CHINTAMANI “B” CHS LTD, Behind Ice Factory, Siddhivinayak
Marg, Bhayander (West), Thane - 401101. Hereinafter referred to as the
“DONOR” (which expression shall unless be repugnant to the context or
meaning thereof be deemed to include his / her / their heirs executors,
administration and assigns) of the One Part.

AND

MRS. JYOTI SONU SONI Age 33 Years, an adult, Indian Inhabitant,

Having Address at Flat No. 16, Third Floor, SHRI CHINTAMANI “B”
CHS LTD, Behind Ice Factory, Siddhivinayak Marg, Bhayander (West),
Thane - 401101. Hereinafter referred to as the “DONEE” (which
expression shall unless be repugnant to the context or meaning thereof be
deemed to include his / her / their heirs executors, administration and
assigns) of the Other Part.

WHEREAS, MRS. JYOTI SONU SONI & MR. SONU NAJJU

SONI is the Joint owners and otherwise well and sufficiently entitled to a
Flat No. 16, on Third Floor, admeasuring about 350 Sq. Feet Super
Built Up i.e. 32.52 sq. Meters Super Built Up, in the building of the
society known as “SHRI CHINTAMANI “B” CO. OP. HSG. SOC.
LTD.”, lying and being at Behind Ice Factory, Siddhivinayak Marg,
Bhayander (West), Thane – 401101; standing on the plot of the land
bearing Old Survey No. 673, New Survey No. 259, Hissa No. 2 of
Revenue Village BHAYANDER, Bhayander (West), within the limit of
Mira Bhayander Municipal Corporation within the jurisdiction of the sub-
Registrar of Thane and Schedule hereunder written (hereinafter referred to
as “THE SAID FLAT”)

AND WHERAS the MR. SONU NAJJU SONI, has Purchased the
SAID FLAT with the joint name of MRS. JYOTI SONU SONI by
Agreement for Sale dated 31/12/2020, Flat No. 16, on Third Floor, in
the building of the society known as “SHRI CHINTAMANI “B” CO.
OP. HSG. SOC. LTD.”, at Behind Ice Factory, Siddhivinayak Marg,
Bhayander (West), Thane - 401101 of Revenue Village BHAYANDER,
AND the said Agreement for Sale dtd. 31/12/2020 was registered at the
office of the Sub-Registrar of Assurance at Thane under Registration No.
TNN-7-12203/2020, on 31/12/2020. And now the DONOR want to gift
his 50% of the share of the SAID FLAT to the DONEE i.e. 175 Sq. Feet
Super Built Up i.e.16.26 Sq. Mtr Super Built Up.

AND WHEREAS, the MRS. JYOTI SONU SONI & MR. SONU
NAJJU SONI herein is registered bonafide members of the SHRI
CHINTAMANI “B” CO. OP. HSG. SOC. LTD., A registered society
formed under the Provisions of the Maharashtra Co-operative Societies
Act, 1960 vide Registration No. (TNA / (TNA) / HSG / (TC) /
12794/2001-2002, to as “the said SOCIETY”, the Donor has agreed to
release, surrender Co-ownership rights, title interest and the said Premises
along with said 05 Shares and Share Certificate and all the amounts of the
said society and any to handover vacant possession of the said Premises to
the Donee herein. The Donor has also agreed to gift and surrender the
right, title interest, full Co-Ownership rights, shares of the membership in
the aforesaid society and shares of the total value of Rs. 250/- bearing
Distinctive Nos. from 071 to 075 [both numbers inclusive] under Share
Certificate No. 15 and also request the society to issue share certificate in
respect of the these Five Shares of the said society to the Donee along
with each and every deposits if any standing in the name of the Donor in
the said Society.

AND WHEREAS the Donor desires to grant the said shares and the
Flat No. 16 more particularly described in the schedule here under written
to the donee as gift in consideration of natural love and affection.

 AND WHEREAS the Donee has agreed and accepts the gift of the
said Flat No. 16 along with the above-said Five Shares as is evidence by
their executing these presents.

AND WHEREAS the Donee is the Wife of the donor.

NOW THESE DEED WITNESSETH AS FOLLOWS:

1. The Donor without any monetary consideration but in consideration

of his Natural Love and affection which the Donor bears to his Wife i.e.
the Donee herein doth hereby grant & transfer convey to the Donee by
way of gift the said Five Shares of Flat No. 16 more particularly
described in the schedule hereunder written together with and singular the
said Flat No. 16, all the thing permanent attach hereto together with all
the amenities and all the privileges, easements advantages and
appurtenances thereto and all estates rights, title, interest, use, inheritance,
possession, benefit, claim and demand whatsoever of the Donor in the
said Flat No. 16 and to hold the same unto and to use and benefit of the
Donee absolutely but subject to the Donee becoming member of the
SHRI CHINTAMANI “B” CO OP HSG. SOC. LTD. at Behind Ice
Factory, Siddhivinayak Marg, Bhayander (West), Tal. & Dist. Thane.
401101, and payment of all taxes, rates, assessments, dues, outgoing and
duties hereafter chargeable thereon by the Government, Mira Bhayander
Mahanagar Palika, Adani or other Authority.

2. The Donor does herby covenant with the donee that the donee now
has in herself good rights, full power and the absolutely authority to grant
the said Flat No. 16 more particularly describes in the schedule here
under written granted as gift to the donee in the manner aforesaid.

3. The donor does hereby further covenant with the donee that the
donee may at all times hereafter peacefully and quietly enter upto, have
occupy possess and enjoy the said Flat No. 16 and personally occupy the
same with his family members or give the same on rental basis or on any
other basis and receive the rents and profits thereof and use the same for
his own benefits without any eviction, interrupts, claims or demand from
the donor or his heirs, executors or assigns or any person or person
lawfully claiming or to claim by from under or in trust for the donor.

4. The Donor has handed over possession of the said Flat No. 16 to the
donee on or before the execution of this gift deed and the Donee hereby
confirms having taken possession of the said Flat No. 16 from the donor
that has accepted the same as Gift.

5. The Donee shall pay his share of taxes, outgoings, etc, in the respect
of the said Flat No. 16 to the said society from the date hereof.

6. The Donee shall abide by all rules and regulation and bye laws o of
the said society and shall pay and discharge all calls, demands,
contributions, etc, which the said society may hereafter make in the reset
of the said Flat No. 16 in the said society.

7. The donor has no objection if the Tata transfer/Adani the customer

number along with the deposit in respect of the electric connection of the
said Flat No. 16 after the same are transferred in the name and favor of
the donee.

8. The Donor shall execute all the necessary documents, transfer forms
application forms, acts, deeds and things whatsoever to get the said Flat
No. 16 transferred in the name of the donee in the record of the society

9. All the stamp duty and registration charges and other levis
whatsoever of and incidental to this gift deed in pursuance hereto shall be
exclusively and entirely borne and paid by the donor.

10. The parties hereto hereby state that the contents of this gift deeds
have been explained to them and they have properly understood all the
contents of the same and thereafter they have signed it with their own free
without any force, coercion, compulsion and under influence and in their
proper state of mind.
