AGREEMENT OF CONSTRUCTION

This Agreement is being executed on ____ day of June, 2022 by and between:
M/s. KCP CONSTRUCTIONS Represented by its partner (1) Mr. V.
KARUNAKAR REDDY, (2) M. GOPI LAL CHOUHAN (3) D. PRAVEEN REDDY
AND having their office at Vaddeadireddy Building, 60 feet road, Balkampet,
Hyderabad.
(Hereinafter called the Builder)
AND
1. SRI MANCHALA RAVI KUMAR S/O SRI MANCHALA ASHOK KUMAR,
aged about 48 years, Occupation: Business, Resident of House No.7-1-
209/1/A/1, Ashok Nivas, Beside Satyam Theatre, Ameerpet, Hyderabad-
500016.
2. SRI MANCHALA PRAVEEN KUMAR, S/O SRI MANCHALA ASHOK
KUMAR, aged about 46 years, Occupation: Business, Resident of House
No.7-1-209/1/A/1, Ashok Nivas, Beside Satyam Theatre, Ameerpet,
Hyderabad-500016.
(Hereinafter called the Landlords)
The Landlord has agreed to appoint the Builder for construction of an
Independent Building at House bearing Municipal Nos. 7-1-518,519 (PTIN:
1100705469), 7-1-518/1/A (PTIN: 1100705470), 7-1-518/1/B (PTIN:
1100705471), 7-1-518/1/C (PTIN : 1100705472), 7-1-518/1/D (PTIN :
1100705473) and 7-1-518/A (PTIN : 1100705474) admeasuring 230
sq.yards or 192.30 sq.mters.

The Builder has agreed to do the Building construction complete with Material and
Labour (Total Material Contract basis) as per the specifications scope of work, cost
factor & execution time detailed in this agreement.

Annexure-B appended to this Agreement indicates detail specifications of works.

Annexure-C appended to this Agreement indicates details concerning payment


release schedule & job completion time schedule.

Annexure-D indicates estimated cost of the project.

SCOPE OF WORK:

Scope of work includes structure with all the necessary finishing required for
comfortable residence.

STRUCTURE;

Construction of building is understood to mean all the necessary structured work


commencing from R.C.C. Column footings till laying Roof Slab for the fifth floor with
stair case, overhead Tanks and Sump. Entire Brick work and plastering of walls and
roof also from part of the structure. R.C.C. work, pertaining to kitchen for lofts, and
platforms are also included in the scope of work.

Stair case room on the terrace should be covered with R.C.C slab, parapet
wall/Railings construction bordering balconies and topmost floor terrace and also
normal elevation work for the building for a presentable outside appearance also
form part of the scope of work. Terrace flooring with water proofing cement is also
required to be done within this scope of work.

However, structural design should be capable of withstanding cellar+ Ground + five


floors - pent house though the present construction as per this agreement is
restricted to cellar, ground floor and five floors above that.

SPECIFICATIONS;

Both structural work, other works forming part of the scope of work entrusted to
the Contractor as "Finishing" are detailed herein as plumbing for water supply and
sewerage, electrical, doors and windows fixing, flooring & painting as per the
specifications mentioned in Annexure B

COVERAGE OF AREA FOR THE BUILDING:

Coverage of cellar + Ground + five floors based on this, following area coverage for
the construction work has been agreed between Landlords and Builder as per
Architect design engineer.

COST FACTOR;

 With the above details pertaining to scope of work, specifications and


building area coverage, following payments have been agreed between the
Landlord and Builder.

 For the entire construction for the structure with all the necessary finishing
with RCC roof above and brick walls between flooring and roofing Rs.1800/-
(Rupees One Thousand Eighty Hundred only) per Sft becomes payable.
First floor balconies, porch also are covered under this category.

 Parapet walls bordering terrace on the four sides and railings for stair case
and balconies are also required to be constructed at no extra cost. Cement
flooring for terrace with water proofing material also form scope of work.

 Slab + outer walls + windows + doors + window grills design and


toilets.
 Compound wall, ramps/drive ways, landscaping, rock cutting, clearing, earth
filling /leveling of external areas are excluded from scope of work.

PAYMENT TERMS

1. Advance paid a sum of Rs. 10,00,000/- (Rupees Ten Lakhs only) vide
Cash/cheque No.___________ dt: .06.2022 drawn on ______________
_______________ Branch, Hyderabad.
2. After each Slab Rs.10,00,000/- (Rupees Ten Lakhs only) to be paid.

OTHER TERMS AND CONDITIONS;

 Curing becomes the responsibility of the contractor at no extra cost. This job
is required to be done with the desired efficiently.

 Water bill and electrical bills to be statutory authorities will be taken care of
by the landlord. Builder is free to use this water and power for the
construction without payment. However, any additional water procurement
charges from outside sources such as tankers become payable by the
contractor for which reimbursement claims will be entrusted.

 If situation warrants, the Builder and Landlord is authorized to incorporate


modifications in the design of the structure and other works as well as its
implementation. The Builder will also be involved in this regard for discussion
concerning techno commercial aspects of the propose alterations.

 Payment schedules and time schedule for the job execution are detailed as
Annexure-C appended to the agreement.

 No time escalation for the job execution as detailed in this agreement


become acceptable to the landlord.

 Landlord is responsible if any legal disputes arise hereafter.

 The Builder shall complete the entire project within the committed time
schedule of 12 months. The landlord has agreed to provide grace time of 3
additional months incase of justifiable reason for time escalation. However, in
the event of the project completion time exceeding 15 months from the date
of commencement, the contractor is liable to be penalized. The duration of
penalty will be decided up on mutual discussion.

 The Builder shall ensure structural safety of the building as well as quality
construction standard and also earth proofing & water proofing.

 The safety and security of the construction material, manpower and structure
under construction is the sole responsibility and at the risk of the contractor
only for which he is expected to all the necessary precautions.

 Laisoning with officials visiting the construction site also becomes the
responsibility of the builder who has agreed not to bother the landlord in this
regard.

 Warranty maintenance for structural, electrical, plumbing, water leakage


(Plumbing), defects, if any, shall be for a period of 12 months from the date
of final payment settlement which is expected to be one month from the date
of completion of building construction as detailed in this agreement.

This agreement comes in to force from the date of signing by the concerned parties
and remains valid till the completion of warranty maintenance period.

hardware and safety grills with bright steel.

6. Flooring : Vitrified Tiles(Double layer) with 2' x2' size


for flooring and Granite for staircase steps
with full molding on edges.

7. Painting : Internal - 2 coats of Birla Putty, 2 coats of


acrylic emulsion paint over a base coat
primer (apcolite)

External - exterior acrylic emulsion paints


(apex or an equivalent)

8. Toilets : All toilets will consist of


a) Wash Basin-INos
b) E.W.C - 1 Nos
c) Hot and Cold mixture with shower 1No.
(And all fittings of premium quality)
d) Provision for geyser, exhaust fan, and
necessary electrical points.
e) CPVC (astral) piping for water supply and
U.P.V.C. for soil and waste water lines
f) (Ceramic Tiles for walls and floor)

b) Power outlets for air-conditioner and Geyser in
all bathrooms

10. Water Tank & Sump: Water Tank - Sintex (1 0000 Ltrs) - 2 tanks

with water proof plaster (10000 Ltrs + 10000 Ltrs
= 20000 Ltrs ) with partition

11. Terrace : Cement flooring with water proof plaster


12. Stair Case Railing : Stainless Steel (302) Plain Design
13. Lift : Owners cost.

Mixing)

Reinforcement Steel : Jai Raj or Shree Steels
