MEMORANDUM OF AGREEMENT

Know All Men By This Presents:

This Memorandum of Agreement (MOA) is made and entered into by and between:

The Department of the Interior and Local Government -Regional Office VI, a government agency, created by virtue of Republic Act No. 6975 and

operating under existing laws, with office address at P. Aquino St., Fort San Pedro, Iloilo City, and represented herein by its Regional Director, Juan

Jovian E. Ingeniero, CESO IV, hereinafter referred to as “DILG-VI”;

and

The Provincial Board Members’ League of the Philippines-Western Visayas Chapter, with office address at the Iloilo Provincial Capitol, Bonifacio

Drive, Iloilo City, represented by its Regional Council Chairperson, Hon. Domingo B. Oso, hereinafter referred to as “PBMLP-VI”'';

WITNESSETH:

WHEREAS, On 01 June 2021, President Rodrigo Roa Duterte signed Executive Order
(EO) No. 138, s. 2021: Full Devolution of Certain Functions of the Executive Branch to
Local Governments, Creation of a Committee on Devolution, and for Other Purposes
that prescribes the processes and mechanisms towards full devolution for the effective
implementation of the Supreme Court Ruling on the Mandanas-Garcia Cases starting
FY 2022.
WHEREAS, Section 10 of the said EO enjoins all LGUs to formulate and prepare their
Devolution Transition Plans (DTPs) to guide the transition in their full assumption of the
roles and functions devolved to them through Section 17 of Republic Act (RA) No. 7160:
Local Government Code of 1991 and other pertinent laws passed thereafter;

WHEREAS , the DILG and the Department of Budget and Management (DBM), has issued a Joint
Memorandum Circular (JMC) which provides guidance in the preparation of LGU DTPs.
Complementing said policy guidelines, a series of multi-level activities have been undertaken
this year to better assist provinces, cities, municipalities, and barangays as they prepare
their respective DTPs;

WHEREAS, with the above-stated development, there is a need to complement the content for local legislation to ensure its relevance with the
demands of full devolution by mainstreaming various sectoral framework requirements with the; what is the next

WHEREAS, the Provincial Board Members’ League of the Philippines as one of the key bodies of local legislators deemed it necessary to prepare its

members to the roles and responsibilities that they need to undertake as partners of the executive in the implementation of the provisions of Executive

Order No. 138 on Full Devolution;

WHEREAS, in recognition of the strong partnership between the PBMLP-VI and the DILG-VI through their previous engagements, an activity entitled

“Enhancing the Legislative Towards Full Devolution” is designed to respond to this need.

NOW, THEREFORE, for and in consideration of the above premises, the parties agree, through their authorized officials, to enter into a Memorandum of

Agreement under the following terms and conditions:

I. Roles and Responsibilities

DILG Regional Office VI

a. Provide content for the training;

b. Attend pre-activity meetings;

c. Assist in the confirmation of attendance of the participants through DILG Field

Offices;

d. Prepare certificate of completion to be signed by both DILG and the PBMLP;and,

e. Prepare pre and post activity assessment forms.

Philippine Board Members’ League of the Philippines- Western Visayas Chapter

a.
Overall in-charge of the activity;

b. Attend pre-activity meetings;

c. Ensure attendance of the participants; and,

d. Submit post-activity report to the DILG.

It shall be the responsibility of both parties herein to prepare all necessary plans to guide the detailed activities of this undertaking, hold regular
consultation/ meetings to discuss the progress of the program as well as ensure the availability of its respective staff and personnel whenever required
during the conduct of project review and capacity building missions.
II. Effectivity and Validity

This Agreement shall take effect on the date of its signing without prejudice to revisions or modifications of any of the contracting parties, provided that

such revisions or modifications are consistent to the original purpose of the Agreement and shall remain in full force until the completion of the

implementation of the program.
