DEMAND LETTER

I write this letter in behalf of MERLYN BERT in relation to your act of posting a
libelous remark to the above-mentioned person through your social media.

Our office is informed that on April 11, 2023, you posted on your Facebook social media
account the photo of Ms. Bert with her full name and you captioned such post with “Ako
diay si mai2 kabet ko sa akong papa mang gubaay diay kog pamilya wag nyoko tularan
#proudkabet”. Due to such post, several individuals commented and ridiculed the
person and reputation of Ms. Franco. One of the commentors even mentioned of “…
itsahan og granada”. This post and the comments thereon caused Ms. Bert anxiety,
mental torture and anguish.

Please take note that under the Cybercrime Prevention Law in relation to the Revised
Penal Code, cyber libel may be committed when a person maliciously imputes a crime,
vice or defect, real or imaginary, or any act, omission, condition, status, or
circumstance publicly through a computer system or any other similar means with the
intention to cause dishonor, discredit or contempt of the person defamed.

Demand is therefore given to you to immediately delete your malicious posts


against Ms. Bert and to cease from further posting any malicious imputation
to her in any social media platform.

I understand that there may be circumstances which brought about your act. However,
please be reminded that these circumstances, whatever they may be, do not justify
your act of committing a crime, unless it is justified by the law. Hence, it is imperative
that you heed this demand. Failure to do so will constrain Ms. Bert to file the
appropriate case/s against you.
