This Rent Agreement executed at Greater Noida on 22nd day of

_June 2022 between RAM S/o VIKAS R/o D-158, INDRAPRASTHA


DELHI-110011 (Hereinafter called the LESSOR) which expression shall
include his heirs, successors, legal representatives and assigns of the ONE
PART
And

Sh. SHYAM S/O RISHABH R/O D-120, INDRAPRASTHA DELHI-


110011 (Hereinafter called the LESSEE) which expression shall include his
heirs, successors, legal representatives and assigns of the SECOND PART.

Whereas the lessor is a legal owner of Ground Floor house no-3B, plot no-
100, khasra no-200, pi-1, BLACK ACRE, SECTOR Pi-II,
INDRAPRASTHA ,

AND WHEREAS the LESSOR and the LESSEE have agreed on the
following terms and conditions:

COMEENCEMENT: -This agreement is for 9 Years 11 months from


1st Jan 2021 and valid up to 31st Dec 2029.

1. Term of Lease:
This Agreement has been entered into for a period of 9 years 11
months commencing 1st Jan 2021 and the rent shall be effective
from 1st Jan 2021. The LESSEE acknowledges the receipt of vacant
and peaceful possession of the flat on together with all the keys to
the flat, the cupboards, refrigerator, fans, geysers, cooking range
with oven, curtain rods, tube lights /CFL’s, Jacuzzi and other
fixtures etc. provided.

2. Rent:
The LESSEE shall pay to the LESSOR for the premises described
above; a monthly rent of Rs. 20,000 (Rupees Twenty Thousand)
which includes Maintenance of Rs 2800 (Two thousand eight
hundred only) to the Lessor as the rent for the term of this
Agreement. The LESSOR acknowledges the receipt of the same.

3. Electricity / Water charges:

The LESSEE shall pay directly to the electricity department for


electric (power, light) charges, according to the bills raised by the
electricity department as per the separate meter installed for the flat.
The LESSEE shall also pay the electricity backup charges /
Generator charges directly to the society as per the bills raised by
them or as per any other method so determined by the society for
charging the same. The LESSEE shall also pay water charges, pay
any other fixed charges so determined by society other than
maintenance charges of Rs 2800 which will be borne by LESSOR.

4. Security deposit.

The LESSEE has given to the LESSOR total Rs 1,00,000 as an


interest free security deposit which is refundable at the time of
termination of this agreement.

The LESSEE agrees to refund security amount after adjusting


against any outstanding dues or any damages caused to the property
or fixtures within fifteen working days of the date of termination of
this agreement.

5. Rent and Fresh Lease

The rent will be paid by 10 th of each month by online bank transfer


(ECS). The monthly rent will be credit into Lessor’s bank account
through NEFT by 10th day of each month in advance for which the
details are mentioned below:

In case Lessee delay the payment of monthly rent will invite penalty
of Rs.500 per day and if rent not paid in time, IFSD (Interest Free
Security Deposit) will be forfeited after one Month. The lease shall
be deemed as terminated and Lessee will have to immediately
handover the Vacant Possession of the premises to the lessor in the
condition as taken by the LESSEE at the time of entering into this
lease agreement, fair wear and tear excepted.

At the end of the 5 years 11 months, the parties may execute a fresh
lease agreement with an increase in rent amount, not less than 10%
of existing rental amount, after mutual understanding of both
parties.

That notwithstanding anything herein above contained, it is


expressly agreed by and between the parties hereto that in default of
any payment on the dates herein above mentioned the LESSOR
shall always be entitled to and shall have always the power to
revoke the agreement herein granted by his/her absolute discretion
and reoccupy the premises without subjecting himself to any
liability on that account and not withstanding any intermediate
negotiation or waiver of breach thereof and then and in such event,
the LESSEE shall surrender the occupied premises Flat No. 502 ,
Tower 15, Unitech Habitat , Greater Noida .
6. Termination:

The Lessor shall be entitled to determine/terminate this agreement in


the event of the Lessee commits breach of any of the terms and
conditions contained herein.

Either party may terminate this Agreement by giving six month’s


notice to the other party or by giving three month’s rent in lieu of
the notice.

Either of the party terminate this agreement without six month prior
notice will be liable to pay 2,00,000/- (Rupees Two Lakhs) to other
party.

7. Not to sublet:

The LESSEE shall not sub-let, assign, or otherwise part with the
possession of the premises in part or whole and shall not keep any
paying guest within the said premises.

8. Fixtures and fittings:

At the time of the occupation, the LESSEE shall ensure that all
sanitary, electrical, and other fittings and fixtures are in perfect
working order, and nothing is broken or missing.

LESSEE shall be responsible to restore and maintain them to the


condition in which they were taken over.

LESSEE shall be liable to pay for any breakages, damages to


sanitary and other fittings, electrical goods and fixtures during the
LEASE AGREEMENT period caused due to his/her negligence or
poor maintenance.

9. Limited User:
The LEASE AGREEMENT shall be valid for the purpose of
residential and Commercial accommodation of Sh. SHYAM S/O
RISHABH R/O D-120, INDRAPRASTHA DELHI-110011.
Currently Shyam is a EX-ARMY OFFICER. The LESSEE is
not permitted to allow any other person to use the house during its
currency of the agreement. The said premises shall be used for any
business, commercial professional purpose.
10. No alterations:

The LESSEE shall not carry out any additions or alterations in the
flat layout or fixtures. The LESSEE shall be permitted to install air
conditioners, cooking range, etc. at his/her own cost without
damaging the flat and fixtures.
Any damages caused to flat, or fixtures must be repaired or
compensated by the LESSEE.
The LESSEE shall not alter the existing locking device on the main
entrance door or any of the internal doors and cupboards. Any
damage to any locks will be compensated by the LESSEE.

11. Inspection:

The LESSEE shall permit the LESSOR or his agents etc. to enter the
said premises for inspection and carry out the repairs etc. at
reasonable time as and when necessary, with prior appointment /
information.
12. Compliance with Rules:

The LESSEE shall comply with all rules, regulations, and by-laws
of the Municipal Corporation and other bodies or Corporation and
shall always maintain peace and dignity in the flat without causing
any inconvenience to the neighbours.

The LESSEE shall also not use the said premises for any unlawful
activity or purposes prohibited by law or complex authorities or to
store any hazardous goods which may cause fire, consume any
drugs, damage the property, or expose any resident to any other risk
whatsoever. The LESSEE shall be solely responsible for any such
event taking place from this premises and all risk, expenses and duty
to make the same good shall strictly rest with the LESSEE and the
LESSOR shall be indemnified by the LESSEE against all such
consequences arising due to such event and the losses and The lease
shall be deemed as terminated and Lessee will have to immediately
handover the Vacant Possession of the premises to the lessor in the
condition as taken by the LESSEE at the time of entering into this
lease agreement.

13. Painting:

The LESSOR has carried out painting, polishing, distempering,


whitewashing before handing over possession to the LESSEE and
the LESSOR shall not be required to do it again during this period.
14. Minor Repairs:

The LESSEE shall carry out the day-to-day minor repairs such as
repair and replacement of LED tubes, sanitary fittings and fixtures,
hardware, carpentry, leakage of water taps etc. at his own cost and
shall keep the flat in good and habitable condition.

15.Vacation:

On the date of expiry of this agreement on 31st May 2028, the


LESSEE will hand over the peaceful vacant possession of the
apartment to the LESSOR on 31st May 2028 in the same condition
the premises were at the time of commencement of the lease, failing
which the LESSOR shall have absolute right to have access and take
possession and occupancy of the said premises.

The LESSEE shall be responsible for clearing his entire dues,


payable for the period of his occupancy, on account of outstanding
maintenance charges, electricity charges, statutory charges, any
fixed charges of society, any damage to sanitary fittings or electrical
goods, damage to flat or fixtures or any other expenses or charges,
prior to surrender and vacating the premises. Alternatively, the
LESSEE must deposit with the LESSOR a sum equal to the
estimated dues on the aforesaid accounts, for final settlement of
payment on behalf of the LESSEE.

In witness whereof the LESSOR and the LESSEE have signed this
Agreement on 1st Jan 2019, above written in the presence of witnesses
signing hereunder.

ANNEXURE-A

The following electrical appliances and other fittings have been installed in house no-3B,
plot no-100, khasra no-200, pi-1, BLACK ACRE, SECTOR Pi-II,
INDRAPRASTHA

Note 1: All keys to be returned while vacating the premises. Any loss of key will be charged to
lease by lessor with similar make and quality lock replacement charges.
IN WITNESS WHEREOF THE LESSOR AND THE LESSEE HAVE SET THEIR
RESPECTIVE HANDS TO THIS AGREEMENT ON THE DAY, MONTH & YEAR AS
MENTIONED ABOVE.
