MESSAGE
This 2019 Judiciary Annual Report is historic as it is delivered
in the middle of a global pandemic. In the year covered by this
Report, the Court has made significant strides in the automation of
its operations. As early as June 2019, the Guidelines on the Use of
Videoconferencing Technology for the Remote Appearance and
Testimony of Certain Persons Deprived of Liberty, or PDLs, in Jails and
National Penitentiaries was implemented and pilot-tested three
months after in Davao City courts. Subsequently, the Guidelines
was adopted in 22 courts. This, among other court projects, has
enabled us to weather the pandemic and continue to perform our
constitutional mandate to uphold the Rule of Law at all times.

As I have always emphasized, the courts are not shutting


down in times of emergencies, but have instead been made even
more accessible to everyone at all times given our reliable
Judiciary-wide technologies.

Rest assured that the Judiciary under my watch will continue


with its automation and other reform efforts guided by four core
areas — efficiency,
efficiency, integrity,
security, security,
security, and
and service.

the support of all justice stakeholders, which includes the
Executive and Legislative Departments, to which the Constitution
mandates the submission of this Report.

shareholders, namely: Victor Africa, Lourdes Africa ITF Natalie Africa, Lourdes Africa ITF Jose Enrique Africa,
Lourdes Africa ITF Paul Delfin Africa, Rosario Songco, Raquel Dinglasan, Manuel V. Nieto III, Ramon V. Nieto,
Victoria N. Legarda Ma. Rita N. Delos Reyes, Rosario N. Arellano, Angela N. Lobregat, Benito Nieto, Carlos
V. Nieto, Carmen N. Tuazon and Rafael Valdez, which were transferred to them by defendants Jose L. Africa
and Manuel H. Nieto, Jr., are ill-gotten wealth of defendant Ferdinand Marcos; hence, should be reverted/
reconveyed to the republic of the Philippines;

Ordering defendants Jose L. Africa and Manuel H. Nieto, Jr., substituted by their respective legal heirs,
to reconvey to the Republic of the Philippines their aforesaid shares in the Eastern Telecommunications,
Philippines, Inc. including all the stock/cash dividends received/ deposited and interests that may have
accrued/may still accrue thereto;

Ordering Aerocom Investors and Managers, Inc. and/or defendant Manuel H. Nieto, Jr., substituted by his
legal heirs, to pay the Republic the amount ₱68,167,610.93, which is equivalent to the value of its Eastern
Telecommunications, Philippines, Inc. shares it had transferred or conveyed to ISM Communications
Corporation on July 11, 2005.

Lifting the Order of Sequetration dated June 15, 1988 over Polygon Investors and Managers, Inc. for the
Republic’s failure to prove that the said corporation is part of the ill-gotten wealth of defendants Ferdinand
and Imelda Marcos;

Ordering defendants Jose L. Africa and Manuel H. Nieto, Jr., substituted by their respective legal heirs, to
jointly and severally pay the Republic of the Philippines One Million Pesos (₱1,000,000.00) as exemplary
damages;

Dismissing the case against defendants Juan Ponce Enrile, Imelda Marcos and Ferdinand Marcos, Jr. for failure
of the republic to establish preponderance of evidence against them;

Dismissing defendants Juan Ponce Enrile, Imelda Marcos, Manuel Nieto, Jr., Jose Africa and Ferdinand Marcos,
Jr.’s, counterclaims and cross-claims for failure to present evidence to warrant the grant thereof; and

Dismissing Civil Case No. 0130 filed by Victor Africa for lack of merit;

The monetary awards herein decreed shall earn interest at the legal rate of six percent (6%) per annum from
the date of finality of this Decision until fully paid.

Jose, Antique second floor of the existing Hall of Justice to
house the 1st level courts (Municipal Circuit
Trial Court [MCTC]) within the territorial
jurisdiction of RTCs. Relocating the MCTC
outside its territorial jurisdiction will require
the approval of the Court. As such, the
determination of the final scope of works
cannot proceed.
20 RTC-Bugasong, VI 100,000,000.00 The proposal includes the expansion of the
Antique existing Hall of Justice constructed through
JUSIP but not yet turned over to the Court.
The expansion will house the MCTCs within
the territorial jurisdiction of the RTCs. The
relocation will require approval of the Court.
If the request will not be approved, another
option is to construct the MCTC Hall of
Justice in their respective jurisdiction but will
require provision of lot either through LGU
donation or purchase. As such, the finalization
of the scope of works cannot proceed.
21 RTC Br. 13, Culasi, VI 75,000,000.00 The proposal is for the construction of Hall
Antique of Justice to house the RTC, Branch 13 and
MCTCs. For provision of lot either through
LGU donation or purchase. The request
to house the MCTCs, outside its territorial
jurisdiction will require approval of the
Court. If the request will not be approved,
another option is to construct the MCTC Hall
of Justice in their respective jurisdiction. As
such, the finalization of the scope of works
cannot proceed.

AUTOMATED HEARING UPDATE


In 2019, the Philippine Judicial Academy and the Special Committee on Speedy Trial
conducted a series of training workshops on Automated Hearing to 683 court employees
representing 97 trial courts from the cities of Caloocan, Las Piñas, Malabon, Marikina,
Muntinlupa, Parañaque, Taguig, and Valenzuela. Held in partnership with the Governance
in Justice Programme (GOJUST) with the support of the European Union, the training
workshops were organized and designed to teach the participants how the automated
hearing process works and how it improves court efficiency in the trial courts. The
participants experienced applying this new intervention through group exercises and
simulation activities.
