Section 1. Councils – The Continuing Professional Education (CPE) Councils created by PRC
Resolution No. 381, series of 1995, issued pursuant to Executive Order No. 266 issued on July 25,
1995, are hereby attached to the Professional Regulation Commission and its personnel complement

Section 2. Fees and Other Income – Subject to budgetary laws, circulars, and regulations, fees and
other charges collected by the CPE Councils pursuant to Resolution No. 381, series of 1995, issued

trust fund that shall be expended exclusively in accordance with the purposes of Executive Order

Section 3. Repealing Clause – All orders, guidelines and regulations or portion thereof which are in
conflict with this Administrative Order are hereby repealed or modified accordingly.

Section 4. Effectivity – This Administrative Order shall take effect fifteen (15) days after its
publication in the Official Gazette or in a newspaper of general circulation, whichever is earlier.

Section 1. Title – This Act shall be called the "PRC Modernization Act of 2000." (Short title)

Section 2. Statement of Policy - State recognizes the important role of professionals in nation-building and,
towards this end, promotes the sustained development of a reservoir of professionals.

Section 3. Professional Regulation Commission - There is hereby created a three-man commission, which
shall be attached to the office of the President for general direction and coordination.

Section 4. Composition - The Commission shall be headed by one (1) full-time Chairperson and two (2) full-
time Commissioners, all to be appointed by the President for a term of seven (7) years without
reappointment to start from the time they assume office. Appointments to a vacancy that occurs before
the expiration of the term of a Commissioner shall cover only the unexpired term of the immediate
predecessor. At the expiration of the Chairperson, the most senior of the Commissioners shall temporarily
assume and perform the duties and functions of the Chairperson until a permanent Chairperson is appointed
by the President.
The Chairperson or Commissioner shall be at least forty (40) years of age, holding a valid certificate of
registration/professional license and a valid professional identification card or a valid certificate of
competency issued by the Commission or a valid professional license issued by any government agency,
familiar with the principles and methods of professional regulation and/or licensing and has had at least five
(5) years of executive or management experience: Provided, That, one (1) of the Commissioners must be a
past Chairperson/member of a Professional Regulatory Board.

Section 5. Exercise of Powers and Functions of the Commission - The power of a chairperson and its role.

with the Law enforcement who keeps peace within the venue and around the venue before, during
and after the examination. That includes: Police, Soldiers and other government workers that
conducts peace.

Section 13. Appropriations - The amount that was used to implement this act shall be charged to the
PRC.

Section 14. Authority to Use Income - Authority to use income for this act such as the
implementation of the boards and other activities done in this act shall have the authority to use
income that was charged to the examinees.

Section 15. Penalties for Manipulation and Other Corrupt Practices in the Conduct of Professional
Examinations - All of the penalties that must be charged when someone made a misconduct,
dishonorable or dishonest things during the professional examinations, the amount of penalties and
their time to serve in prison.

Section 16. Penalties for Violation of Section 7 - penalties or sanctions that must be charged for
anyone who will violate all of the said laws in section 7.

Section 17. Implementing Rules and Regulations - Implementing rules and regulations 90 days before
the examination.

Section 18. Transitory Provisions - The incumbent Commissioner and two (2) incumbent Associate
Commissioners shall serve as Chairperson and Commissioners respectively under the terms for which
they have been appointed without need of new appointments.

Section 19. Separability Clause - Any person without proper declaration can’t be considered as
members of the board or can’t be considered as a commissioner.

Section 20. Repealing Clause - This act is always open for revision, modification especially when this
act become inconsistent, also in order to improve this law.

Section 21. Effectivity - This Act shall take effect after fifteen (15) days following its publication in
the Official Gazette or in two (2) newspapers of general circulation, whichever is earlier.

STANDARDIZED GUIDELINES AND PROCEDURES FOR THE


IMPLEMENTATION OF THE CONTINUING PROFESSIONAL EDUCATION FOR ALL PROFESSIONS

ARTICLE I
CPE OBJECTIVES, DEFINITION, NATURE, AND RATIONALE


Section 1. Objectives The CPE programs shall have these objectives: (1) To provide and ensure
the continuous education of a registered professional with the latest trends in the profession
brought about by modernization and scientific and technological advancement; (2) To raise and
maintain the professional's capability
for delivering professional services; (3) To attain and maintain the highest standard and quality
in the practice of his profession; (4)To make the professional globally competitive; and (5) To
promote the general welfare of the public.


Section 2. Definition Continuing Professional Education (CPE) refers to the inculcation,
assimilation and acquisition of knowledge, skills, proficiency and ethical and moral values, after
the initial registration of a professional, that raise and enhance the professional's technical skills
and competence.


Section 3. Nature The CPE programs consist of properly planned and structured activities, the
implementation of which requires the participation of a determinate group of professionals to
meet the requirements of voluntary maintaining and improving the occupational standards and
ethics of the professionals.


Section 4. Rationale Voluntary compliance with the CPE program is an effective and credible
means of ensuring competence, integrity and global competitiveness of professionals in order to
allow him/her to continue the practice of his/her profession.

ARTICLE II
THE CPE COUNCILS: CREATION, COMPOSITION, TERMS OF OFFICE, FUNCTIONS, MEETINGS.


Section 5. CREATION Each of the concerned professional regulatory boards (PRBs), upon
approval by the PRC, shall create a council within thirty days from the effective of this resolution
shall be known as the CPE council which shall assist its corresponding PRB in implementing its
CPE programs.


Section 6. COMPOSITION Each CPE council shall be composed of a chairperson and two
members. The chairperson of each CPE council shall be chosen from among the members of the
PRB by the members themselves. The first member shall be the president or, in
his absence or incapacity, any officer chosen by the board of directors of the Accredited
Professional Organization (APO). The second member shall be the president or, in his absence or
incapacity, any officer of the organization of the deans or department heads or schools, colleges
or universities offering the course requiring licensure examination. In the absence of such
organization, the second member shall be chosen and appointed by the PRC from at least three
recommendees of the PRB concerned. Said recommendees shall be well known academicians.

Section 7. Terms of Office The term of office of the chairperson of each CPE council shall be co-
terminus with his/her incumbency in the PRC. The first member shall have a term of office co-
terminus with his/her incumbency as officer of the APO; the second member shall have a term of
office co-terminus with his/her incumbency as officer of the organization of deans or heads of the
departments. In case of the academinician-member, upon the expiration of their respective terms of
office in the PRB, APO or organization of deans of heads departments, the chairperson, first member
and second member shall continue to function as such in the CPE Council until the appointment or
election of their respective successors in the PRB, APO or organization.


Section 8. Exercise of Powers and Functions Each CPE Council shall upon majority vote, exercise
powers and functions which shall include but shall not be limited to the following:

1. Accept evaluate and approve applications for accreditation of CPE providers

2. Accept, evaluate and approve applications for accreditation of CPE programs, activities or sources
as to their relevance to the profession and determine the number of CPE credit units to be earned on
the basis of the contents of the program, activity or source submitted by the CPE providers.
3. Accept, evaluate and approve applications for exemptions from CPE requirements.

4. Monitor the implementation by the CPE providers of their programs, activities or sources.

5. Assess periodically and upgrade criteria for accreditation of CPE providers and CPE programs,
activities or sources.

6. Perform such other related functions that may be incidental to the implementation of the CPE
programs or policies.

ARTICLE III
CRITERIA FOR ACCREDITATION OF PROVIDERS, PROGRAMS, ACTIVITIES OR SOURCES;
EQUIVALENT CREDIT UNITS; CREDIT REQUIREMENTS; EXEMPTIONS AND OTHER MATTERS

Section 12. Criteria for Accreditation. In order to merit accreditation, the following criteria shall be
complied with:

A. For CPE Provider

1. Must be a duly registered organization, firm, institution or agency, or a professional of good


standing and has never been convicted of a crime.

2. Shall have an established mechanism for measuring the quality of the program being offered or
administered;

3. Must have adequate, modern and updated instructional materials to carry out the CPE programs
and activities;

4. Shall have instructors, lecturers and resource speakers with good moral character and technical
competence and are, preferably, holders of current professional licenses.
B. For CPE programs, activities or sources

1. The scope shall be beyond the basic preparation for admission to the practice of the profession.
The contents shall be relevant/related, but not limited to the practice of the profession.

2. The programs, activities or sources shall enhance the competence of the professional by
upgrading and updating knowledge and skills for the practice of the profession as brought about
by modernization and scientific and technical advancements in the profession.

Section 14. CPE Credit Units. The total CPE units for registered professionals with baccalaureate
degree shall be sixty (60) credit units for three (3) years. Any excess credit units earned shall
not be carried over to the next three-year period except credit units earned for doctoral and
masters degrees.

The total CPE credit units for registered professionals without baccalaureate degree shall not be
carried over the next three-year period.

One credit hour of CPE program, activity or source shall be equivalent to one credit unit.

professional and within the context of the concerned profession’s code of ethics and is considered
a necessary, effective and credible means of ensuring competence, integrity and global
competitiveness of professional in order to allow him/her to continue the practice of his/her
profession.

Section 9. Functions of the Council Chairperson. – Each Council Chairperson shall have the
following functions:

2. To direct or supervise the activities of the Council.

3. To submit minutes of regular and special meetings within thirty (30) days from date of said
meetings.

4. To submit Council annual reports before the end of February of the succeeding year.

5. To issue the certificate of accreditation (the “CoA”) to CPE providers found by the Council to be
qualified in accordance with these Guidelines as well as certificate of accreditation of program/s
(the “CoAP”), activities and sources
Section 10. Secretariat. – The Chairperson of the Commission shall designate or appoint an
official of the Commission with the rank not lower than Division Chief who shall act as the
Secretary of all CPE Councils. The designated official may participate in the deliberations of the
CPE Councils but shall not vote. His/her duties and functions shall be as follows:

1. To see to it that the sessions, meetings or proceedings of


the Councils are recorded;

2. To prepare the minutes of all the meetings and


proceedings of the Councils;

3. To receive applications for accreditation of CPE providers, programs, activities or sources;

4. To submit to the Councils applications for accreditation of aspiring CPE providers and CPE
programs, activities or sources;

5. To release Certificates of Accreditation to CPE providers and programs, activities or sources;

6. To assist the Councils by providing relevant statistical data on the renewal of professional
licenses and other related matters

The Secretary shall exercise general supervision and control over each of the Council Secretaries,
the staff of which shall be selected by the Chairperson of the Commission from among the
existing personnel of the Commission. Each of the Council Secretaries shall have, among others,
the following functions:

1. To release CPE Certifications of credit units (the “CUs”) earned to the registered and licensed
professionals concerned;

2. To keep all records, papers and other documents relative to the evaluation, approval and
accreditation of CPE programs, activities or sources;

3. To maintain records of accredited CPE providers, ongoing, continuing or completed CPE


programs, activities or sources, the list of participants and other relevant data

Section 11. Meetings. – The Councils shall hold regular meetings once a month on dates to be fixed
by said Councils. Special meetings may be called by a Chairperson or upon written request of at
least a member of a CPE Council.

IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 10912, knowns as the
“CONTINUING PROFESSIONAL DEVELOPMENT (CPD) ACT OF 2016

Section 1. Title - This Resolution shall be known as the "IMPLEMENTING RULES AND
REGULATIONS (IRR) OF REPUBLIC ACT NO. 10912, knowns as the “CONTINUING
PROFESSIONAL DEVELOPMENT (CPD) ACT OF 2016" hereinafter referred to as "IRR of R.A.
No. 10912

Section 2. Declaration of Policy - The IRR of R.A. No. 10912 shall be interpreted, construed, and
carried out in the light section 2 of R.A. 10912,which states as follow

"It is hereby declared the policy of the State to promote and upgrade the practice of
professions in the country. Toward this end, the state shall institute measures that will
continuously improve the competence od the professionals in accordance with international
standard of practice, thereby, ensuring the contribution of professions in uplifting the general
welfare, economic growth, and development of the nation

Section 10. CPD as Mandatory Requirement in the Renewal of the Professional License and
Accreditation System for the practice of Profession - The CPD is hereby made as a mandatory
requirement in the renewal of the PICs of all registered and licensed professionals under the
regulation of the PRC.

10. 1 Registered and licensed professionals shall complete the required credit units every three
(3) years of compliance period

10. 2 The table below shall be used as reference for the renewal of PIC in the transitory period;
however, the PRB concerned may prescribe their own required CPD credit units through a
resolution subject to the approval by the Commission.

10. 4 Professionals working overseas may take programs/seminars through the foreign chapters
or affiliates of accredited CPD Providers. They may also attend seminars/trainings conducted by
non-accredited CPD Providers and apply for credit unit/s with their respective CPD Councils
under Self-Directed and/or Lifelong Learning track.
