Approves The Technical Quality Regulations and


Conformity Assessment Requirements for
Components Automotive from Motorcycles,
Motorcycles, Mopeds, Tricycles and Quadricycles -
Consolidated.

The PRESIDENT OF THE NATIONAL INSTITUTE OF METROLOGY, QUALITY AND TECHNOLOGY -


INMETRO, in the exercise of the competence granted to him by Articles 4, § 2, of Law No. 5,966 of
December 11, 1973, and 3, items I and IV, of Law No. 9,933 of December 20, 1999, combined with the
provisions of Articles 18, annex V, from Annex I to Decree No. 6,275 of November 28, 2007, and 105,
item V, of the Annex to Ordinance No. 2 of January 4, 2017, of the then Ministry of Industry, Foreign
Trade and Services, considering what determines Decree No. 10,139 of November 28, 2019, and what is
contained in SEI Case No. 0052600.009724/2021-96, Solves:
Object and scope from application
Art. 1º The Consolidated Regulation for Automotive Components of Motorcycles, Motorcycles,
Mopeds, Tricycles and Quadricycles is approved, in the form of the Technical Quality Regulations, the
Conformity Assessment Requirements and the Specifications for the Conformity Identification Seal, set
out in Annexes I, II, III, IV, V and VI of this Ordinance.
Art. 2º TheTechnical Regulations of Quality, established in AnnexesI, II, IIIe IV, determine the
requirements, of mandatory compliance, related to the safety of the product.
Article 3 º Suppliers of automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles shall fully comply with the provisions of this Regulation.
Art. 4º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles, object of these Regulations, must be manufactured, imported, distributed and marketed,
so as not to offer risks that compromise the safety of the user, regardless of the full compliance with the
requirements published herein.
§ 1 This Regulation applies to the automotive components of motorcycles, motorcycles, mopeds,
tricycles and quadricycles intended exclusively for the aftermarket.
§ 2 - By aftermarket, the components marketed in the wholesale and retail trade are understood,
including authorized services and dealers of the brands of motorcycles, motorcycles, mopeds, tricycles
and quadricycles.
§ 3 - The automotive components of motorcycles, motorcycles, mopeds, mopeds, tricycles and
quadricycles are excluded from compliance with the provisions of these Regulations:
I - intended for assembly lines of motorcycles, motorcycles, mopeds, tricycles and quadricycles;

II - to be applied to vehicles due to recall;


III - applied exclusively to vehicles with discontinued production until December 31, 2008;
IV - intended exclusively for vehicles with a motorization with a volume greater than 450 cylinders;
V - intended exclusively for vehicles with a maximum power of more than 25 kW;
VI - intended exclusively for vehicles that have a minimum suggested public price of sale of R$
25,000.00;
VII - intended for the aftermarket, provided that they are imported as part of a assembled
assembly;
VIII - intended exclusively for bicycles, electric bicycles, machinery, implements and agricultural
equipment; and
IX - intended exclusively for minimotorcycles, racing motorcycles and motorcycles or the like which
are not intended to travel on public roads.
§ 4º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles of discontinued from January 1, 2009 to the date of March 24, 2014, and manufactured or
imported before March 24, 2019, may be sold until the end of their inventories.
§ 5º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles intended for vehicles of low import and production volumes, special vehicles, collection
vehicles or special application must comply with the specific regulations of the inmetro ordinance in
force for low volume automotive components.
Art. 5º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles may only be marketed in the country with the presence of one of the following phrases, in
their packaging and technical catalogs, electronic media or physical medium, at points of sale, clearly
and indelible, accessible to the consumer, with a minimum source size of 2 mm, for the purpose of
referencing its exclusion from the scope of this regulation:
I – "This component is intended for the assembly lines of motorcycles, motorcycles, mopeds,
tricycles and quadricycles.";
II – "This component is intended for motorcycles, motorcycles, mopeds, tricycles and quadricycles
due to recall.";
III – "This component is applied exclusively to the motorcycle(s) model(s)) include the Names Of
templates discontinued until December 31, 2008.";
IV - "This component is applied exclusively to the model(s) model(s) include the Names Of
templates discontinued until December 31, 2008.";
V - "This component is applied exclusively to the moped(s) model(s) include the Names Of
templates discontinued until December 31, 2008.";
VI - "This component is applied exclusively to the model(s) model(s) include the Names Of
templates discontinued until December 31, 2008.";
VII – "This component is applied exclusively in the model(s) model(s) include the Names Of
templates discontinued until December 31, 2008."
VIII – "This component is applied exclusively to motorcycles, motorcycles, mopeds, tricycles and
quadricycles that have motorization with a volume greater than 450 cylinders.";

IX – "This component is applied exclusively to motorcycles, motorcycles, mopeds, tricycles and


quadricycles with a maximum power exceeding 25 kW.";
X – "This component is applied exclusively on motorcycles, motorcycles, mopeds, tricycles and
quadricycles that have a minimum suggested public price of sale of R$25,000.00.";
XI – "The component(s) include the name(s) of the component(s) applied exclusively on
motorcycles, motorcycles, mopeds, tricycles and quadricycles are imported and are part of a assembled
assembly, and commercialization is not permitted separately.";
XII – "This component is applied exclusively to bicycles.";
XIII – "This component is applied exclusively to electric bicycles.";
XIV – "This component is applied exclusively in machinery, implements and agricultural
equipment.";
XV – "This component is not subject to compulsory certification, as determined by Article 5 of
Ordinance Inmetro No. xxx/202X.[mention to the Concierge now Approved]
Art. 6 º The production chain of automotive components of motorcycles, motorcycles, mopeds,
tricycles and quadricycles is subject to the following obligations and responsibilities:
I – the national manufacturer shall manufacture and make available, free of charge or for
consideration, automotive components of motorcycles, motorcycles, mopeds, tricycles and quadricycles
in accordance with the provisions of these Regulations;
II – the importer shall import and make available, free of charge or for consideration, automotive
components of motorcycles, motorcycles, mopeds, tricycles and quadricycles in accordance with the
provisions of these Regulations;
III – the other entities in the production chain and supply of automotive components of
motorcycles, Mopeds Mopeds Tricycles and Quads including or
trade in physical or virtual establishments, must maintain the integrity of the
product, of its mandatory markings, preserving compliance with the requirements of these Regulations.
Single paragraph. If a person has more than one function in the production and supply chain,
among those listed above, their responsibilities are accumulated.
Requirements Pre-Market
Art. 7º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles, manufactured, imported, distributed and marketed in national territory, free of charge or
for consideration, must be compulsorily submitted to conformity assessment, through the certification
mechanism, subject to the terms of these Regulations.
§ 1 - The Conformity Assessment Requirements for Automotive Components of Motorcycles,
Motorcycles, Mopeds, Tricycles and Quadricycles are set out in Annex V of this Ordinance.
§ 2 - Certification does not exclude the supplier from exclusive responsibility for the safety of the
product.
Art. 8º After certification, the automotive components of motorcycles, motorcycles, mopeds,
tricycles and quadricycles, imported, distributed and marketed in national territory, free of charge or
costly, must be registered in Inmetro, considering Inmetro Ordinance No. 258, of August 6, 2020, or
substitute.
§ 1 - Obtaining the registration is conditional on the authorization of the use of the Conformity
Identification Seal on certified products and for its availability in the national market.

§ 2 - The model of Conformity Identification Seal applicable for automotive components of


motorcycles, motorcycles, mopeds, tricycles and quadricycles, is found in Annex VIof thisOrdinance.
Art. 9º The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles, covered by the Regulation herein approved, are subject to the non-automatic import
licensing regime, and the importer must obtain approval from Inmetro, considering Inmetro Ordinance
No. 18, of January 14, 2016, or substitute.

Vigilance from Market

Art. 10. The automotive components of motorcycles, motorcycles, mopeds, tricycles and
quadricycles, objects of these Regulations, are subject, throughout the national territory, to market
surveillance actions carried out by Inmetro and public law entities linked to it by delegation agreement.

Art. 11. It constitutes an infringement of the action or omission contrary to the provisions of this
Ordinance, and may result in the penalties provided for in Law No. 9,933 of 1999.
Art. 12. The supplier, when subjected to market surveillance actions, must provide Inmetro, when
requested, with the information required within a maximum period of 15 days.
Deadlines and provisions Transitional
Art. 13. Suppliers of automotive components of motorcycles, motorcycles, mopeds, tricycles and
automotive quadricycles will have up to 12 (twelve) months from the effective date of this Ordinance, to
update the requirement of item XVII of Art. 5.
Art. 14. The publication of this Ordinance does not imply the need for a new certification process
to be initiated based on the requirements now consolidated.
Single paragraph. Certificates already issued should be reviewed, for reference to the Ordinance
published herein, in the next evaluation stage.

Art. 15. The following are revoked on the effective date of this Ordinance:
I – Ordinance Inmetro No. 50, of January 28, 2014, published in the Official Gazette of January 30,
2014, section 1, page 113;
II – Ordinance Inmetro No. 123, of March 19, 2014, published in the Official Gazette of March 24,
2014, section 1, pages 94 to 95;
III – Articles 3, 4, 7, 8, 10, 11, 12 and 15, of Inmetro Ordinance No. 248, of June 3, 2016, published

1. GOAL
This Technical Quality Regulation establishes the mandatory requirements for transmission current, to
be met by the entire supply chain of the product in the national market.

2. ACRONYMS
For the purposes of this RTQ, the acronyms contained in the document referred to in item 3 are
adopted, complemented by the following.

5. REQUIREMENTS TECHNICAL
5.1 The transmission currents must have the dimensions provided for in Table 1 of this RTQ.
5.2 Transmission currents must be accurate in length when measured in accordance with ABNT NBR
16427:2016.
5.3 Transmission chains must be constructed with materials that offer mechanical resistance.
5.4 The transmission chains must be wrapped in protective oil, or grease, or similar product that
exercises this function in its packaging.

the hub and fixing holes, according to ABNT NBR 16427:2016.
5.2 Crowns must be constructed with materials that offer resistance to mechanical wear.
5.3 Crowns must have surface-adherent coating that offers corrosion resistance.

ATTACHMENT IV - REGULATION TECHNICIAN OF QUALITY


TOWARDS EXHAUST FROM MOTORCYCLES MOPEDS MOPEDS
TRICYCLES And QUADS

1. GOAL
This Technical Quality Regulation establishes the mandatory requirements for leakage, to be met by the
entire supply chain of the product in the national market.

2. ACRONYMS
For the purposes of this RTQ, the acronyms contained in the document referred to in item 3 are
adopted, complemented by the following.

3. DOCUMENTS
There are no additional documents for this RTQ.

4. DEFINITIONS
For the purposes of this RTQ, the following
definition is adopted. 4.1 Exhaust
Metal pipe used for the conduction of gases from the combustion of the engine to the atmosphere.

5. REQUIREMENTS TECHNICAL
5.1 The exhausts must have their watertightness guaranteed, and the dimensions of the fixing system
and the finishing conditions (burrs, live corners, holes or cracks) cannot allow the leakage of gases.
5.2 Exhausts may not cause burns to the user, when in accidental touches, under normal conditions of
use of the vehicle with the use of appropriate clothing and accessories. To this end, the exhaust must
have mechanical protection in regions where accidental touches are possible under normal conditions of
use of the vehicle.
5.3 Exhausts must be constructed with materials that offer corrosion resistance.

ATTACHMENT V – REQUIREMENTS FROM EVALUATION OF COMPLIANCE


TOWARDS COMPONENTS AUTOMOTIVE FROM MOTORCYCLES MOPEDS MOPEDS
TRICYCLES And QUADS

1. GOAL
Establish the criteria and procedures for conformity assessment for automotive components of
motorcycles, motorcycles, mopeds, tricycles and quadricycles, focusing on safety, through the
certification mechanism, aiming at the prevention of accidents in its use.
Note: For simplification purposes, the term "automotive components of motorcycles, motorcycles,
mopeds, tricycles and quadricycles" is referred to in this RAC as "automotive components".
1.1 Grouping towards effects from certification
1.1.1 For certification of the object of this RAC, the concept of family applies.
1.1.2 The criteria for family formation of each automotive component are defined in the Specific
Annexes of this RAC.

2. ACRONYMS
For the purposes of this RAC, the acronyms contained in the documents mentioned in item 3 are
adopted.

3. DOCUMENTS
For the purposes of this RAC, the following documents and those listed in the RGCP are adopted.

4. DEFINITIONS
The settings contained in the documents listed in item 3 and in the Specific Annexes of this RAC are
applied.

5. MECHANISM FROM ASSESSMENT OF COMPLIANCE


The compliance assessment mechanism for Automotive Motorcycle Components is certification.

6. STEPS OF ASSESSMENT OF COMPLIANCE


This RAC establishes 2(two) distinct certification models, and it is up to the supplier to opt for one of
them:
a) Certification Model 5 - Initial evaluation consisting of tests on samples taken from the manufacturer
including audit of the Quality Management System - QMS, followed by periodic maintenance evaluation
through sample collection of the product in trade, to carry out the activities of conformity assessment,
and audit of the QMS.

b) Certification Model 1b - Batch test. 6.1

6.1.1 Evaluation Initial
6.1.1.1 Request from Certification
The vendor must forward a formal request to the OCP, providing the documentation described in the
RGCP.
6.1.1.2 Analysis Of Request and Of Compliance Of Documentation
The criteria for analyzing the request and complying with the documentation must follow the
requirements set forth in the RGCP and the Specific Annexes cited in this RAC.
6.1.1.3 Audit Initial of the System from Management
The initial audit criteria of the management system must follow the requirements set out in the RGCP.
6.1.1.4 Plan from Tests Initial
The criteria for defining the initial plans must follow the conditions defined in the RGCP. The initial test
plan shall be drawn up by family and shall include the sampling specified in the Specific Annex of each
Automotive Component.
6.1.1.4.1 Definition Of Tests the Be Performed
Compliance with all requirements set out in the RTQ. The tests are those established in the Specific
Annex of each Automotive Component.
6.1.1.4.2 Definition Of Sampling
6.1.1.4.2.1The definition of sampling and acceptance and rejection criteria must follow the general
conditions defined in the RGCP. The specific criteria are described in the Specific Annex of each
Automotive Component.
6.1.1.4.2.2 The samples indicated in each Specific Annex shall correspond to the test samples. Equal
quantities for the evidence sample shall be collected for the evidence and witness samples.
6.1.1.4.2.3 If the evidence sample is disapproved, the disapproved test must be repeated in the
evidence and witness samples, both of which must meet the requirements set out in the Specific Annex
to the Automotive Component.
6.1.1.4.3 Definition of the Laboratory
The criteria for laboratory definition must follow the requirements set out in the RGCP.
6.1.1.5Treatment from No Conformities in Stage from Evaluation Initial
The criteria for handling non-conformities in the initial evaluation stage must follow the requirements
set out in the RGCP.
6.1.1.6Issue of the Certificate from Compliance
6.1.1.6.1 The criteria for issuing the Certificate of Conformity must follow the requirements set out in
the RGCP. The Certificate of Conformity must be valid for 4 (four) years.
6.1.1.6.2 In the certificate of conformity, the family model(s) should be noted as provided in the Specific
Annex of each Automotive Component.

After the certificate of conformity is granted, the monitoring of the Certification is carried out by the
OCP to verify that the technical-organizational conditions that gave rise to the initial grant of the
certification continue to be fulfilled.
