W I T N E S S E T H:
WHEREAS, the SELLER is a conjugal owners of a parcel of land denominated as Lot No.
4299-E Portion of Tacloban cadastral survey, Csd-08-006868-D being a portion of Lot 4299,
situated at Brgy. Cabalawan Tacloban City by virtue of Extrajudicial Settlement of Estate among
heirs of Spouses Iluminado pulga and Rufina Doldol Pulga on October 10, 1998 and entered in
the Notarial register of Atty. Generoso Casimpan as Doc. No. 466’ Book No. 95; Series of
1998;
NOW THEREFORE, for and in consideration of their mutual covenants, the parties
have hereunto entered into this agreement the following terms and condition to wit:
1. That the parties agreed the selling price is ONE MILLION PESOS
(Php1,000.0000)
2. That the first payment to be paid by the buyer to the seller is Seven Hundred
Thousand Pesos ( Php 700.000.00)
3. That the second payment to be paid by the Seller to the buyer is Two
Hundred Thousand Pesos ( Php 200,000.00)
4. That the remaining balance of One Hundred Thousand Pesos
(Php100,000.00) shall remain to the buyer for the expenses stated in Par.
5 and 6 in this memorandum agreement;
5. That the payment of Estate Tax of the late Iluminado Pulga and Rufina D.
Pulga and the late Iglecerio Jecino and other incidental expenses shall be
shouldered by the SELLER;
6. That the Capital gains, Documentary Stamp tax, Notarial fees and other
fees relative to the sale between hrs. of Iluminado and Rufina Pulga and
Spouses Iglecerio and Dionisia Jecino shall be shouldered by the SELLER;
7. That pertaining to the sale of the herein parties, capital gains, Documentary
Stamp tax, Notarial fees and other miscellaneous expenses shall be
shouldered by the BUYER;
8. That the parties herein agreed that the BUYER and SELLER equally divide
for the payment for the transfer of the house erected on the subject property
base on the market value of the house;
9. That once the Seller acknowledge to receive the amount of Nine Hundred
Thousand Pesos (900,000.00) from the buyer , the buyer will immediately
took possession of the subject property;
10. That after the registration of the sale in favor of buyer before the office of the
City Register of Deeds of Tacloban and issuance of new tax declaration in
the name of buyer, the buyer will liquidate the expenses return to the seller if
any remaining balance of the expenses to the sell.
IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this __

ACKNOWLEDGMENT
BEFORE ME, a Notary Public, in and for the City of Tacloban, Philippines, this
_______________, personally appeared:
foregoing instrument and acknowledged to me that the same is their own free and voluntary act
and deed. This Memorandum of Agreement consists of two (2) pages duly signed by the parties
and their instrumental witnesses at the dispositive portions of this page and the left margin of all
other pages.
