Dear Madam:

This refers to your application for an Environmental Compliance Certificate


(ECC) for the proposed ARUSO CO. LTD. GASOLINE REFILLING STATION
Project located in Block 4, Lot 4093-A, National Highway Purok Puso, Brgy.
Somosa, Tabogon, Cebu, Region VII (Central Visayas), 6009 Tabogon, Cebu.

After satisfying the requirements of Presidential Decree No. 1586, pursuant to


its Implementing Rules and Regulation, the Department, through this Office
has decided to grant an ECC for the above-mentioned project.

In this regard, the proponent is expected to fully implement the measures


presented in the Initial Environmental Examination Checklist (IEEC), intended
to protect and mitigate the project's predicted adverse impacts on community
health, welfare, and the environment. Environmental considerations shall be
incorporated in all phases and aspects of the project.

This certificate does not create any right nor can it be used as an authorization
to implement or commence with the operation of the project. This Office shall
be monitoring the project periodically to ensure strict compliance with the
stipulations cited in the attached ECC.

THIS IS TO CERTIFY THAT THE PROPONENT, ARUSO CO. LTD., as


represented by its Owner, Maria Kelly A. Nolasco, is granted this
Environmental Compliance Certificate (ECC) for its ARUSO CO. LTD. Gasoline
Refilling Station located in Block 4, Lot 4093-A, National Highway, Purok
Puso, Brgy. Somosa, Tabogon, Cebu, Region VII by the Department of
Environment and Natural Resources (DENR), through the Environmental
Management Bureau (EMB).

SUBJECT to the conditions and restrictions set out herein labeled as Annexes
A and B:

PROJECT DESCRIPTION
This Certificate shall cover the ARUSO CO. LTD. Gasoline Refilling
Station with an area of Seven Hundred Fifty (750) square meters to
be located in Block 4, Lot 4093-A, National Highway, Purok Puso,
Brgy. Somosa, Tabogon, Cebu, Region R07 with geographic
coordinates of 10°58'15.8"N and 124°00'16.9"E.

PROJECT COMPONENTS

1. Underground Storage Tanks – Twenty-four point Ninety-two


(24.92) square meters:
 Two (2) units for Gasoline, 15.14 kiloliters each tank;
 One (1) unit for Diesel, 22.71 kiloliters;
2. Two (2) Units Dispensing Pump – Two (2) square meters;
3. Canopy – Sixty-three (63) square meters;
4. Office – Seventeen point Sixty (17.60) square meters;
5. Employee Room – Four point Forty (4.40) square meters;
6. Air and Water Station – Two (2) square meters;
7. Price Board and Pylon Sign Area – Two (2) square meters;

The project has a total storage capacity of 52.99 kiloliters of


various fuels with EURO 4 standards or higher as indicated in the
submitted ECC online application.

This Certificate is issued in compliance with the requirements of Presidential


Decree No. 1586, and its Implementing Rules and Regulations. Non-
compliance with any of the provisions of this Certificate including the
mitigating measures cited herein shall be a sufficient cause for its cancellation
and/or imposition of a fine in an amount not to exceed Fifty Thousand Pesos
(P50,000.00) for every violation thereof without prejudice to the imposition of
fines and penalties under other environmental laws. The EMB, however, is not
precluded from reevaluating and correcting any deficiencies or errors that may
be found after issuance hereof.

I. ENVIRONMENTAL MANAGEMENT

All commitments, mitigating measures and monitoring requirements, especially


those contained in the Initial Environmental Examination Checklist Report,
particularly in the Environmental Management and Monitoring Plan (EMMoP),

II. GENERAL CONDITIONS

1. This ECC supersedes the Certificate of Non-Coverage (CNC) for the 16-kL
total storage capacity gasoline refilling station project docketed as CNC-
OL-R07-2023-06-02025 located within the same site issued on June 30,
2023 by the EMB Central Office;

2. The Proponent shall strictly comply with the commitments, mitigating


measures, and monitoring requirements, especially those contained in
the IEEC Report, particularly in the EIA Management Plan (EIAMP) to

minimize any adverse impact to the environment throughout the project
implementation as indicated in Annex A;

3. Conduct effective Information, Education, and Communication (IEC)


activities to inform and educate all stakeholders. The proof of conduct of
the IEC activities shall be submitted to EMB Regional Office prior to
project implementation. The Proponent shall also provide copies of this
approved ECC to pertinent government offices, to wit: DENR-MGB7,
DENR7-PENRO, DENR7-CENRO, DOE, Barangays, and concerned LGUs
and submit proof of receipt together with the first Compliance Monitoring
Report (CMR);

4. The Proponent shall install and maintain an adequate and efficient


wastewater treatment facility to treat all wastewater coming from
different sources. Subsequently, the proponent shall ensure that
discharges/effluents should comply with the DENR standards and with
all the provisions of RA 9275, the Philippine Clean Water Act of 2004 and
its Implementing Rules and Regulations at all times;

5. The Proponent shall install and maintain air pollution control devices to
minimize dust and gas emissions from different sources. Likewise, the
Proponent shall ensure that emissions comply with the DENR standards
and all the provisions of RA 8749, the Philippine Clean Air Act of 1999,
and its Implementing Rules and Regulations at all times;

6. The Proponent shall implement proper collection, handling, treatment,


storage, and disposal of hazardous wastes in compliance with all the
provisions of RA 6969, the Toxic Substances and Hazardous and Nuclear
Wastes Control Act of 1990 and its Implementing Rules and
Regulations;

7. The Proponent shall ensure compliance with all the provisions of RA


9003, the Ecological Solid Waste Management Act of 2000 and its
Implementing Rules and Regulations;

8. Establish a reforestation program to mitigate GHG emissions in line with


the DENR programs. The Proponent shall produce, plant, and maintain
One Hundred Twenty-five (125) seedlings or bamboo shoots or mangrove
propagules. As proof of compliance, submit the following together with
the Compliance Monitoring Report (CMR):

a. Geotagged pictures of the mangrove planting area;


b. LGU/DENR-CENRO Certification, and;
c. MOA with the 3rd party, if applicable;

The tree-growing activities shall be completed in less than 1 year;

9. A 2’ x 4’ billboard containing this message: “Notice to the Public, This


project <Project Name> with geographic coordinates of <Latitude> and
<Longitude> has been issued an Environmental Compliance Certificate
(ECC Number) by the Environmental Management Bureau of the
Department of Environment and Natural Resources, Region VII'' shall be
installed at a conspicuous/visible area to inform the general public
before project implementation and shall be posted all throughout the
project operation;

10. The Proponent shall establish an adequate rainwater harvesting/cistern
storage tank upon project implementation as an additional measure in
water resources management. The collected rainwater will be used for
toilet flushing, landscaping, and other reusing purposes to prevent storm
runoff overflow to nearby areas or roads;

11. Designate a full-time Managing Head and/or Pollution Control Officer


(PCO) that shall competently handle the environment-related aspects of
the project before implementation, if applicable. In addition to the
monitoring requirements as specified in the Environmental Management
Plan/Environmental Monitoring Plan, they shall have the following
responsibilities:
a. Monitor actual project impacts vis-à-vis the predicted impacts and
management measures in the IEEC;
b. Recommend revisions to the EIAMP/EMMoP, whenever necessary
subject to the approval of EMB RO;
c. Ensure that data gathered during monitoring activities are properly
assessed, documented, evaluated, and reported to EMB Regional
Office in accordance with the standard formats; and
d. Ensure that monitoring and submissions of reports (such as, but not
limited to, semi-annual Compliance Monitoring Report, quarterly
Self-Monitoring Report, etc.) to EMB are carried out as required;

12. Emergency Preparedness, Contingency Plan, and Preventive Maintenance


to address possible case of accidental spills, explosion, leakage, and
environmental hazards shall be established and submitted to this Office
together with the Compliance Monitoring Report;

13. Any inconsistency and/or falsification or misrepresentation of data,


information, plans, proof of authority, land use compatibility, or any
supporting documents in the submitted ECC application in comparison
with the actual implementation as determined by this Office and/or any
concerned government agency shall be a ground for the suspension of
this ECC and/or other legal sanctions;

14. The Proponent shall allow entry of EMB7 field personnel into the project
site at all times to conduct monitoring and to validate the project’s
compliance to the ECC conditions stipulated therein;

15. Adequate mitigating measures on the generation of harmful vapor


emissions shall be implemented during loading/discharging operations
from the fuel tank truck to the underground storage tank, such as, but
not limited to, installations of gas vents with filter membrane and hose
fitting at the discharge point to the underground storage tank;

16. Any damage/destruction to the adjacent property/land, etc. caused by


the project implementation shall be reported immediately to this Office
copy furnished DENR7-CENRO and EMB7. The operation should be
stopped immediately, and restoration/mitigation shall be carried out by
the Proponent. A report of the immediate stoppage and
mitigation/restoration shall be submitted to this Office within 24 hours
from the time of the incident;

17. Underground fuel storage tanks shall be provided with secondary

containment and shall be in accordance with internationally acceptable
standards. Regular checking of tanks to determine possible leaks shall
be undertaken and that tanks shall be replaced upon reaching its
average lifespan. Should there be any damage to the environment,
particularly on ground water contamination, the proponent shall and
shall immediately stop the operation of the fuel refilling station;

18. In case of abandonment, the Proponent shall submit to EMB an


Abandonment Plan to include Environmental Site Assessment (ESA) six
(6) months prior to actual pull out of underground storage
tank(s)/facilities. The Abandonment Plan shall include rehabilitation
measures/clean-up, remediation of areas affected by the project and
proposed alternative projects in the area;

19. The proponent shall ensure that the proof of authority over the project
area and tenurial are valid prior to implementation of the project. Any
complaint, conflict, and issue arising from the ownership or right over
the area/s covered shall be resolved by the proponent with the
appropriate concerned Government Agency/Entity (e.g., DENR7, affected
LGUs, Registry of Deeds, Judicial Courts, etc.);

III. RESTRICTIONS

19. This certificate should not be construed as a permit or any form of proof
of authority/ownership;

20. No cutting down of trees during project implementation should be done.


However, when clearing an area is unavoidable, a Tree Cutting Permit
must be secured from DENR-CENRO;

21. The proponent shall coordinate with other concerned Government


Agencies in the management of the project and shall implement only
after securing all the necessary and relevant permits from other pertinent
Government Agencies;

22. The Proponent shall not commercialize nor illicitly dispose outside the
project site of any quarried material resulting from clearing and
development of the project. Otherwise, a separate ECC will have to be
applied for quarry activities;

23. No other activities shall be undertaken other than what was stipulated in
the updated IEEC document. Any expansion or modification of the
Project beyond the project description or any change in the activity shall
be subject to a new EIA requirement; and

24. In case of transfer of ownership of this Project, these same conditions


and restrictions for which written notification must be made by herein
grantee to EMB within fifteen (15) working days from such transfer.

PROJECT ASSESSMENT PLANNING TOOL

For the assistance and guidance of the Proponent and Government agencies
concerned in the management of the Project and for better coordination in
mitigation of the impacts of the Project on its surrounding areas and the
environment, the following recommendations are forwarded to the parties and
authorities concerned for appropriate action.

Requirements for the Proponent

Local Government Unit (LGU)

1. The proponent shall give priority employment to qualified local residents.


Adequate public information for jobs available to local residents in the
affected areas shall be provided
2. The proponent shall comply with the Building Code and Sanitation Code of
the Philippines
3. The proponent shall coordinate with the concerned LGU for the
implementation of Solid Waste Management Plan
4. The proponent shall implement the emergency response plan and disaster
preparedness program in case of emergencies
DENR-Forest Management Bureau (FMB)

5. The proponent shall secure tree cutting permit if any


DOLE – Bureau of Working Condition

6. The proponent shall comply with the Labor Code of the Philippines
DOE
7. The proponent shall comply with pertinent policies relative to energy
exploration, development, utilization distribution, and conservation

8. The proponent shall comply with the fire safety protection requirements of
the Fire Code of the Philippines
