CHILD TRAFFICKING IN INDIA

WHAT IS CHILD TRAFFICKING?

The definition of the human trafficking which also involves child trafficking is given in the
Section 370 of The Indian Penel Code, according to which, whoever, for the purpose of
exploitation, recruits, transports, harbours, transfers, receives, a person or persons, by using
threats, using force, any form of coercion, by abduction, by fraud, deception, abuse of power
by inducement, including the giving or receiving of payments or benefits, in order to achieve
the consent of any person having control over the person recruited, transported, harboured,
transferred and received, commits the crime of trafficking.i And in simple words meaning of
child trafficking is illegally deal or trade of the children.

A BROAD VIEW OF CHILD TRAFFICKING IN INDIA

Child trafficking is a heinous crime and is a very serious problem. One child goes missing
every 8 minutes in India. India is a prime country for child trafficking to happen, as many of
those trafficked are from, travel through or destined to go to India. Most of the trafficking
occurs within the country, there is also a significant number of children trafficked from the
neighbour countries such as Nepal and Bangladesh. In its one report US department of state
stated that, “India is a source, destination and transit country for men, women and children
subjected to forced labour and sex trafficking and the majority of India’s trafficking problem
is internal, and those from the most disadvantaged social strata- lowest caste, members of
tribal communities, religious minorities and women and girls from excluded groups are most
vulnerable”ii And according to this, most of the issues of child trafficking are domestic. Even
today the rate of the poverty is high in India and there are some families who do not have
food to eat and even cloths to wear. So many people in the country crave for food and this
yearning to eat is such a social evil that forces people to trade their own children and makes
them comit such a heinous crime and even when we visit any city in India, we will see a lot
of children begging there, and little do we know is the most of them are the victims of child
trafficking. And that is a huge number. And there is no actual record that how many children
in India are victim of the Child Trafficking.

REASONS FOR CHILD TRAFFICKING

There are six main reasons for the Child Trafficking and those are as follows:
1. Forced Child Labour
2. Prostitution
3. Poverty
4. Organ Trade
5. Domestic Servitude
6. Begging

CAUSES OF CHILD TRAFFICKING

There are six main causes of Child Trafficking

1. Poverty
2. Lack of Education
3. Unemployment
4. Some illegal cultural practices
5. Child Marriage
6. Weak law enforcement

EFFECT OF COVID 19 ON CHILD TRAFFICKING

No citizen of India is unknown from this fact that due to COVID-19; the economy of the
country has been drastically affected and too many people has lost their job due to COVID-
19. 75 percent of those people used to run their houses by doing small trades, daily wage
labourers and those who were already beyond the poverty line, have no source of earning
money for their families due to the pandemic iii. And this vulnerability of the people has
become the main reason of the parents trading their own children so that they could get food
to eat. According to a statement of Delhi Police recently in the year 2020, 209 minors have
been rescued by the anti-human trafficking unit of the Delhi Police out of which 102 were
male and 107 were female.iv

Police and authorities are basically pre occupied in the pandemic so nobody is actually
focusing on the issue of child trafficking lately and it has become a lot easier for people to
carry out such crime. For this reason, there have been many cases of child trafficking in the
last few days came and FIR of many missing children have been reported in India.

RECENT CASES OF CHILD TRAFFICKING IN INDIA


In New Delhi on 3 October 2020, a FIR was filed by Asiya Khatoon of Batla House of
kidnapping of her 1 and ½ year old daughter, she went missing while playing with some other
kids in the streets. The child was found at Jamia Nagar by the police with a couple and during
the interrogation the said couple accepted their crime that they kidnapped the child to engage
her into the begging.

On October 20, 2020 an Ahmedabad based NGO claimed that approximately 1.30 lakh
children, mostly tribal children have been illegally employed at cotton seed farms in Gujarat.
An official from the state labour department told PTI that they will send their teams in areas
particularly stated by the NGO and will take action if any kind of wrongdoing or crime has
been found.v

In the Gorakhpur, Uttar Pradesh on 16 October, 2020 five minors have been rescued by the
Anti-Human Trafficking Unit of Uttar Pradesh Police for which two man has been arrested
according to the statement of the police. SSP said that the accused, Vinod Kumar and Vinod
of Maharaj Ganj district, said the police during interrogation that they were taking the girls to
Hisar, Haryana.vi

In Vishakhapatnam, Andhra Pradesh on 16 August, 2020 Police arrested six persons for their
alleged role in a child trafficking case at Universal Srushti Hospital. City police has found
that the management of the hospital exchanged several new-borns and allegedly cheated the
officials of Childline and Child Welfare Committee/CWC. It was alleged by the Andhra
Pradesh Police that doctor Namratha has spread her network in rural areas and hired agents,
who was conspiring to target egg donors, destitute pregnant women and unwed pregnancies
to procure babies for their trafficking. The doctor’s modus operandi is to trade the procured
babies to rich families who were childless.vii

They were some cases that have been reported, however most of the case of child trafficking
are hidden from our eyes.

CONCLUSION

Article 23 of the Indian Constitution bans the practice of Child Trafficking in India, however,
the number of cases of child trafficking are rising rapidly. There are many reasons for the
high rate of Child Trafficking today and this web of trafficking rackets are unable to be seen
from surface. This web has been spread all over the country and its roots are very deep.
Cutting that root is not an instant work, it is a process and strengthen our law enforcement
could be the best start for that. India doesn’t have only one issue, it has a lot of issues going
on such as poverty, hunger, unemployment, lack of education etc, Intergovernmental
organisations, like the United Nations, has introduced measures to remove child trafficking
since the year 1900 with varying degrees of success.

Government can take some measures to prevent Child Trafficking in India:

 spread awareness to the people regarding the issue of Child Trafficking and educate
them to take several measures.
 Promote education among the tribal people, the poor and the backward people.
 Improvise Execution of the Law in Country.
 Take strict actions against Child Marriages.
 Follow the measures suggested by the UN.

Children are the future of the Nation and engaging them in the activities like begging,
prostitution etc is a great loss to the Country and a cruelty to those kids and the increasing
number of such heinous crime is an alarm that our government should prioritize this issue.
