APPLICATION FOR ALTERATION OF CHARGES UNDER SECTION 216
READ WITH SECTION 251 OF CRIMINAL PROCEDURE CODE
The under-signed applicant most respectfully submits as follows:
1) It is submitted that the above-mentioned case is a summons case instituted on
a police report wherein the allegation against the accused in the FIR and Final Report were u/s 323,504,341 and 506 of the IPC and this honourable court took cognizance of the said offences only.
2) This honourable court on 10-01-2024 framed the charges /read the substance of the accusation to the accused and in addition to the charge’s U/s 323,504,341 and 506 of the IPC, this Hon’ble Court has also charged the accused U/s 324 of the IPC (voluntarily causing hurt by dangerous weapons or means).
3) It is humbly submitted there is neither any allegation nor any materials on
record regarding commission of offence U/s 324 of the IPC.

WHEREFORE, in view of aforesaid grounds the accused most humbly prays that this Hon’ble Court may kindly be pleased to amend the charges and thereby drop the charge U/s 324 and try the accused in a summons trial.
