examination
Report, Environmental Management Plan and Environmental Monitoring Plan and other
safeguard aspects mentioned in the contract. No additional payment shall be admissible
on any such account.
10(a). The contractor shall take all necessary mitigation measures to safeguard
Environment and Safety and Well-being of Labourers/ workers. The Contractor
shall provide necessary training on safety, health, EMP implementation and best
practices to workers and his staff. There shall be provision of water sprinkling
arrangement to reduce dust emission on roads, shelter for workers, drinking
water supply, separate toilet facility for male and female workers, first aid boxes,
waste bins for solid waste collection at construction site and as well as labour
camp and all required PPEs for construction workers.

10(b). In view of the ongoing Covid Pandemic situation, Contractor shall provide training
on COVID -19 awareness, health, hygiene and prevention to all his workers and
staff and provide all required PPEs (including the thermal sensor) for all the
workers. Prior to field mobilization, the Contractor shall submit for Employer’s
approval a site-specific environmental management plan (SEMP) along with
occupational health and safety (OHS) plan, including specific plan and Standard
Operating Procedure (SOP) for managing COVID-19 risks at construction sites
and all facilities. These should comply with the measures advised by the
Government of India and relevant guidance notes issued from time to time by
authorized international agencies such as the WHO, for commencing or resuming
construction works. The contractor shall arrange all preventive measures against
the COVID-19 risks and establish emergency protocols as approved by the
Employer and required by the government.

11. Cost of temporary works like temporary dewatering and drainage arrangements,
establishment and maintenance of contractor’s site office, store, labour facilities,
establishment and maintenance of workshops, plant and equipment, including Project
sign boards etc. will be part of work and shall not be paid extra.
