That on 12.03.2012, SI Surinder Singh I/C PP Seeto

Guro PS Bahav Wala along with HC Sukhraj Singh, HC

Lakhwinder Singh 259, C Sarwan Singh 2649, PHG Som

Dutt 6791, PHG Radhey Sham 6714 via official

vehicle PB-05-L-5655 which was driven by HC

Lakhwinder Singh were present at area of Moti Khera

Tikoni Mod for barricading and checking of

suspicious persons and in the meantime Sanjay Kumar

son of Bheeka Ram resident of Seeto Guro who came

from the side of Village Tarsala came and SI

Surinder Singh was discussing with him and in the

meantime from the side of Village Tarsala one

vehicle approached and SI signalled with Torch to

stop the vehicle and upon seeing police party ahead

the driver of vehicle got nervous and he attempted

to turn the vehicle backwards and vehicle got

stopped suddenly. Thereafter, SI along with

colleagues reached near vehicle and vehicle number

was RJ-03-GA-0671 Mark Max Jeep and the driver fled

from the spot after leaving the vehicle and the


second person who was sitting on the seat adjoining

driver seat said that Karaj Singh fled from here

after entangling me in all this. He was apprehended

and his name and address was questioned and he

informed his name as Harjit Singh alias Laadi son

of Bagga Singh Caste SC resident of Sherpur PS

Jeera District Ferozepur and he informed that the

person who fled from the spot is Karaj Singh son of

Buta Singh alias Fauji Caste Majhabi Sikh resident

of Sherpur PS Jeera. Nand Kumar son of Bheekar Ram

resident of Seeto Guro was informed about the

situation and he was involved in police

proceedings. In the body of Max Pickup Jeep No. RJ-

03-GA-0671, bags ‘boriyan’ were kept and upon being

suspicious about its contents SI Surinder Singh

informed Surjit Singh that I, SI Surinder Singh

Police Post Incharge Seeto Guro intends to search

the vehicle as I am suspicious that the bags have

some drug related contents. But you have legal

rights that you can get the search of your bags

‘boriyan’ conducted in presence of Magistrate or

any Gazetted Officer. Then Surjit Singh accused

said to SI Surinder Singh that I intend to get my

vehicle searched in presence of any Gazetted

Officer. On this, SI Surinder Singh prepared

disclosure of dis-consent and witnesses appended

their signatures on the same. Thereafter, SI


Surinder Singh messaged through wireless and

requested Sh. Vibhor Kumar DSP Abohar to arrive on

the spot and after about 45 minutes Sh. Vibhor

Kumar DSP Abohar arrived on the spot via official

vehicle along with Gunman and SI informed all facts

of the case to DSP Abohar. Thereafter, DSP informed

Accused Surjit Singh that my name is Vibhor Kumar

and I am DSP Abohar and I am Gazetted Officer. Bags

‘boriyan’ kept in your vehicle are to be searched

but you have legal right that you can get the

search of your bags ‘boriyan’ conducted through

Magistrate. On this Accused Surjit Singh said that

I have trust on you and thereafter disclosure of

consent was prepared by DSP after providing

information to accused about his rank. Witnesses

and accused Surjit Singh appended their signatures

on the same. Thereafter, DSP instructed SI Surinder

Singh to search the bags ‘boriyan’. That 25 bags

‘boriyan’ of plastic and 13 bags ‘boriyan’ of

‘taat’ cloth were there and total 38 bags ‘boriyan’

were there. Bags ‘boriyan’ were marked with numbers

from 1 to 38 and below the bags one plastic bag

containing brown color drug material were

recovered. Opening of the bags were opened and

checked and in all bags ‘bhukhi chura post’ was

recovered and plastic bag was opened and opium was

recovered and the same was weighed with spring


weighing scale and it was 9.5 kg opium. From the

recovered opium, 10 gram opium was taken out as

sample and was kept in a plastic box ‘dibbi’ and

parcel was prepared and another parcel was prepared

with 10 gram opium and was kept in a plastic box

‘dibbi’. Remaining opium weighing 9 kg 480 grams

was kept in the same plastic bag and one separate

parcel was prepared and the opening of the bag was

sewed with thread and the same was kept in a

plastic box and parcel was prepared. From each bag

‘bori’ recovered sample of 250/250 gram ‘bhuki

chura post’ was taken out as sample and 38 separate

parcels were pepared and all parcels were marked

with numbers 1 to 38 and remaining bags were

weighed with spring weighing scale and each bag was

weighed 34.5/34.5 kg. Opening of the bags were tied

and 38 parcels were prepared. Thereafter, SI

Surinder Singh engraved all parcels of bhuki chura

post and opium with his seal initials ‘SS’ and M-29

Form compliance was conducted and seal was handed

over to HC Sukhman Singh 844 after use. Thereafter,

DSP engraved all parcels with his initials ‘VK’ and

sample stamp was also marked as ‘VK’ and verified

the same. Thereafter, SI Surinder Singh took all

parcels along with sample stamp and M-29 Form in

police custody via disclosure. Witnesses appended

their signatures on the disclosure. DSP verified


the disclosure. Surjit Singh accused and Karaj

Singh accused have kept opium and bhuki chura post

in their custody and by doing so they have

committed offences under section 13, 15, 25, 61/85

NDPS Act and accordingly written submission was

prepared against accused and was sent to Police

Station for case registration through PHG Radhey

Sham and case was got registered. Enquiry

proceedings were conducted on site. Inspection of

site was conducted and site layout was prepared and

statements of witnesses were noted and accused

Surjit Singh was informed about brief facts of the

case and he was arrested as per procedure. Jeep Max

Pickup No. RJ-03-0671 was taken in police custody

via separate disclosure. Accused Surjit Singh was

searched and from front pocket of his shirt which

he was wearing, Rs. 200/- currency note was

recovered. The same were taken in police custody

via disclosure. Witnesses appended signatures on

the disclosures. Upon arriving at Police Station

the case material as per disclosures was handed

over to SI Makhan Singh SHO. SI Makhan Singh kept

the case material in his custody at police station

and after questioning with accused Surjit Singh he

was locked up in police station lock up. On

12.3.12, Accused Surjit Singh was presented before

Hon’ble Court and Hon’ble Court of Sh. Mohit Bansal


JMIC Abohar verified the case material and sealed

the material. Police remand of accused was provided

till 16.3.12. Surjit Singh was sent for questioning

at Amritsar. That apart from this recovery, no

other recovery was made from the accused. That

accused was presented before Hon’ble Court of Sh.

Mohit Bansal JMIC and order was provided for his

judicial remand and accordingly he was sent to

Judicial Prison Fazilka. Case material including

parcels of bhuki chura post and opium were sent to

Kharar for chemical examination through Darshan

Singh 1434. In this case, recovered RC of Max Pick

up jeep No. RJ-03-GA-0671 has been got verified. In

this regard, upon enquiry it was found that the

vehicle owner has no involvement in this case.

Therefore, in this case offences under section 25

61/85 NDPS are not observed. Second accused of the

case Karaj Singh is yet to be arrested and for him

proceedings under section 82/83 Cr.PC are in

process before Hon’ble Court. Enquiry of the case

is completed. Result of chemical examination from

Kharar for the parcel of opium has been received.

That result is found as opium. The strength is 3.4%

and result for parcels of bhuki chura post is yet

to be received. That upon receiving the same, the

same shall be enclosed with the challan. From the

investigation till now, from the recovery of opium


and bhuki chura post, from the questioning with the

accused, sufficient evidences have been observed

for submission of challan against the accused under

section 15, 18, 61/85 NDPS Act. Accordingly,

challan is prepared against Accused Surjit Singh

son of Bagga Singh under section 173 Cr.PC and is

being presented before this Hon’ble Court. Further

compliance may kindly be conducted. Witnesses as

per column 6 may be summoned and appropriate

punishment be given to accused as per law.
