Draft Agreement

LEASE AGREEMENT

This LEASE AGREEMENT is made here at New Delhi on day, date

between
Mr., X s/o ______A_______, R/o _________D block______________ (M): (hereinafter
called the ‘LESSOR’, which expression shall unless excluded by or repugnant
to the context include his/her heirs, executors, administrators,
representatives and assigns) of the ONE Part
and
Mr. __________IHG______ S/o _______JFK_____________, R/o ____________________ (M):
(hereinafter called the ‘Lessee’ which expression shall unless repugnant to
the context or meaning thereof include his/hers successors and assigns) of
the OTHER PART.

NOW THIS AGREEMENT WITNESSTH AS FOLLOWS:


In consideration of the rent hereinafter reserved and all the covenants and
conditions hereinafter contained to be observed and performed on the part
of the Lessee, the LESSOR hereby grants on LEASE to the Lessee,
Flat/floor/House No _____________________________________________________
(hereinafter called the said Premises) consisting of ____ Bedrooms, _______
Toilet-Baths, a drawing cum dining room, a kitchen, complete with fittings
and fixtures and one reserved covered car parking space, for a period of 11
Months commencing from _____________ up to _________________________ and on a
mutually agreed Rent of Rs - (Rupees in words) per month
including/excluding maintenance, payable in advance, subject to the
following terms and conditions:
1. That the Lessee agrees to pay to the Lessor the said monthly
rent in advance by cheque/draft/online transfer on or before
_________10th__
day of each English Calendar month.
2. That the Lessee has paid to the Lessor one month’s advance
rent of Rs. 10000 /- and two months’ security deposit of
Rs. /- (Rupees in words). The security deposit shall be
refunded to the Lessee upon termination of this Lease
Agreement and peaceful vacation of the premises after
deducting outstanding dues, if any.
3. That the Lessee agrees to pay the electricity, common utilities
bill that is charged on usage basis and is paid to the concerned
authorities/housing society on a monthly basis. The electricity
bill at the time of handing over the Premises to the Lessee is
paid up-to-date with no dues.
4. At the time of commencement of this Lease Agreement, the
Lessor has handed over the Premises to the Lessee in excellent
and tidy condition, whitewashed and together with the
Lessor’s fittings and fixtures which include,
_____________________list________________________ – all in running
condition. Upon the expiry of this Agreement, the Lessee
agrees to return the vacant possession of the premises in the
same condition failing which the Lessor shall deduct any
expenses incurred towards renovation of the premises from
the security deposit of the Lessee.
5. That the Lessee agrees to keep the interior of the said Premises
in good order and condition (reasonable wear and tear
excepted) and attend to all minor electrical and sanitary
maintenance and repairs such as fuses, leakage of water taps
etc. at his own expense. The Lessee further agrees not to carry
out any structural change, addition or alteration in the said
Premises including nails, screws or tapes on the walls of the
said Premises.
6. That as per this Agreement, the Lessee is allowed to use the
said Premises for residential purpose only and agrees not to
carry out any dangerous, illegal and unlawful activity in the
said Premises. Further, the Lessee undertakes to occupy the
said Premises and use the common areas, peacefully without
causing undue nuisance, hazards or obstruction to other
residents in the building.
7. That the Lessee agrees not to sub-let, assign or otherwise part
with possession of the said Premises without the consent of
the Lessor The Lessee also agrees to give free and
unobstructed access to the Lessor or his authorized
representatives into the said Premises for inspection or any
other appropriate purpose, by being intimated in advance of
the same.
8. That the Lessor or Lessee are entitled to terminate this Lease
Agreement at any time during the initial or renewed terms of
the lease upon serving One month’s written or verbal notice of
their intention to do so.
9. This Lease Agreement is being made for a duration of 11
months starting from _______1st Jan 2000_________________ and
shall expire on _______________________________. Unless this Lease
Agreement is renewed on mutually agreeable terms and
conditions, the Lessee agrees to hand over the vacant
possession of the said Premises immediately upon the expiry
of this Agreement, failing which, he agrees to pay Rs
500/1000/2000/- per day to the Lessor till the vacant
Premises is handed over to the Lessor.
10. That the Lessor and the Lessee represent and warrant that
they are fully empowered and authorized to make this lease
Agreement and hold each other free and harmless of any
demands, claims, action or proceedings to one or the other in
respect of possession of the said premises. That in the event of
dispute, if any the Lease Deed is subject to the jurisdiction of
the Courts in _________city name__________.
IN WITNESS WHEREOF, the parties hereto have executed these presents
at Gurgaon on the day, month and year first above written in the
presence of witness.
