establishing and solving problems related
to the Fiqh?
Definition of Sunnah
Literal Meaning
a clear path or a beaten track
·normative practice, or an established course of
conduct whether it is good or bad
·In pre-Islamic Arabia, the Arabs used the word
‘Sunnah’ in reference to the ancient and continuous
practice of the community which they inherited from
their ancestors.

Technical Meaning

Prophet (SAW). Including his statements, actions, tacit
approvals, personality, physical description, or biography.

Sunnah vs Hadith
Hadith: A narration of the sayings of the Prophet s.a.w
Sunnah: The practices of Prophet. E.g, His sayings, actions,
and tacit approval.
.
Position of Sunnah as a source of law

sources of Islamic law
Sunnah is one of the primary

The next reference after the Qur’an. In case when the

jurist does not find a text in the Qur’an for a case he has
to settle, he has to recourse to the Sunnah in the
derivation of the rule.

Proof of the Sunnah as the source of law is established by

Qur’an and Ijma’
The justifications by the Qur’an
1.

The Qur’an points out that whatever originated from the

Messenger of Allah does not come out from his own desire but is a
type of revelation.
"Nor does he say (aught) of (his own) desire. It is no less than inspiration
sent down to him” (Al-Najm : 3-4)

2. There are many verses of the Qur’an command the believer to

follow the Sunnah or to obey the Messenger of Allah.
"And whatever the Messenger gives you, take (observe) it, and whatever he
forbids you, abstain from it.” (al-Hashr(59):7)
The justification on the basis of Ijma’

All Muslims during the period of the Holy Prophet

(PBUH) accepted sunnah as a source of law

The Muslims are bound to follow legal injunctions that

are derived from Sunnah

Role of the Sunnah with regards to the Qur’an:

It is a secondary and complementary to the Qur’an
It is an elaboration and explanation of the Qur’an
Three main roles of Sunnah in this regard are:

Reemphasizes of al-Qur’an

Explanation and Elaboration of al-Qur‘an

The Sunnah may enact a ruling on which the
Qur’an is not mentioned about it. (al-Sunnah al-
Muassisah)
Reemphasizes of al-Qur’an
The Sunnah reemphasizes the injunction of the
Qur’an
Qur'an: O you who believe! Eat not up your property among yourselves
unjustly except it is a trade amongst you, by mutual consent.
[Al-Nisa’: 29]

Prophet Muhammad SAW said:

“It is unlawful to possess a property of a Muslim without his express
consent” (It is reported by al-Darqutni)
Explanation and Elaboration of al-Qur‘an
Sunnah explains and elaborates the concise injunctions
.of the Qur’an
Example: The Sunnah explains the manner of performing
prayer

TheQur'an:“And perform al-salah, ……”.[Al-Baqarah:110]

Hadith:Perform the prayer as you see my prayer.
To Enact Rulings (al-Sunnah al-Muassisah)
The Sunnah may enact a ruling on which the Qur’an
not mentioned. This kind of Sunnah is referred to
as al-Sunnah al-Mu’assisah or the founding Sunnah.

Example:The punishment of rajm (stoning to death) for

adultery committed by married Muslim, and the
prohibition of wearing a gold ring by man
Conclusion
The Sunnah is important in fiqh ruling. Without this
source, the Muslim world will face many obstacles
regarding fiqh and in solving several issues that have
not been mentioned in Qur'an.
