    COMPROMISE AGREEMENT

    KNOW ALL MEN BY THESE PRESENTS:

    This Compromise Agreement is entered by and between


    SAINT MICHAEL MULTI PURPOSE COOPERATIVE a
    cooperative duly organized and existing under the laws of the
    Republic of the Philippines with principal office at Maharlika
    Highway, Poblacion, Mahaplag , Leyte , represented by
    CHARLITO F. MONDRAGON herein referred as the FIRST
    PARTY ;
    -and-

    SUSAN CEBALLOS , Filipino , married , of legal age and a


    resident of Mahaplag , Leyte herein referred as the SECOND
    PARTY;

    WITNESSETH :

    WHEREAS, the FIRST PARTY is the private complainant in a


    Criminal Case No. VIII-02b- INV-24A-0004 pending before the
    Regional Trial Court Eight Judicial Region ,Branch 14, Baybay
    City,Leyte of Baybay City, Leyte;

    WHEREAS, the SECOND PARTY is the accused in the


    abovementioned case;

    WHEREAS, the SECOND PARTY proposed for an amicable


    settlement unto the FIRST PARTY, the FIRST PARTY through its
    Board of Directors acceded to the proposal , thus there was meeting
    of minds between the parties;

    WHEREAS, being part of the compromise agreement, the Parties


    agreed to the following :

    1. SECOND PARTY acknowledged that the property she has


    encroached is owned by the FIRST PARTY ;

    2. SECOND PARTY will respect the rights of the owner of the


    property , the FIRST PARTY - SAINT MICHAEL MULTI
    PURPOSE COOPERATIVE covered by Transfer Certificate of
    Title TP .-18998 designated as Lot No. 613-C and will refrain
    from harvesting or taking coconuts nor ask somebody to
    harvest or take any plants from the said area;
    3. SECOND PARTY having no right on the property where she
    planted her cacao plant is not claiming any reimbursement
    from the FIRST PARTY ;

    4. SECOND PARTY undertakes to pay the amount of Fifty


    Thousand Nine Hundred Pesos ( PhP 57,900.00) to indemnify
    the FIRST PARTY for the monetary expenses incurred to
    protect its interest;

    5. Upon payment of the SECOND PARTY to the FIRST PARTY


    of the agreed amount as mentioned above , the FIRST PARTY
    will discontinue and will not testify in the said case , to
    cause the dismissal of the same;

    6. That for this purpose, the FIRST PARTY absolved said


    SUSAN CEBALLOS and ROGELIO BERGADO from the
    charges against them from any civil or criminal liabilities
    whatsoever. Neither will any member from the FIRST
    PARTY testify in any proceedings of the case against them ;

    7. Upon dismissal of the said criminal case, the Accused on the


    same day , the case is dismissed , shall immediately move for
    the release of the bond.

    IN WITNESS WHEREOF, We affixed our signature this May 19,


    2024 , at Inopacan, Philippines.

    ACKNOWLEDGEMENT
    BEFORE ME, a Notary Public for and in the Municipality of
    Inopacan under the jurisdiction of RTC Hilongos , Leyte the parties
    personally appeared known to me and to me known to be the same
    persons who executed the foregoing instrument and acknowledged
    to me that the same is their free act and voluntary deed.
    This COMPROMISE AGREEMENT , consisting of three (3)
    pages, including the page on which this acknowledgment is written,
    has been signed on each and every page thereof by the concerned
    parties and their witnesses, and sealed with my notarial seal.
    WITNESS MY HAND AND SEAL on this May 19, 2024 at
    Inopacan, Leyte.
