MEMORANDUM OF UNDERSTANDING/DEED OF

SETTLEMENT/UNDERTAKING

THIS MEMORANDUM OF UNDERSTANDING/DEED OF


SETTLEMENT/UNDERTAKING is executed on this day of
July, 2023 at New Delhi by and between:

MR. AAYUSH, SON OF SH. RANJAN SINGH, AGED ABOUT 27


YEARS, CURRENTLY RESIDENT OF SAKET, NEW DELHI -
110017 (hereinafter referred to as “FirstParty”).

-AND-

MS. AYESHA, WIFE OF AAYUSH, AGED ABOUT 24 YEARS,


CURRENTLY RESIDENT OF D W A R K A , NEW DELHI
110037 (hereinafter referred to as “Second Party”).

The First Party and the Second Party are hereinafter


collectively referred to as the “Parties”.

WHEREAS the marriage between the First Party and


Second Party to this Memorandum of Understanding/ Deed of
Settlement/ Undertaking was solemnized on 10.03.2015 at the Arya
Samaj Mandir , in NEW DELHI under the Hindu rites and
ceremonies.
AND WHEREAS, the Parties to this Meomrandum of
Understanding/ Deed of Settlement/ Undertaking lived together as
Husband and Wife and cohabited and the marriage was duly
consummated and TWO children were born from the said wedlock
IN 2017.

AND WHEREAS , due to temperamental differences, the parties to


this Meomrandum of Understanding/ Deed of Settlement/
Undertaking could not adjust with each other and have been living
separately from each other ever since 13.05.2022.

AND WHEREAS the Parties are not living together from past one
year and only in the eyes of society are said to be husband and wife.
Therefore, the Parties are living apart from and independent from
each other and therefore shall institute Divorce Proceedings before
the Family Court seeking a decree of divorce and dissolution of their
marriage through mutual consent.

THE PARTIES to the present Memorandum Of


Understanding/Deed of Settlement/Undertaking have mutually and
amicably decided/ settled all their disputes and to get their marriage
dissolved by a decree of divorce by mutual consent, after completion
of separation of the one year, without wasting any time in litigation,
so as to avoid the multiplicity of litigation in future and for
betterment of the parties. In this regard, the parties have arrived at
the present Memorandum of Understanding/Deed of
settlement/Undertaking, on the following terms and conditions:-
NOW THE MEMORANDUM OF UNDERSTANDING/ DEED
OF SETTLEMENT/ UNDERTAKING WITNESSETH AS
UNDER:-

1. That the parties to the present Memorandum Of


Understanding/Deed of Settlement/Undertaking sincerely feel
and believe that they cannot live together as husband and wife
any more under any circumstances, they have decided to get
their marriage dissolved by a decree of divorce by mutual
consent, after completion of more than one year of separation,
till than both parties will/ have lived separately from each
other.

2. That the parties to the present Memorandum Of


Understanding/Deed of Settlement/ Undertaking have
mutually agreed and undertaken to move the petitions under
section 13-b(1) & 13-b(2) for mutual consent divorce before
the competent court of law at District Court at Delhi,
imminently, without wasting further time and also move
appropriate application for waving the stipulated period of six
month in filing the second motion along with mutual consent
divorce petition for betterment of the parties and will co-
operate each other in the said case.

3. That the parties to the present Memorandum Of


Understanding/Deed of Settlement/ Undertaking have
mutually and amicably decided/ settled all their claims,
disputes and grievances with regard to the dowry articles/
stridhan, maintenance – past, present and future and
alimony OF 20,000 per month along with all the medical
expenses of the children to be paid by the first party to the
second party, that has been mutually decided on the very first
instance of filing this Mutual divorce petition between the
parties.

4. The second party will allow the first party to meet the children
once every week.

5. That the present parties agree to abide by the present


Memorandum Of Understanding/Deed of
Settlement/Undertaking.

6. That both the parties shall have no relation or concern


whatsoever in any manner with each other after dissolution of
the marriage of both the parties by mutual consent as
mentioned above.

7. That parties to the present Memorandum Of


Understanding/Deed of Settlement/Undertaking agrees and
undertakes not to interfere or create any legal, social,
economical, physical or mental troubles in any manner in the
life of each other after dissolution of the marriage of both the
parties by mutual consent as mentioned above.

8. That parties to the present Memorandum Of


Understanding/Deed of Settlement/Undertaking shall cease to
have any right to file or initiate any case of civil or criminal or
matrimonial nature against the first party in relevance to this
marital dispute, if any, lodged by them against each other or
their relatives, after dissolution of this marriage of both the
parties by mutual consent as mentioned above.
9. That if either of the party has filed any complaint which is
notin knowledge of the either of the parties in any court of law,
police, or any authority either in New Delhi or in part of India,
then it shall deemed to be considered as compromised and
withdrawn and shall not have any legal effect.

10.It is specifically agreed between the Parties that in case the


terms and conditions as stipulated in the present Memorandum
Of Understanding/Deed of Settlement/Undertaking are not
complied with by either of the Parties, then the aggrieved
party(s) shall have the right to pursue the same in accordance
with law.

11.Except as mutually agreed in this Memorandum Of


Understanding/Deed of Settlement/Undertaking, both the
Parties further agree and undertake that they shall have no
claim or right qua any immovable or movable properties of the
other party or against the family members of the other party
whether self-acquired, HUF or ancestral under any
circumstances now or in future, immediately in view of the
present Settlement Deed.

12.Pursuant to engrossing their signatures on the present


Memorandum Of Understanding/Deed of
Settlement/Undertaking, the First Party and Second Party shall
not interfere in the lives of each other in any manner including
personal, oral, written, electronic or telephonic contact and
also will not make any allegation against each other and/or
their respective family members.
13.The present Memorandum Of Understanding/Deed of
Settlement/Undertaking is effective and enforceable from date
of its execution and shall remain effective and binding and
form part of the decree for mutual consent.

14. It is agreed between the Parties that they will strictly adhere to
the terms and conditions of this Settlement and will do all acts
necessary for the expeditious compliance of the same and shall
cooperate with each other and do all acts and sign all the
relevant documents required for the purposes of obtaining
divorce by mutual consent.

15.Both the Parties have entered into this Memorandum Of


Understanding/Deed of Settlement/Undertaking at their own
accord and free will, without perpetration of any force, undue
influence or coercion from any quarter, and both the Parties
shall be estopped in law to assail the validity of any
clause/term of the Settlement on the ground of the same being
void or unlawful. Further, the Parties have further confirmed
and undertaken that they were given sufficient time and
opportunity to consult their legal Counsels of their choice and
it is only after said consultations with the counsels of their
choice, after full understanding of the effect of the terms and
conditions of the present settlement Deed, that the Parties have
executed the present Settlement Deed.
AND WHEREAS Parties are executing this Memorandum Of
Understanding/Deed of Settlement/Undertaking after understanding
the contents of the same in vernacular and voluntarily without
pressure, threat or coercion in the presence of the relatives of both
the parties and respectable persons of the society.

IN WITNESS WHEREOF both the Parties have signed this


Memorandum Of Understanding/Deed of Settlement/Undertaking at
the places and on the day, month and year first above written.
