Works Rights Notification and Authorization
数据堂（北京）科技股份有限公司（以下简称“数据堂”）是一家全球性的数据服务和数据处理公司，致力于
为人工智能研究领域提供数据采集和数据标注服务。数据堂根据经营需求，现将对您的人脸、身形、声音等通过拍
摄、摄像、录音等方式（以下简称为“采集”）制作形成图像、视频、音频或其他形式的作品，并将该作品用于或
授权第三方企业用于人工智能领域的技术研究开发、学术论文写作等用途。鉴于该作品可能包含您的个人信息，数
据堂根据法律法规的规定，将相关权利告知，并征求您的同意，请您认真阅读本文件，您签署本文件后即视为您完
全知晓、理解并同意本文件内容并做出相应授权。
Datatang (Beijing) Technology Co., Ltd. (hereinafter referred to as "Datatang") is a global data service
and data processing company. Datatang is committed to providing data collection and data annotation
services for research purposes of artificial intelligence development. According to business demand,
Datatang will produce images, videos, audios, or other forms of works of your face, body, voice, etc.,
through image captures, video recordings, and audio recordings (hereinafter referred to as " Collection").
Datatang and our authorized third-party companies may use the works for artificial intelligence technologies
development, academic paper writing, and other purposes. The works may contain your personal
information through authorization according to the provisions of laws and regulations. By signing this
document, you acknowledge that you have read, understood, and agreed to the content of this document and
authorized Datatang to use it.
一、【作品信息】您本次根据数据堂本次委托您配合采集制作的作品信息如下：
I. [the Works Information] The information of the Works you have commissioned to collect and
produce according to the Datatang is as follows:
1.【作品名称】 1 万人人脸图片数据采集 。（以下简称“本次作品”）
1. [ The Works Name] 10,000 people face image data collection . (Hereinafter referred to as "the
Works")
2.【报酬对价】数据堂采用有偿方式采集制作作品，采集成果符合项目要求后，您将获得相应的对价（数据堂
支付或委托第三方支付），采集价格因作品不同而有所不同，具体以数据堂向您支付的金额为准，数据堂以本文件
约定方式使用本次作品或处理您的个人信息或根据法律法规规定再次向您征求单独同意时，均无需再次支付报酬。
2. [Remuneration] Datatang adopts the method of compensable collection. The collection price varies
depending on the Works, and the specific amount is to be determined by Datatang. When the collected
information meets the Works’ requirements, you will get the corresponding remuneration (paid by Datatang
or a third party). Datatang may use the Works and possess your personal information, in the manner agreed
in this document. The laws and regulations may request Datatang to seek your further authorization to use
the works, and no additional consideration will pay.
3.【权利归属】本次作品的所有权、知识产权、数据权益归属数据堂所有。本次作品的所有权、知识产权、数
据权益受侵害后，数据堂有权以自己的名义进行民事诉讼、刑事报案、获得赔偿等。数据堂或数据堂授权的第三方
根据本次作品加工、研发形成的数据、技术等的相关权利归数据堂所有，您无权就本次作品主张权利或再次要求给
付报酬。
3. [Ownership of Rights] Datatang has the ownership, intellectual property rights, and data rights of
the Works. Datatang or Datatang's authorized third party owns the rights of the Works and technology
formed by processing, researching, and developing the Works. In the event of an infringement of the Works'
intellectual property rights and data rights, Datatang has the right to file civil lawsuits, criminal reports, and
obtain compensation in its name. You will not be entitled to compensation or claim any rights for the Works.

二、【个人信息】本次采集制作的作品将收集的个人信息，具体如下：

Works as follows:
1. 【个人信息种类】本次作品收集的个人信息为： 人脸、声音（声纹）、指纹、其他 。
数据堂不会将您于本文件登记的姓名、联系方式作为作品的一部分进行处理，其仅用于向您告知涉及您个人信息相
关事宜以及征求单独同意。
1. [Types of Personal Information] The personal information collected in the Works are: faces,
voices (voiceprint), fingerprints, others . The name and contact information registered in this
document will not be processed as part of the Works. Datatang will only use name and contact information
to inform you of matters related to your personal information and to seek individual authorization.
2.【处理目的及必要性】数据堂将本次作品用于人工智能领域的技术研究开发及相应的商业用途，主要为人脸
识别、声音合成、声音识别、指纹识别等，鉴于前述技术研发客观需要，本次作品收集您前款所述的个人信息是客
观必要的。
2. [Processing Purpose and Necessity] Datatang may use the Works for technical research and
development in the field of artificial intelligence and corresponding commercial purposes mainly for face
recognition, voice synthesis, voice recognition, fingerprint recognition, etc. Given the objective needs for the
aforementioned technical research and development, it is objectively necessary for the Works to collect your
personal information as described in the preceding paragraph.
3.【处理方式】数据堂处理本次作品所包含的个人信息的具体方式包含收集、存储、使用、加工、传输（不限
于您国籍国境内）、提供、公开、删除、创造衍生作品、在网站或展会等场所展示以及授权第三方以前述方式进行
处理等。
3. [Processing Methods] The specific ways in which Datatang will process the personal information
contained in the Works include collecting, storing, using, processing, transmitting (not limited to the country
of your nationality), providing, disclosing, deleting, creating derivative works, displaying on websites or at a
trade show,and authorizing third parties to process in the aforementioned manner.
4.【保存期限】数据堂将以实现采集目的所必需的最短时间为存储原则，但一般情况下由于您的个人信息在数
据堂的处理下成为人工智能模型训练的基础数据，而这一数据将永久对人工智能模型训练具有价值，因此若您未行
使删除个人信息权利，数据堂将会在服务器中永久保存您的个人信息，并长期处理使用。
4. [Retention Period] Datatang will take the least amount of time needed for the collection as its
storage principle. Your personal information will become the basic data for artificial intelligence model
training under the processing of Datatang, and this data will be incorporated for AI model training
perpetually. Therefore, if you do not exercise the right to delete your personal information, Datatang will
perpetually store your personal information on the server and retain for long-term use.
三、【权利告知及行使方式】鉴于本次作品包含您的个人信息，数据堂现将法律法规赋予您的相关权利及行使
途径告知如下：
III. [Notification of Rights and Ways to Exercise] Given that the Works contains your personal
information, Datatang needs to inform the relevant rights granted to you by laws and regulations and
the ways to exercise them as follows:
1.【权利】您享有请求查阅、更正、补充、删除您个人信息的权利，若您行使删除个人信息等权利将致使作品
实质无法使用，则您应当于数据堂执行相应操作前，先行返还数据堂支付的报酬。
1. [Rights] You have the right to request access, check, correct, update, and delete your personal
information. If you exercise your right to delete your personal information, which makes the Works
substantially unusable, you shall return the remuneration paid by Datatang before Datatang performs the
corresponding operations.

据堂，行使前款所述的各项权利，数据堂将在收到您的请求后作出相应的操作。

2. [Exercise Method] To exercise the rights mentioned in the preceding paragraph, you can contact
Datatang through Datatang’s official website https://www.datatang.com or email law@datatang.com.
Datatang will make corresponding actions upon receipt of your request.
四、【特别告知】鉴于本次作品包含您的个人信息以及数据堂对本次作品的使用方式，数据堂做出特别告知如
下：
IV. [Special Notice] In view of the fact that the Works contains your personal information and
the way that Datatang uses the Works, Datatang makes a special notice as follows:
1.【信息告知】鉴于数据堂使用本次作品的方式包括授权第三方使用本次作品，数据堂将不可避免地向被授权
的第三方提供您的个人信息，数据堂会通过您预留的联系方式或使用数据堂指定的 APP 或网站将接收方名称、联系
方式等信息告知于您。
1. [Information Notification] Given that Datatang’s use of the Works includes authorizing a third
party to use the Works, Datatang will inevitably provide your personal information to the authorized third
parties. Datatang will contact you through your reserve contact information or use the APP or website
designated by Datatang to inform you of the recipient's name, contact information, and other information.
2.【单独同意】鉴于数据堂使用本次作品的方式包括授权第三方使用本次作品，法律法规规定需要再次取得您
单独同意的，数据堂会通过您预留的联系方式或使用数据堂指定的 APP 征求您的同意。基于本次作品的处理目的以
及为了促进个人信息合理使用与技术研发，您同意在数据堂发送通知后 3 日内您未作出反对答复，视为您同意此次
数据堂向第三方提供您的个人信息以及接收方依据其与数据堂的约定处理您的个人信息。
2. [Separate Authorization] Given that Datatang’s use of the Works includes authorizing a third party to
use the Works, abiding by the laws and regulations to obtain your separate authorization, Datatang will send
the notice to get your authorization again through the contact information you provided, the APP, or the
website designated by Datatang. Considering that the processing purpose of the Works is to promote
technological research and development through the reasonable use of personal information, you agree that
Datatang can provide your personal information to the third party without your additional separate
authorization if you do not reply with any objections within three days after the notice is sent. The third
party has the right to process your personal information in accordance with the agreement between the third
party and Datatang.
3.【跨境传输或提供】鉴于数据堂使用本次作品的方式包括授权第三方使用本次作品，数据堂可能将您的个人
信息传输至您国籍国境外或提供至您国籍国境外第三方，法律法规规定需要再次取得您单独同意的，数据堂会通过
您预留的联系方式或使用数据堂指定的 APP 征求您的同意，基于本次作品的处理目的以及为了促进数据流动与技术
研发，您同意在数据堂发送通知后 3 日内您未作出反对答复，视为您同意此次数据堂向境外传输或向境外第三方提
供您的个人信息以及接收方依据其与数据堂的约定处理您的个人信息。
3. [Cross-border Transmission or Provision] Given that Datatang’s use of the Works includes
authorizing a third party to use the Works, Datatang may transfer your personal information outside of your
country of nationality or provide it to a third party outside of your country of nationality. The laws and
regulations require that each cross-border transmission needs to obtain your separate authorization. Datatang
will seek your authorization through the contact information you have reserved, the APP, or the website
designated by Datatang. Based on the purpose of processing the Works and promoting the data flow and the
technology development, you agree to respond within three days after the notice is sent. If you do not reply
with any objections within three days, you agree that Datatang transmits your personal information outside
of your country of nationality or provides it to a third party outside of your country of nationality without
additional separate authorization. The third party has the right to process your personal information in
accordance with the agreement between the third party and Datatang.

括但不限于专用的服务器以及数据加密等）和组织上的措施防止您的个人信息在存储及传输环节不被任何未经授权
的第三方获取或使用；目前，数据堂已通过了国际权威的 ISO9001 质量管理体系认证、ISO27001 信息安全管理体系
认证和 ISO27701 隐私管理体系认证。
1. [Information Security] To ensure the security of your information, Datatang and its related parties
and third parties authorized by Datatang will take all appropriate technical (including but not limited to
dedicated servers and data encryption, etc.) and organizational measures to prevent your personal
information from being obtained or used by any unauthorized third party during storage and transmission;
As currently dated, Datatang has been certified the internationally authoritative ISO9001 Quality
Management System Certification, ISO27001 Information Security Management System Certification, and
ISO27701 Privacy Management System Certification.
2.【安全事件】如发生数据泄露事件，数据堂将会及时在公司官网及其他公开渠道发布信息并配合国家相关部
门对数据泄露事件进行处理。如果泄露的数据涉及到您，您可以与数据堂进行沟通并获取数据泄露事件的最新进展，
并通过法律途径获得相应赔偿。
2. [Security Events] In the event of a data leakage incident, Datatang will promptly release the incident
information on the company's official website and other public channels. Datatang will cooperate with
relevant national departments to handle the data leakage incident. If the leaked data pertains to you, you can
communicate with Datatang to get the latest progress of the data breach and obtain corresponding
compensation by legal approaches.

本人已经仔细阅读并且完全知悉、理解了本告知及授权书的内容。本人特授权数据堂（包括数据堂关联公司及
其他数据堂授权的第三方）根据本授权的条款采集使用本人的个人信息。电子邮箱将是数据堂联系您的唯一方式，
请您确保电子邮箱准确无误，否则无法通知等相关责任由您承担。
I have carefully read and fully understand the contents of this Works Rights Notification and
Authorization. I authorize Datatang (including Datang’s affiliates and other third parties authorized by
Datatang) to collect and use my personal information under the terms of this authorization. Datatang will
only contact you via E-mail. Please ensure that the e-mail you provide is accurate and active, otherwise, you
will be responsible for the inability to be notified.
