me and my wife and my child as my back rider in going home coming from
Tuguegarao City proper;

4. That in the Capatan Provincial Road, Tuguegarao City we met a vehicular


accident wherein another motorcycle bumped us;

5. That due to said incident, the motorcycle is now under the custody of the
Tuguegarao City Police Station;

6. That it is my desire to take custody of said motorcycle for purposes of


repairing the same, for my family used as the our only mode of transportation
and to avoid complete deterioration pending the outcome of any settlement
and/or any court proceedings between the parties, and to produce the same
whenever required;

7. That I am executing this Affidavit in order to attest to the truth and veracity of
the foregoing statement.

That said motorcycle was registered in my name and I was issued by the LTO,

the Writ of Execution;

4. That said amount above-mentioned was received by the undersigned,

5. That upon receipt of the said amount, undersigned immediately went to the given
record of address of the private complainant to personally deliver the same but
failed for the reason that at the time of delivery he is out of his residence;

6. That undersigned again tried to deliver the said money on different time and date
but failed;

7. That undersigned advice herein relatives of the private complainant to inform


him to proceed to this Court anytime to personally receive the said payment of
accused Cirilo Beran;

month on the ground that some terms and conditions contained in the
said agreement where failed to comply by you.

Formal demand is, therefore served upon you to pay the amount

compelled to institute the appropriate legal action against you.

MOTION FOR RECONSIDERATION


COMES NOW, movant through himself and unto this Honorable
Provincial Prosecutor, respectfully alleges that:

1. On November 13, 2015, movant received a copy of the


Order of this Honorable Provincial Prosecutor denying
movants’ motion to release vehicle, the dispositive portion of
the Order states:

“Wherefore, premises considered, the Motion to


Release of Motor Vehicle filed by the GEOFFREY
U. VILLOTA is hereby ordered denied.

SO ORDERED”, a copy of the order is hereto


attached as annex “A”;

2. That the denial of the said motion are based on the


following grounds:

a. For failure of movant to attached supporting


documents as such Certificate of Registration, stencil
of the Engine number of the vehicle and a certification
issued by the PNP, Cabatuan, Isabela certifying that
attached pictures are indeed the one that is
impounded in their office;

3. That movant respectfully prays for the reconsideration of


said order and hereby submits the said lacking documents,
the Certificate of Registration, hereto attached and
marked as annex “B”, the Certification issued by the
PNP, Cabatuan, Isabela, hereto attached and marked as
annex “C”, pictures numbered 1 and 2 are hereto
bracketed and marked as annex “C-1”, stencil of the
engine number is hereto bracketed and marked as annex
“D” and pictures numbered 3 and 4 are hereto also
bracketed and marked as annex “D-1” respectively;

WHEREFORE, premises considered, Movant respectfully prays for


the reconsideration of the Honorable Provincial Prosecutor’s 8 October,
2015 Order, issuing a new one granting movants prayer to release his
motor vehicle.

Other reliefs as are just and equitable are likewise prayed for.

AFFIDAVIT COMPLAINT
I, FLORDELIZA BASSIG y DE LEON, of legal age, Filipino,
married and a resident of Andal Street, Cataggaman Viejo, Tuguegarao
City, after first being sworn according to law, do hereby depose and
state:

1. That on December 12, 2015 at around 5:00 o’clock in the


afternnon, I went to the house of my brother Gilbert De
Leon at Centro 7, Burgos Street, Tuguegarao City, Cagayan,
for the purpose of meeting my sister in the person of
Benedicta Martin;

2. That my sister and I saw each other and after some


conversations, I asked her to return my blouse which is a
gift from me by my “kumare” which she recently borrowed;

3. That instead of returning my blouse she became unruly (got


mad) and uttered unsavory remarks to the extent of saying
the following remarks to quote “SAKBAY MO MAALA
GITTIGITTINGEK PAY LANG DADAILEK UMUNA BEFORE MU
MAALA URAY MANU NGA FERDIE TI SANGWEK HAANAK
MABUTENG” which means before you can get it back I
will cut it first into pieces and I can confront as many
Ferdie’s and I am not afraid;

4. That due to said remarks I was insulted and went near her
for purposes of confronting her;

5. That to my surprise, after going near to her, she


immediately grab my hair and pulled it so many times;

6. That due to what she did, I tried to stop her but she
continuously pulled my hair, to defend myself and in order
to evade her we grappled each other;

7. That she only stop pulling my hair when my brother, my


sister in-law and the step mother of my sister in-law pacified
her;

8. That due to the said incident, I suffered bruises in my face


and in my left arm and some of my hair strands were also
uprooted;

9. That I am executing this affidavit to prove the veracity of


the foregoing statements and in support of my complaint to
be filed against my sister BENEDICTA MARTIN for all
appropriate offense that may be charged against her under
the law.

of Tuguegarao City in reference to the furnished copies of Writ of Execution and
Notification sent thru registered mail by the undersigned to your good office.

Please be informed that undersigned is only following procedures as per Office


of the Court Administrator Circular No. 11-013 of the Supreme Court, that all Writ of
Executions and Notification prior to its implementation, your good office and the
Presidential Commission for the Urban Poor must be furnished copies of the same and
furnishing the said documents does not mean automatically seeking for police
assistance.

As procedure we can only seek police assistance upon motion by herein


undersigned to the Court a quo who issued said Writ as need arises and the same be
granted by the Honorable Court.

Rest assured that before undersigned will seek police assistance proper Court
Order will be issued granting the same and proper protocols, coordination and
pertinent documents will be attached in Relation to Rule 28.2 of the Revised

4. That on May 6, 2016, upon the recommendation of the Probation Officer assigned to
this case, the Court hereby grants probation unto petitioner-accused;

5. Considering that she is now granted probation by this Honorable Court, she is now
respectfully requesting that the bond posted for her provisional liberty be withdrawn
and to be used as payment of her civil liability to the complainant;

more or less. To make this project possible, we started to contribute

good Honorable Governor respectfully states:

1. Undersigned for and in behalf of his parents and siblings, are


all residents of 72 Pilapil Street, Barangay Centro 10,
Tuguegarao City, Cagayan;

1. His parents erected their house at 72 Pilapil Street,


Tuguegarao City in the year 1973 as per approval of then
Tito Dupaya as Governor of the Province of Cagayan as
caretaker of said lot considering that at that time his father
is a Utility worker of the Regional Trial Court wherein said
offices were in-house on said building owned by the
Province of Cagayan on the same premises;

2. Undersigned, his parents and siblings were open,


continuously and uninterruptedly in possession, stayed and
erected their house on said portion of lot owned by the
Province of Cagayan, to proved said allegation Barangay
Certificate issued by Honorable Rommel Arugay as Barangay
Chairman of Centro 10 is hereto attached;

3. That in the year 1980’s houses were erected on said


premises which is owned by the Province of Cagayan but
removed during the term of Governor Rodolfo Aguinaldo but
we were excluded;

4. That again in the early year of 2000, houses and shanties


were build by the Spouses of Provincial prisoners and during
the term of then Governor Alvaro Antonio, the same were
demolished and families were relocated at a housing project
of the Province of Cagayan and the City of Tuguegarao at
the Barangay Annafunan and Barangay Cataggaman wherein
we were again excluded for the reason that our house was
erected at the least right corner of the lot and
acknowledging us as caretaker /tenant under public tenancy
for residing on said portion for more than forty (40) years;

5. That on December 14, 2017, at the office of Barangay


Chairman Rommel Arugay, a dialogue between herein
undersigned, Atty. Vicente Lasam, and an employee of the
Engineering Department of the Province of Cagayan was
done, after which an ocular inspection was conducted on
said premises to check the exact area were our house was
erected on the lot owned by the Province of Cagayan;

6. That as per ocular inspection, they found out that our house
was really located at the least right corner portion of the lot
owned by the Province of Cagayan and will not anyway
obstruct or destroy the beautification being implemented by
your good office;

Undersigned, his parents and siblings respectfully seeking your


good heart and for humanitarian consideration as a father of the
Province of Cagayan that our house erected on the least right corner
portion of the lot owned by the Province of Cagayan be spared for its
removal and/or demolition.

A member in good standing is one who:

a) Has paid the required membership fee;

c) has not violated any provision of any existing laws, rules and
regulations and other issuances of the scholl, the by-laws,
membership agreement or any other instrument required to
be executed for the benefit of the pupils and school;

A member is deemed in good standing unless there is an act or

Sec. 4 Duties and Obligations of a member:

The following shall be the duties and responsibilities of a member:

a) to comply with the rules and regulations of the organization;

b) to attend, participate and to vote in membership meetings;

c) to attend aseminars required by the school, if any;

d) to assist/participate in the implementation of any program of


the organization and the school;

e) to comply with all other membership obligation;

f) to give support with all other members of the organization,


morally, spiritually and financially, if possible.

Sec. 5 Rights and privileges of a member in good standing:

The rights and privileges inherent to any member in the


organization shall be available only to members in good standing.
The following are the rights and privileges of the member:

a) to participate in the deliberation during membership assemblies


and vote all matters brought before the assembly;

b) to participate in any social activities of the organization;

c) to be elected as officer or committee member;

d) to be qualified to all service/assistance available from the


organization without any discrimination;

e) to exercise such rights and privileges granted to any member.

Sec. 6 Liabilities of a member:

a) He/she is liable to any violation committed against the rules


and regulations of the organization and shall be dealt with
accordingly by:

1. Disciplinary Action
2. Expulsion from the organization
b) He/she be solely liable to his/her own act or omission
contrary to the rules and regulations of the school;

c) He/she is liable for any act or omission, injurious or


prejudicial to the interest or welfare of the organization.

Sec. 7 Membership Fee:

a) A membership fee be automatically collected to the members


upon enrolment of their children in the amount of One
Hundred Pesos Only (Php100.00);

b) Monthly dues of Ten Pesos Only (Php10.00)

GOVERNMENT
Sec. 1 General Assembly:

Subject to any provisions, final and executory resides in the General


Assembly:

The power of the General Assmebly ar as follows:

a) to elect or appoint a member or remove the same for valid


cause;

b) to hear and act upon the reports of the officers and


committees;

c) to mediate in disputes or disagreements between the


organization and the school;

d) to approve development plans/projects of the organization.

Sec. 2 Regular General Assembly:

The members shall meet at least once twice (2) every school year,
wherein one will be on 3rd Friday of October and next will be within
thirty (30) days before the summer break preferably on the 3 rd
Friday of February. The meeting shall be held at the TECS
Gymnasium.

Sec. 3 Special General Assembly:

A special general assembly may be called at any time by the GPTA


President or by the majority of the GPTA officers to take-up urgent
matters requiring the consensus of the members.

Sec. 4 GPTA Officers Meeting:

The Officers shall meet at least once a month. The meeting shall be
held preferably on the 3rd Friday of every month.

GREETINGS!!!

I write to you regarding to your loan obligation in the amount of One


Hundred Thousand Pesos (Php1000,000.00). That I grant you said loan
obligation because you earned my trust and confidence.

That in view of said loan you agreed that the payments be made with
interest, will be paid in post dated personal checks, in various amounts.

In December, 2010 simultaneously in receiving the amount of One


Hundred Thousand Pesos (Php100,000.00) loan in cash, you issued four (4)
checks. (Attached herewith are copies of the four (4) checks)

That on the date of maturity of said checks in the month of January and
February, I deposited the same and it turned out your checks were dishonored
by the drawee bank for the reasons ACCOUNT CLOSED.

That verbal demand were immediately made by me for payment after the
dishonor of your two (2) checks, which you promised will be attended to but
you miserably failed to do so including the two (2) checks in the month of
March and April which was not even deposited by me because you asked me
not to deposit/encashed the same as you promised to pay the value of said
checks in cash.

Moreover, considering your continued failure to pay your loan


obligation, the total interest will be determined on the date you finally make the
payment reckoned from the date when you defaulted in your payment.

Consider this as my final demand for you to pay, otherwise I will be


forced to take such legal action/s that is/are appropriate under the laws of the
Philippines.
