MESSAGE
This 2019 Judiciary Annual Report is historic as it is delivered
in the middle of a global pandemic. In the year covered by this
Report, the Court has made significant strides in the automation of
its operations. As early as June 2019, the Guidelines on the Use of
Videoconferencing Technology for the Remote Appearance and
Testimony of Certain Persons Deprived of Liberty, or PDLs, in Jails and
National Penitentiaries was implemented and pilot-tested three
months after in Davao City courts. Subsequently, the Guidelines
was adopted in 22 courts. This, among other court projects, has
enabled us to weather the pandemic and continue to perform our
constitutional mandate to uphold the Rule of Law at all times.

Accused Ma. Luisa Judal Loot and Samuel Punay Moralde were found guilty beyond reasonable doubt of the
offense of Violation of Section 3(e) of RA No. 3019, as amended and each of them was sentenced to suffer
an indeterminate prison term of six (6) years and one (1) month as minimum, to eight (8) years, as minimum,
with perpetual disqualification from public office.
In SB-18-CRM-0254:
Accused Loot and Moralde were found guilty beyond reasonable doubt of the crime of malversation of Public
Funds and were sentenced to each suffer the indeterminate prison term of two (2) years four (4) months and
one (1) day of prision correccional, in its minimum period, as minimum to seven (7) years four (4) months
and one (1) day of prision mayor in its medium period, as maximum, and the penalty of perpetual special
disqualification from holding any public office.
Accused are also liable to indemnify jointly and severally the Municipality of Daanbantayan, Cebu in the
amount of Five Hundred Thousand Pesos (₱500,000.00), plus interest thereon at the rate of 6% per annum
reckoned from the finality of this decision until the amount is fully paid.
In SB-16-CRM-0237 and SB-16-CRM-0240, accused Alvin S. Sandoval, Dennis L. Cunanan, Maria Rosalinda M.
Lacsamana, Marivic V. Jover, Consuelo Lilian R. Espiritu, Rolleo L. Ignacio were also acquitted but were found
to be civilly liable for the improper implementation of the project funded by the PDAF released under SARO
No. ROCS. D-08-03248 and jointly and severally liable in the amount of Four Million Five Hundred Thousand
Pesos (₱4,500,000.00).
In SB-16-CRM-0238 and SB-16-CRM-0241, accused Alvin S. Sandoval, Dennis L. Cunanan, Maria Rosalinda
M. Lacsamana, Marivic V. Jover, Consuelo Lilian R. Espiritu, Rolleo L. Ignacio were also acquitted but were
found to be civilly liable for the improper implementation of the project funded by the PDAF released under
SARO No. ROCS. D-08009694 and jointly and severally liable in the amount of Eighteen Million Pesos
(₱18,000,000.00)
In SB-16-CRM-0479, accused Rogelio Maquiano Pimentel and Hermenigildo Quico Reyes are found guilty
of Malversation of Public Property and are sentenced to suffer an indeterminate penalty of imprisonment
of two (2) years, four (4) months, and one (1) day of prision correccional, as minimum, to six (6) years and
one (1) days of prision mayor, as maximum, with perpetual disqualification from holding public office, and to
each pay a fine of One Hundred Twenty-One Thousand Three Hundred Sixty-Six Pesos and Eighty Centavos
(₱121,366.80), the value of the property malversed. No civil liability is awarded in view of the full restitution of
the properties involved.
In SB-15-CRM-0104, accused is found guilty of Section 3(e) and is sentenced to suffer the penalty of
imprisonment of six (6) years and one (1) month, as minimum, to ten (10) years, as maximum, with perpetual
disqualification from public office, and is ordered to pay the Municipality of Corella, Bohol the amount of
₱92,239.70, with legal interest of six percent (6%) per annum from finality of the Decision until fully paid.
In SB-15-CRM-0105, accused is found guilty of Section 3(e) of RA3019 and is sentenced to suffer the penalty
of imprisonment of six (6) years and one (1) month, as minimum, to ten (10) years, as maximum, with
perpetual disqualification from public office, and is ordered to pay the Municipality of Corella, Bohol the
amount of ₱1,088,252.20, with legal interest of six percent (6%) per annum from finality of the Decision until
fully paid.
In SB-15-CRM-0108, accused is found guilty of the crime of Failure of Accountable Officer to Render
Accounts and is sentenced to suffer the penalty of imprisonment of six (6) months of arresto mayor, as
minimum, to one (1) year, eight months and twenty (20) days of prision correccional, as maximum. He is also
ordered to pay a fine of ₱40,000.00.
Every person criminally liable is also civilly liable. For his civil liability, the accused is ordered to pay Manila
Seedling Bank Foundation, Inc. the following amounts:
A. Seven Hundred Eighty-Three Thousand Eighty-Three Pesos and Eighty Centavos (₱783,083.80),
representing lost monthly rental income at the time of its eviction; and
B. One Million Fifteen Thousand Six Hundred Fifty-Six Pesos and Thirteen Centavos (₱1,015,656.13),
representing lost average gross monthly sales at the time of its eviction.
RULING
In SB-10-CRM-0162, 0164, 0166, 0168, 0170, 0172, 0174, the Court found accused Olimpio R. Mañalac, Jr. and
Melissa Nathalie Y. Mañalac-Toledo guilty beyond reasonable doubt of Violation of Section 108, in relation to
Section 128, of the Government Auditing Code of the Philippines. They are sentenced to each pay a fine of
One Thousand Pesos (₱1,000) in each of the aforementioned criminal cases, or a total of Seven Thousand
Pesos (₱7,000.00) each or Fourteen Thousand Pesos (₱14,000) for both of them; and
In SB-10-CRM-0163, 0165, 0167, 0169, 0171, 0173 AND 0175, THE Court found accused Olimpio R. Mañalac,
Jr. and Melissa Nathalie Y. Mañalac-Toledo guilty beyond reasonable doubt of Violation of Article 218 of the
Revised Penal Code, or Failure of Accountable Officer to Render Accounts. They are sentenced to each pay
a fine of Two Thousand Pesos (₱2,000) in each of the aforementioned criminal cases, or a total of Seven
Thousand Pesos (₱7,000.00) each or Fourteen Thousand Pesos (₱14,000) each or Twenty-Eight Thousand
Pesos (₱28,000) for both of them.
Accused Mañalac, Jr. and Mañalac-Toledo are also found solidarily liable and are ordered to pay the
government the amount of ₱272,178.00 by way of civil liability.

RULING
Accused Bernardito Asibuque Abapo is found guilty beyond reasonable doubt of the crime of Malversation
of Public Funds, and is ordered to suffer the Indeterminate Sentence Law of twelve (12) years, five (5)
months and eleven (11) days to fourteen (14) years, ten (10) months and twenty (20) days as minimum to
imprisonment of sixteen (16) years and one (1) day to twenty (20) years as maximum.
Additionally, and as provided by Article 217 of the Revised Penal Code, as amended, he is likewise ordered to
suffer the penalty of perpetual special disqualification to hold public office and to pay the fine of Twenty-Six
Million Five Hundred Nine Thousand Five Hundred Ninety Four Pesos and Four Centavos (₱26,509,594.04).
RULING
Judgment is rendered declaring the shares of (1) defendants Jose L. Africa and Manuel H. Nieto, Jr. in the
Eastern Telecommunications Philippines, Inc., which were acquired on June 10, 1974, (2) Polygon Investors
and Managers, Inc., and Aerocom Investors and Managers, Inc. and (3) the so-called small individual
shareholders, namely: Victor Africa, Lourdes Africa ITF Natalie Africa, Lourdes Africa ITF Jose Enrique Africa,
Lourdes Africa ITF Paul Delfin Africa, Rosario Songco, Raquel Dinglasan, Manuel V. Nieto III, Ramon V. Nieto,
Victoria N. Legarda Ma. Rita N. Delos Reyes, Rosario N. Arellano, Angela N. Lobregat, Benito Nieto, Carlos
V. Nieto, Carmen N. Tuazon and Rafael Valdez, which were transferred to them by defendants Jose L. Africa
and Manuel H. Nieto, Jr., are ill-gotten wealth of defendant Ferdinand Marcos; hence, should be reverted/
reconveyed to the republic of the Philippines;
Ordering defendants Jose L. Africa and Manuel H. Nieto, Jr., substituted by their respective legal heirs,
to reconvey to the Republic of the Philippines their aforesaid shares in the Eastern Telecommunications,
Philippines, Inc. including all the stock/cash dividends received/ deposited and interests that may have
accrued/may still accrue thereto;
Ordering Aerocom Investors and Managers, Inc. and/or defendant Manuel H. Nieto, Jr., substituted by his
legal heirs, to pay the Republic the amount ₱68,167,610.93, which is equivalent to the value of its Eastern
Telecommunications, Philippines, Inc. shares it had transferred or conveyed to ISM Communications
Corporation on July 11, 2005.
Lifting the Order of Sequetration dated June 15, 1988 over Polygon Investors and Managers, Inc. for the
Republic’s failure to prove that the said corporation is part of the ill-gotten wealth of defendants Ferdinand
and Imelda Marcos;
Ordering defendants Jose L. Africa and Manuel H. Nieto, Jr., substituted by their respective legal heirs, to
jointly and severally pay the Republic of the Philippines One Million Pesos (₱1,000,000.00) as exemplary
damages;
Dismissing the case against defendants Juan Ponce Enrile, Imelda Marcos and Ferdinand Marcos, Jr. for failure
of the republic to establish preponderance of evidence against them;
Dismissing defendants Juan Ponce Enrile, Imelda Marcos, Manuel Nieto, Jr., Jose Africa and Ferdinand Marcos,
Jr.’s, counterclaims and cross-claims for failure to present evidence to warrant the grant thereof; and
Dismissing Civil Case No. 0130 filed by Victor Africa for lack of merit;
The monetary awards herein decreed shall earn interest at the legal rate of six percent (6%) per annum from
the date of finality of this Decision until fully paid.
