MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is entered into by and between:

The GIRL SCOUTS OF THE PHILIPPINES(GSP), created under Republic Act No.
10073, as amended by Commonwealth Act No. 542, series of 1940, with its Provincial
Headquarter, the GSP Negros Oriental-Siquijor Council, represented by its Council
President, DR. PROFETIZA S. LIM, with office address at the Capitol Area, Daro,
Dumaguete City, hereinafter referred to as the FIRST PARTY:

The Province of Negros Oriental, duly created in accordance with law, with office
address at the Provincial Capitol, Daro, Dumaguete City, represented by HON. ROEL
R. DEGAMO in his Official capacity as the Provincial Governor, and is duly authorized
to enter into this Agreement per Sangguniang Panlalawigan Resolution No._________,
current series, hereinafter referred to as the SECOND PARTY;

WITNESSETH:

WHEREAS, Chapter 3, Section 33 of Republic Act 7160, otherwise known as the

Local Government Code of 1991, provides that “Cooperative Undertakings Among
Local Government Units”. Local Government Units may, through appropriate ordinance
group themselves, consolidate, or coordinate their efforts, services, and resources for
purposes commonly beneficial to them. In support of such undertakings, the local
government units involved may, upon approval by the sangguniang concerned after a
public hearing conducted for the purpose, contribute funds, real estate, equipment, and
other kinds of property and appoint or assign personnel under such terms and
conditions as may be agreed upon by the participating local units through Memorandum
of Agreement”;

WHEREAS, Section 36 of the same chapter of said Act, also provides that
“Assistance to People’s and Nongovernment Organizations”. A local government unit
may, through its local chief executive and with the concurrence of the sangguniang
concern, provide assistance, financial or otherwise to such people’s and
nongovernment organizations for economic, socially-oriented, environment, or cultural
project to be implemented within its territorial jurisdiction”;

WHEREAS, the FIRST PARTY is working in the different schools of the province
and in support of the flagship programs of the Provincial Government of Negros
Oriental, which recognizes the vital role of the Filipino Youth in nation-building;

WHEREAS, the FIRST PARTY helps in molding boys and girls into a socially-
conscious, morally educated, skill-tested, environmentally-aware and service-oriented
citizens and future leaders of the country through the various scouting programs,
projects,activities and in the local , regional ,national levels, respectively & operational
expenses.

WHEREAS, cognizant of the need for financial support on operations, and

establishing a strong partnership and cooperation between the two (2) parties, the
SECOND PARTY has appropriated in its 2022 Budget, the amount of TWO HUNDRED
FIFTY THOUSAND (P250,000.00) PESOS in favor of the FIRST PARTY;

NOW THEREFORE, the parties have come to an agreement as they herby

agree that:

WHEREAS, the SECOND PARTY, in its desire to give financial assistance to the
Girl Scouts of the Philippines- Negros Oriental-Siquijor Council, in support of its various
programs and projects, & operational expenses shall grant the amount of TWO
HUNDRED FIFTY THOUSAND (P250,000.00) PESOS, to the FIRST PARTY,
chargeable against the Approved Budget of 2022.

WHEREAS, the FIRST PARTY, shall issue an Official Receipt to acknowledge

the amount received from the SECOND PARTY as financial aid in support of its
operational expenses , projects and programs;

WHEREAS, the FIRST PARTY, through its Provincial Headquarter, situated at

the Capitol Area, Dumaguete City, shall be fully responsible for the accounting and
disbursement of the transferred funds in accordance with existing COA and other
government regulations. In addition, it shall submit verified liquidation reports in
accordance with the COA Circular No. 94-013 dated December 13, 1994;

The parties herein bind themselves to observe and comply with, in good faith, the
provisions of this Memorandum of Agreement which shall be effective for the year 2022;

Hon. Roel R. Degamo, of legal age, and a resident of Siaton, Negros Oriental, herein
referred to as the FIRST PARTY:
And

The GIRL SCOUTS OF THE PHILIPPINES-(GSP)-created under Republic Act

No. 10073, as amended by Commonwealth Act. No. 542, series of 1940, Provincial
Headquarter, the GSP Negros Oriental-Siquijor Council , represented by its Council
President , Dr. Profetiza S. Lim, with office address at the Capitol Area, Daro,
Dumaguete City, Negros Oriental, herein referred to as the SECOND PARTY;

WITNESSETH:

WHEREAS, the SECOND PARTY, as an active Organization, recognizes its vital

role in developing young Girls into socially conscious, morally educated, skill-tested,
environmentally aware and service-oriented citizens and future leaders of the country,
through various programs, projects and activities, in the local, regional and national
levels.

WHEREAS, the SECOND PARTY, in order to further enhance its basic

motivation and goals to provide innovative skill trainings to the Girls and Troop Leaders,
as well as create other viable programs and projects, needs support and assistance to
help augment its operational expenses especially at this time of pandemic.

WHEREAS , the FIRST PARTY, as part of its program of government,

endeavors to strengthen organizations as an avenue that will help redound for the
common good particularly the community and the entire Province of Negros Oriental
through partnership and collaboration.

WHEREAS, the SECOND PARTY, takes earnest concerted effort to support and
promote the flagship program of the Provincial Government of Negros Oriental, as it has
always been through the years, as its partner agency.

Now therefore, the Parties have agreed to an agreement as they hereby agree
that;

The FIRST PARTY, in its desire to extend assistance to augment its operational
expenses as additional source of funds, shall grant the amount of TWO HUNDRED
THOUSAND PESOS (₱ 200,000.00) to the SECOND PARTY to conduct trainings and
sustain its operations including all other programs and activities in the Organization.

The SECOND PARTY shall submit to the visitorial audit by the Commission on
Audit (COA) authorized to perform the audit under and approved office order;

The parties bind themselves to observe and comply with, in good faith, the
provision of this Memorandum of Agreement which shall be effective for the year 2022
