santoshi (Handicapped & Unmarried Daughter) of Lt. Mr. Harkishan ,Retd.A.L.C being nominated as nominee under the Family pension Rule,1972.
Dear Sir,
Under instructions and on behalf of my client Ms. Pallavi
santoshi D/o Lt. Shri Harkishan Santoshi, Retd. A.L.C (Central),New Delhi R/o 69,Shanti Sarovoure, Ramghat Road, Aligarh-202001(UP) presently in Delhi , I do hereby serve upon you the notice as under:
1. That my client is the daughter of Mr.Harkishan which get
retired from your office in the year 2008.
2. That after the retirement he was receiving the pension and
he also nominated her wife Lt. Mrs. Shakuntala Devi as nominee after her death under the family pension Rule 1972. 3. That the mother of my client and wife of pensioner got expired on 04.03.2019. Thereafter the father/pensioner of my client vide letter dated 17.08.2020, write to your office whereby nominated my client as nominee in place of her wife since she got expired, under the family pension Rule, 1972.
4. That on 21.12.2020 the pensioner/ father of my client got
expired. That thereafter you and other offices made certain communication regarding the above said pension, but this could not help my client in any way.
5. That my client being handicapped unemployed being fighting
for day to day expenses after the death of his Father/Pensioner as she is totally dependent on him, visited your office numerous time but could not get satisfactory reply on your part.
6. On 01.02.2022 my client made representation to the higher
authority for release of pension, since, she is legally entitled being legally nominated as nominee by the pensioner/Father. The said representation was forwards to your office, since your office is the custodian of the service book of the pensioner/Father. 7. That it is almost two years that the pensioner/Father of my client had been expired and my client visited from pillar to post but nothing help my client cause.
It is therefore, you are hereby called upon
through this notice to release the pension amount as per the Family Pension Rule 1972 to my client as she is legally entitled being the nominate and also being handicapped unmarried unemployed daughter of the pensioner/Father, within 15 days from receiving this notice, failing which my client will be constrained to initiate legal proceeding against you at your cost and consequences.
