    SHANKAR KOTAGI SEEKING EXEMPTION FROM PERSONAL
    APPEARANCE FOR TODAY;

    MOST RESPECTFULLY SUBMITTED:


    1. That the present matter is pending adjudication before this Hon’ble

    Court and listed today i.e; 16.12.2022, for prosecution evidence.

    2. It is stated that the Applicant/ Accused is has meet with an accident

    on 13.12.2022, as his car got slipped from the road and fell down in

    the roadside farm land. The photos of the car showing above said

    accident is annexed herewith as ANNEXURE A1(COLLY).

    3. It is further submitted that the non appearance of the accused is not

    intentional neither deliberate, as his train tickets were already

    booked from Belagavi to Delhi for the presence on NDOH i.e; is

    today 16.12.2022. The copy of the train tickets is annexed herewith

    as ANNEXURE A2.

    4. That due to the above-mentioned reason, the applicant/accused is

    unable to be present before this Hon’ble Court today. It is most

    respectfully submitted that the aforementioned circumstances are

    beyond control of the Applicant/ Accused and his non-appearance


    for today before this Hon’ble Court is neither intentional nor

    deliberate.

    5. That the Applicant/Accused has also dutifully and diligently made

    himself present before this Hon’ble Court on all the previous dates

    and his conduct has also been good.

    6. That the present application is filed with bonafide and in the interest

    of justice, therefore, the same maybe allowed by this Hon’ble Court.

    7. That the Applicant/ Accused has not filed any other application

    seeking similar relief before any other Court of Law, except the

    present application.

    PRAYER
    In view of the facts and circumstances narrated hereinabove, it is most

    respectfully prayed before this Hon’ble Court to:

    A. Allow the present application and exempt the Applicant/ Accused

    from his personal appearance for today only;

    B. Pass any further Order(s) and/ or Direction(s), which this Hon’ble

    Court may deem fit and proper in the interest of justice.
