3. WHEN: At about 3:00 o'clock in the afternoon of September 5, 2021.
4. WHO : A). Victim; Marianne Gonzales 25 years old, female, single, Filipino and a
resident of Ormoc City. B). Suspect; Noly Buscay 32, years old, male, married, driver, and a
resident of Brgy. Mejia, Ormoc City. Gonsalo Cruz 29 year’s old, male, single, laborer, Filipino
and a resident of Brgy. Mejia, Ormoc City.
5. WHY : Rape/Sexual Attempt
6. HOW:
At about 3:00 o'clock in the afternoon of September 5,2021 there were two residents of
Brgy. Macabug ,Ormoc City named Protacio Ecleonil y Boholst 21 years old, single, college
student and a highschool student named Jose Ecleonil y Boholst 17 years old, single, reported at
Ormoc City Police Station 1 Brgy. Cogon, Ormoc City that there was a dead body floating at
river bank of Macabug river located at sitio dump site, Brgy. Macabug, Ormoc City. Acting on
the said report personnel of this station led by PSSg Rolando P. Cabrera immediately proceeded
to the reported place.
Upon arrival at the crime scene, responding police officer saw the dead body of the
undetermined female person who was floating at the river bank and discovered that the dead
body was Marianne Gonzales a 25 years female and a resident of Ormoc City.
The immediately brought the dead body of the victim to the hospital, as what the
examined they found out a fresh laciration on vagina with the presence of undetermined quantity
of sperm cells and the cause of death is Axphysxia by Extrangulation.
During the crime investigation the two suspects named Noly Buscay arrested during hot
pursuit operations for his initial violation of the case RA 10591 and RA 9165 and possitively

identified by witness named Nancy Cabahug to be the responsible for the death of the victim
including Gonsalo Cruz who remains at large as of this time. Progress report will follow.

Person by virtue of citizen’s arrest.

On the previous operation conducted by Ormoc City Police Station 1, suspect (1)NOLY
BUSCAY 32 years old, male, married, driver and a resident of Brgy. Mejia Ormoc City was
arrested during hot pursuit operation on the same date. After a week of arrested in suspect
number 1, a voluntarily witness named Nancy Cabahug 27 years old, married, fishvendor,
Filipino and a resident of Ormoc City came to Police Station 1 and give information everything
about where the suspect number 2 was hiding off in Baybay City. And also she offers herself to
testify in the court as a witness.
In coordination of Ormoc City Police Station 1 into Baybay Police Station was conducted
a hot pursuit operation. Minute ago Police Station 1 received a mystery caller coming from
unidentified person that he act a buyer of shabu to the said suspect. Upon arrival of the join task
force of Ormoc City Police Station 1 and the Baybay Police Station the suspect is already
overcome by the concern citizen named Franko Tampus and the suspect identified by the Police
Officer was Gonsalo Cruz 29 years old, male, single, laborer, Filipino and a resident of Brgy
Mejia Ormoc City, and it was recover to him a sachet of suspected drugs, 1 caliber 45, and a
drug money
Gonsalo Cruz was violates RA. No 8353 known as the “Anti- Rape Law”, RA No. 9165
commonly known as the “Dangerous Drugs Act of 2002” and the RA. No 10591 known as the
“Comprehensive Firearms and Ammunition Regulation Act.

1. On September 5,2021 at about 3:00 o'clock in the afternoon there was an incident
happened at Macabug, Ormoc City. Wherein there was two resident named Protacio Ecleonil y
Boholst 21 years old, single, college student and his brother Jose Ecleonil y Boholst 17 years old,
single, highschool student who are concerned about on what they saw, a floating lifeless body at
river bank of Macabug river located at Macabug, Ormoc City. As they investigate the dead body
of the dead body of the victim it was Marianne Gonzales a 25 years old, female, single, Filipino
and a resident of Ormoc City. The victim was raped by the two suspects and a resident of Brgy.
Mejia Ormoc City named Noly Buscay 32 years old, male, married, driver, Filipino and Gonsalo
Cruz 29 years old,male, single, laborer, and also a Filipino.
2. As the result of examining the body of the victim was found out with fresh laciration
on vagina with the presence of undetermined quantity of sperm cells, and it was clearly that the
victim was raped. The suspect Noly Buscay and Gonsalo Cruz was arrested during hot pursuit
operation for his initial violation of the case RA 10591 and RA 9165 and possitively, identified
by the witness,named Nancy Cabahug 27 years old, married, fish vendor, Filipino and a resident
of Brgy. Macabug, Ormoc City. To be responsible of the death of the victim.

kasong ito, ang magbabantay sa nagpapatuloy na pagsisiyasat.
Dahil nasa kustodiya ka ng pulisya at mayroon kang kaso na Anti-Rape Law, sa oras na ito ay
iniimbestigahan ka para sa panggagahasa kay Marianne Gonzales, isasama ka sa imbestigasyon

Philippine National Police (PNP) and presently assigned at Ormoc City Police Station 1, after

At exactly 3’00 0’clock in the afternoon September 05, 2021 PROTACIO
ECLEONILY BOHOLST, 21 years old, Single, College Student and JOSE
ECLEONIL Y BOHOLST, 17 years old, Single, High School, Both resident of Brgy.
Macabug, Ormoc City, Personally appeared at Ormoc City Police Station 1. To report
that around 1 o’clock in the afternoon same date they saw a lifeless body floating along
the river bank of Macabug, Ormoc City.
Thereafter, our chief of Police directed us together with my comrades to respond and
proceed to the reported place of incident to verify the veracity of the aforementioned
information and if affirmative, to conduct an ocular investigation.
Upon arrival at the place of incident. The first suspect NOLY BUSCAY, 32 years
old,male, resident of Brgy. Mejia Ormoc City, Arrested during Hot-pursuit operation and
confiscated a suspected drugs and illegal handling of firearms.
Furthermore we were informed by the said NANCY CABAHUG that the second suspect
hurriedly escaped. But weeks after the incident happen there are concerned citizen who
called or a mystery caller called at Police Station 1 and tell us where the suspect 2 hiding
off at Baybay City.
In coordination of Ormoc City Police Station 1 into Baybay Police Station was
conducted a Hot-pursuit operation the suspect has been already subdue by the concern
citizen. The suspect identified as GONSALO CRUZ 29 years old, male, single,laborer,
resident of Brgy. Mejia Ormoc City, was recover to him the 3 sachets of the suspected
drugs, 1 caliber 45 and a drug money.
Both suspects was violates RA.NO. 8353 commonly known as the “Anti-Rape Law”
RA. NO. 9165 or commonly known as the “Dangerous Drugs Act of 2002” and the RA.
NO.10591 commonly known as the “ Comprehensive Firearms and Ammunition
Regulation on Act”
I executed this affidavit to the best of my knowledge of the facts and circumstances to
support for the filing of appropriate charges against the suspects in court.

I, NANCY CABAHUG 27 years old, married, fishvendor, Filipino and a resident of Ormoc City,
after having been sworn in accordance with law, do hereby depose and state that:
1. I was present and personally saw that accused. Noly Buscay and Gonsalo Cruz,
committed the crime of Rape against the victim named Marianne Gonzales.
2. Noly Buscay and Gonsalo Cruz, I saw these two person near at the River Bank like they
are watching someone. Over there Marianne Gonzales walking towards at the River bank.
3. Marianne Gonsalez sense that there are two men’s watching and following here bound at
river bank. When Marianne Gonzales feel uneasy she plan to run but she’s running out of
time because these two suspects grab her and lifted her up.
4. It happened on September 05, 2021 at exactly 1pm in the afternoon. I was about to help
Marianne Gonzales but I was afraid that they might hurt me as will or worst kill me. So I
decided to follow them where they take Marianne Gonzales and I witness everything
happened to Marianne Gonzales. Like how they rape here and kill her.
5. They took the body of Marianne Gonsales at the River Bank and threw it. And I really
confirmed that these two men’s who did brutal to Marianne Gonzales was Noly Buscay
and Gonsalo Cruz both resident of Brgy. Mejia Ormoc City.

One (1) caliber 45 pistol with no serial number, a chamber loafer.
Six (6) live rounds in the magazine marked "RDP 1-8"; and retained bullet fragments.

TYPE AND PURPOSE OF LABORATORY EXAMINATION:
To determine whether the caliber of the firearm used to discharge the item marked "RDP
1-8." To see if the "RDP 1-8" objects were all discharged from the same caliber 45 firearm.
FINDINGS:
Laboratory Examination conducted on the above mentioned specimen gave the following
results:
1. The object labelled "RDP 1-8" has the same class characteristics as caliber 45 bullet lead
cores fired from a caliber 45 firearm upon physical testing and comparison.
2. Microscopic analysis and comparison of the "RDP 1-8" items indicated that they all had
the same individual characteristics.

CONCLUSIONS:
The piece stamped "RDP 1-8" is a caliber 45 bullet lead core fired from a caliber 45,
based on the preceding findings. The "RDP1-8" pieces were all fired from the same caliber 45
firearm.

The said victim was found out to have a lone stab wound on her left chest to death by one
NOLY BUSCAY 32 years old, male, married, driver, Filipino resident of Brgy. Mejia
Ormoc City on September 05, 2021 at about 1:00 o'clock in the afternoon along the river
bank of Macabug river located at sitio dump site, Brgy. Macabug, Ormo City.
2. Further, this office will be furnished a copy of the results of the said examination,
which will be used in the investigation and to support the filing of appropriate cases in
court against the above-named suspect.

SPECIMEN SUBMITTED:
The cadaver of MARIANNE GONZALES, 25 years old, female, single, Filipino
resident of Ormoc City.

Forensic Autopsy and to determine the cause of death.
FINDINGS:
POSTMORTEM FINDINGS:
The body of a grossly pale female cadaver was fully developed, fairly nourished with
fresh laciration on the vagina with the presence of an undecided quantity of sperm cells. The post
mortem/autopsy result of the victim was found to have a lone stab wound on her left chest. 900
ml of blood was found in the left pleural cavity, and 20 ml in the heart sac. The post-mortem
internal examination showed no natural disease.
CHEST and ABDOMEN:
An external examination of the corpse revealed the presence of numerous stab wounds
on the chest and abdomen as well as a dozen or so superficial pricks and several superficial
chafes of the epidermis in these areas. There were no injuries to the back of the body. No injuries
suggesting defense wounds or hesitation marks were identified either.

Cause of death: Multiple stabbing in sex-related homicides.
