Task 1:
As a lawyer, advice will be given about work related issues workplace, brussel office,
disbursement rights and annual leave then advice will be given request compensation
because If the business owner fails to provide a written statement to the employee,
provides an incomplete statement or fails to notify the employee of the change, and
the employment appeals court finds that you have unfairly terminated or
discriminated against the employee, then they can compensate the employee
employee apart from other amounts that the employee is entitled to as compensation,
and better than the initial contract agreement, he must pay close attention to avoid
things that are not desirable.

Task 2:
As an employee who wants to consult a lawyer, the problem letter submitted to the
lawyer is:
1. On sick notes
Sick records as evidence of barriers to working properly are not timed because
sick records may have time constraints to arrive at the company
2. Regarding vacation leave
Vacation leave in accordance with the stipulated conditions. If on the same day
the employee suddenly gets sick, then not counted sick leave
3. On vaccine records
Vaccine records for overseas holidays are not timed because the doctor’s notes
must have some time to reach the company

Task 1:

You are an English-speaking employee in a Belgian company. You wish to consult


your lawyer about the following three problems at work. Read each problem out to
your partner and then make a note of the advice you are given:

1. I normally work in the Brussels office but the company has set up a project
group in the offices of a cooperation partner in Antwerp and now wants to
send me there for the third week in a row I asked my line manager how long
my presence in Antwerp was going to be for and she said she didn't know. Can
she keep sending me to Antwerp for as long as she wants?'
Ans:
A manager can send employees for company cooperation projects according to
company needs but she can’t send the same employee there week after week.
As written in the work contract regarding employee duties is, “Employees as
External Project Coordinators, manage the Company's projects with external
partners in the field of telecommunications software development."

2. I have 36 hours on my overtime account at the moment. I'm trying to save for
a holidays and I'd like to be paid for all 36 hours. My line manager says that I
should accept payment for 12 hours and that should take the other 24 hours as
free time. He says that he doesn't have time to discuss the matter further. Do I
have to accept this?'
Ans:
To ensure this, you should discuss it again at a later time and still pay attention
to the manager’s schedule and still pay attention to the work contract at the
point of “leave entittlement.”
3. A colleague told me that she can take her summer leave during the school
hotidays because she has children aged eight and ten. I haven't got any
children, but when I told her that my live-in boyfriend is a school teacher, she
said that thisdoesn't count. ls she right?'
Ans:
Probably not. But, the employee is entittled to take her leave in the school
holidays if her partner is tied to these holidays because of his / her profession.
In this case, the proffesion of his/her partner is a teacher, so she/he can take
the vacation with her/his part

Task 2:

As an lawyer, then advice or opinion that I give, namely:

1) According to clause 4, if employee is sick and is certified, the fee will be fully
paid by the company according to the length of service scales set forth in the
attached Staff handbook. Irrespective of the length of service, there is a
minimum full pay entitlement of 30 days.
2) According to Clause 5, the employee has a right to paid time off if the
vaccination is made necessary by a business trip. If the Employee model that it
is not possible for such appointments to be made outside of the core working
time, so the employee must have the vaccination in his or her own time.
3) It says in clause 5 that, employees have the right to leave for 30 days and
according to company needs. However, financing outside matters relating to
employees and the company is not borne by the company. For example
wedding expenses.
4) Yes, According to clause 5 the sick note must be handed in no later than four
calendar days after the start of the period of absence. Saturday and sunday are
calendar days, so the sick note arrived late.

Exercise 6:
1. Working hours: Cathy has basically got what she wanted in point 1.2. Although
the contract still doesn’t say specifically that the normal week is Monday to
Friday, it says this indireclly because weekend work is referred to as being
necessary “from time to time.”
2. Leave entitlement: This is definitety not what she wanted. According to this, she
can only carry seven days’ leave over into the foltowing year and only up to the
beginning of March.

Exercise 7:

Exercise 11:

Presenting an outcome

1. We agreed to a mutual agreement regarding Cathy's transfer to Softline , with


the contract effective starting from the 1 " of January.
2. The best option here is to find a middle ground where both of the companies
are satisfied with the outcome of the transfer , which is done by ensuring the
confidentiality of Intelligent Solutions ' resources without compromising
Cathy's future work in Softline.
3. In return they will enforce a contract that Cathy would have to agree on
regarding penalties on breach of confidentiality without Intelligent Solutions '
consent.
4. By way of compensation they will issue a warning and quite possibly
terminate Cathy's contract if she is proven to be guilty of a confidentiality
breach regarding Intelligent Solutions ' resources.

Over to You

1. Although they’ve made a few good points regarding their workplace clothing
regulations, there are some points that I don’t agree with. I have no problem
with their Department wanting a more casual but professional look on their
employees, as long as it is enforced both ways for men and women. If they
require their men employees to wear collared shirts and ties it’s completely
fine, but for their new regulation to have an impact on their overall employees
look, they also need to regulate the women’s clothing in some way. They don’t
have to wear collared shirts and tie per se , but a simple skirt , dress , trousers ,
or fitted shirt would suffice just fine.
2. I do sympathize the employer . It is not easy regulate the employees that they
have on a daily basis . But in order to gain respect and trust from their
employees , they have to listen to the problems that their employees currently
have with the way they run things . In this case , it is regarding the clothing
regulation faced by Matthew and Dennis.
3. I have no work experience as I’m currently only a freshman in one of the state
university in Jakarta . However , the university does have a dress code for both
men and women even though it’s nothing too complicated . It requires all
students to wear a respectable formal or at least semi – formal clothing while
in class to show respect to your lecturer .
4. Yes , it does apply to different groups of people equally . I fully support the
dress code that the university is enforcing because it is only common sense to
show up to class dressed properly for the occasion .
