The defendant, on or about November 20,2022, in the City of Saratoga Springs, Couty of
Saratog4 State ofNew Yorlq with intent to cause the death of another person, attempted to cause the
death of such person.

accuse the defendant, VITO E. CASELNOVA, of the crime of ASSAULT IN THE FIRST DEGREE,
as a "Class B" Violent Felony, in violation of Section 120.10(l) ofthe Penal Law olthe State ofNew
York, committed as follows:
The defendant, on or about November 20, 2022, in the City of Saratoga Springs, County of
Saratoga, State ofNew York, with intent to cause serious physical injury to another persoq caused such
injury to such person or to a third person by means ofa deadly weapon or dangerous instrument.

DEGR-EE, as a'Class A" Misdemeanor, in violation of Section 120.14(l) of the Penal Law of the State
of New York, committed as follows:
The defendant, on or about November 20,2022, in the City of Sararoga Springs, County of
Saratog4 State of New York, intentionally placed or attempted to place another person in reasonable
fear of physical injury, serious physical injury or death by displaying a deadly weapon, dangerous
instrument or what appears to be a pistol, rcvolver, rifle, shotgrm, machine gun or other firearm.

TIIE SECOND DEGREE, as a "Class A" Misdemeanor, in violation of Section 120.20 of the Penal Law
of the State of New York, committed as follows:
Saratog4 State ofNew York, recklessly engaged in conduct which created a substantial risk of serious
physical injury to anolher person.

accuse the defendant, vlro E. cASELNovA, of the crime of POSSESSION oF A FIREARM IN A
SENSITIVE LOCATION, as a "Class E'Felony, in violation of Section 265.01(e) of the Penal Law of
the State of New York, committed as follows:
The defendant, on or about November 20,2022, in the City of Saratoga Springs, County of
Saratoga, State of New York, possessed a firearm in a sensitive location and such person knows or
reasonably should know such location is a sensitive location.

CAPACITY AMMUNITION FEEDING DEVICE, as a "Class D" Felony, in violation of Section
265.02(8) of the Penal Law of the State of New York, committed as follows:
Saratoga State of New York, knowingty possessed a large capacity ammunition feeding device.

Saratoga, State ofNew York" with intent to harass, annoy or alarrn another person struck, shoved, kicked
