Parental right is a set of rights and duties which a father and a mother got by law in order to exercise it in favor of a minor child. All rights and duties covered by parental right are to be exercised by parents exclusively for the interest of a child. Today, a child is in a center of family life, therefore all relationships should be arranged so as to ensure best interest of the child. Parents are jointly responsible for a child, which means that they have to take all measures and actions to meet childs needs and interest. Interest of the child is the most important element in parental right, respectively relationships between parents and children. Mother and father become holders of parental right after birth of child. This right has only one parent when other parent is not alive or not familiar, or his parental right is abolished. Parental right is exercised agreeably and equally by parents. Namely, mother and father are equal as parents, i.e. as compared to children they have the same rights and duties. They make decision on all issues in agreement, though one parent does not always have to get approval from other parent, because it is assumable. Parents are independent upon exercising parental right, as compared to parents and children none has right to interfere. This parents autonomy is adhered to as long as parental right is exercised in the interest of child, and when it is exercised in interest of parents, by jeopardizing or violating interest of child, society, respectively country must intervene. One of the rights of child accepted in Convention on the rights of the child, which is directly linked to exercising of parental right and position of child in the family is right to identity, including citizenship, name and family bonds. Parental right is personal parents right. It cannot be transferred to other people, it cannot be inherited neither abalienated nor parents can waive it. Parental right ceases when child is in age of majority, respectively when he/she becomes capable of taking care of himself/herself, his/her rights and interests when getting in age of majority, child becomes totally independent from his /her parents.
Parental right covers rights and duties of parents towards children which are divided to those referring to personality and those referring to property of child. Rights and duties of parents are inseparably connected to rights and duties of children. A focus is on parents duties, respectively childs rights. Parents must take care of life and health of their children, as well as of their breeding, education and raising and disposal and management of their property. Children must take care of their parents, treat them with respect and help when necessary. Caring and raising child is the most significant obligation and right of parents. Education includes general and professional education of child so as to get child ready for independent life and work and involvement in the society. Parents give name to the child, and based on their residence address, childs residence address is defined. Duly exercising parental right, respectively proper physical and intellectual childs development and preparation for independent life is in the interest of social community.
