SK RESOLUTION NO. 01-2023

A RESOLUTION PROVIDING AND APPROVING THE NEW INTERNAL RULES AND


PROCEDURES OF THE SANGGUNIANG KABATAAN OF DAKILA.

WHEREAS, the members of the Sangguniang Kabataan of Dakila


elected during the October 30, 2023 synchronized Barangay and
Sangguniang Kabataan Elections formally assumed office on
November 20, 2023;

WHEREAS, pursuant to Section 08 of the Revised Rules and


Regulations Implementing Republic Act (RA) No. 10742, Otherwise
Known As The “Sangguniang Kabataan Reform Act of 2015,” As
Amended by RA No. 11768, within sixty (60) days from their
assumption of office, the SK shall Formulate and approve its
Internal Rules of Procedures (IRP) which shall govern the
organization and operation of the SK which shall include, among
others, the creation of committees, the date, time, and place of
SK monthly regular or special meeting, order and calendar of
business for each meeting, the legislative process, parliamentary
procedures which include the conduct of members during sessions,
and discipline of members for disorderly behavior and absences
without justifiable cause;

WHEREAS, there is a necessity to enact an Internal Rules and


Procedure to ensure the orderly and efficiently manner of the SK
Council;

NOW, THEREFORE, on motion of HON. JOHN ANGELO SUPETRAN duly


seconded by all the members of the Sangguniang Kabataan of
Dakila;

BE IT RESOLVED, as it is hereby resolved, to approve and adopt


the Internal Rules and Procedures of the Sangguniang Kabataan of
Dakila (2023-2025), to wit:

RULE I
TITLE, PURPOSE AND SCOPE

Section 1. – These rules shall be known as the Internal Rules and


Procedures of the Sangguniang Kabataan of Dakila1 for the year
2023-2025.

Section 2. – These rules are promulgated in accordance with the


Local government Code of 1991 and the RA 10742 or also known as
the “SK Reform Act of 2015” as amended by RA 11768 to serve as
guidelines for the members of the Sangguniang Kabataan of Dakila
in the discharge of their official functions, provided however
that in case of strict adherence to the letter of this law shall
result in manifest injustice, abuse of authority or in absurdity,
a relaxation of the rules may be adopted in such instance only,
upon majority of votes of all members present.

RULE II
MEMBERS

Section 3. – The Sangguniang Kabataan of Dakila, which shall


hereinafter be referred to as the “SK”, “SK Council” or “SK Body”
shall be composed of the SK Chairperson as the Presiding Officer,
the SK Councilors as the regular members, and the SK Secretary
and SK Treasurer as the appointive members of the Sangguniang
Kabataan of Dakila.

Section 4. – The regular members of the SK Council shall assume


office on the day and in the manner provided for by law and shall
hold the same until their successors shall have been duly chosen
and qualified.

In the case of the appointive SK Members of the SK Council, their


term will commenced after the SK Council passed a resolution for
the appointment of such, received the appointment letter from the
SK Chairperson, and after taking the oath in front of the Punong
Barangay.

RULE III
THE PRESIDING OFFICER

Section 5. – The SK Chairperson is the Presiding Officer of the


SK Council of Dakila. His duties are as follows:

(a) Call and preside over all meetings of the SK and


assemblies of the KK, and vote in case of a tie,
except when one (1) of the agenda to be discussed in
such assembly involves disciplinary action against the
SK Chairperson, in which case, the highest-ranking SK
Member shall preside.

The highest-ranking SK member shall mean the council


member who obtained the highest number of votes during
the SK elections, as reflected in the Certificate of
Canvass and Proclamation of the COMELEC;

(b) Take the lead in the formulation of the CBYDP and the
preparation and implementation of the ABYIP:

(c) Ensure the implementation of policies, programs, and


projects as contained in the ABYIP, in coordination
with the Sangguniang Barangay and the CYDC;

(d) Sign all required documents and warrants/checks drawn


from the SK funds for all expenditures, including
financial reports and other related documents in the
implementation of the CBYDP and ABYIP and other
related programs, projects, and activities;

(e) Exercise general supervision over the affairs and


activities of the SK and the KK as well as the
official conduct of its members;

(f) With the concurrence of the majority of all the SK


members, appoint from among the members of the KK a
secretary and a treasurer;

(g) Coordinate with the Sangguniang Barangay and other


youth organizations within her/his barangay on youth-
related programs and projects that they wish to
initiate and implement; and

(h) Exercise such other powers and perform such other


duties and functions as may be prescribed by law or
ordinance.

RULE IV
THE SANGGUNIANG KABATAAN MEMBERS

Section 6. – The Sangguniang Kabataan Members herein refer to the


7 elected SK Councilors of the Sangguniang Kabataan. Thus, every
SK Council Members are herey required performing the following:

(a) In consultation and with the concurrence of the KK and


within three (3) months from assumption to office, formulate
a three (3)-year rolling plan, which shall be known as the
Comprehensive Barangay Youth Development Plan (CBYDP), which

shall serve as a basis in the preparation of the Annual


Barangay Youth Investment Program (ABYIP). This plan shall
be aligned with the Philippine Youth Development Plan (PYDP)
and other Local Youth Development Plans (LYDPs) in every
level, municipal, city and provincial as is relevant.

(b) Approve the annual budget which is the annual slice of the
ABYIP before the start of the succeeding fiscal year. For
purposes of the annual budget, the SK shall consider the
three-year CBYDP which can be sliced into three ABYIPs. If
the SK funds allow, a supplemental budget shall be approved.
Any changes in the annual budget shall be in accordance with
existing applicable budget, rules and procedures.

(c) Promulgate resolutions necessary to carry out the


objectives of the youth in the barangay in accordance with
the CBYDP and the applicable provisions of this IRR. Such
resolutions are classified but not limited to:

(i) Resolution of Approval/ Concurrence


(ii) Resolution of Adoption
(iii) Resolution of Authority
(iv) Resolution of Ratification
(v) Resolution of Request,
(vi) Resolution of Action
(vii) Resolution of Congratulations,
(viii) Resolution of Recognition or Appreciation,
(ix) Resolution of Sympathy
(x) Resolution of Gratitude

(d) Hold fund-raising activities that are in line with the


CBYDP, the proceeds of which shall be tax-exempt and shall
accrue to the general fund of the SK: Provided, however,
that in the appropriation thereof, the specific purpose for
which such activity has been held shall be first satisfied:
Provided, further, that any appropriations thereof shall be
in accordance with existing applicable budget, accounting
and auditing rules and regulations;

(e) Conduct youth profiling, establish, maintain and update a


database of youth in the barangay and ensure submission to
City Youth Development Office, and proper turn-over to the
next set of SK officials.

(f) Assist in the establishment and registration of youth


organizations and youth serving organizations in the
barangay, in accordance with the guidelines of the
Commission;
(g) Adopt and implement a policy on full public disclosure of
all its transactions and documents involving public
interest. The rules and procedures to be followed in the

implementation of the policy on full public disclosure shall


be promulgated by the DILG;

(h) Exercise such other powers and perform such other functions
as may be prescribed by law or ordinance, or delegated by
the SK Chairperson, Sangguniang Barangay, Sangguniang
Panlungsod or DILG.

RULE V
SECRETARY TO THE SK COUNCIL

Section 7. – The Secretary to the SK Council shall be under the


control and supervision of the Sangguniang Kabataan of Dakila and
under the administrative supervision of the SK Chairperson. He
also shall:

(a) Keep and, in coordination with the other SK members,


prepare and update all the records of the KK, including the
list of its qualified and registered members, youth
policies, profile, database studies, research and registry
of youth, and youth-serving organizations in the barangay,
if any, and ensure submission to the Commission and proper
turn-over to the next set of SK officials;

(b) Prepare and keep the minutes of all meetings of the


SK, reflecting the attendance of all SK Officials, including
all the assemblies of the KK;

(c) Cause the posting, on the barangay bulletin board and


at least three (3) conspicuous places within the
jurisdiction of the barangay, and if possible, including the
use of traditional and/or non-traditional media, and make
these available for any person with legal purpose, of the
following:

i. all resolutions approved by the SK;


ii. the annual and end-of-term reports of the
programs and projects implemented by the SK;
iii. the Comprehensive Barangay Youth Development Plan
(CBYDP); and
iv. Annual Barangay Youth Investment Plan (ABYIP).

These shall be disseminated to the concerned offices,


institutions, and individuals; and

(d) Perform such other duties and discharge such other


functions as the SK chairperson may prescribe or direct.

RULE VI
TREASURER TO THE SK COUNCIL

Section 8. – The Treasurer to the SK Council shall be under the


control and supervision of the Sangguniang Kabataan of Dakila and
under the administrative supervision of the SK Chairperson. He
also shall:

(a) Take custody of all SK properties and funds and ensure


proper turnover to the next SK treasurer;

(b) Collect and receive contributions, monies, materials,


and all other resources intended for the SK and the KK, and
issue the corresponding official receipts thereto;

(c) Serve as cosignatory in all withdrawals from the SK


funds and disburse funds in accordance with the approved
annual budget and supplemental budget, as the case may be,
of the SK;

(d) Certify the availability of the SK funds whenever


necessary;

(e) Submit to the SK and the Sangguniang Barangay, certified


and detailed statements of actual income and expenditures at
the end of every quarter and the posting of the same on the
barangay bulletin board and at least three (3) conspicuous
places within the jurisdiction of the barangay, and if
possible, including the use of traditional and non-traditional
media;

(f) Render a written financial report of all SK funds and


property under her/his custody and
shall be made available to the KK members during the regular
KK assembly; and

(g) Perform such other duties and discharge such other


functions as the SK chairperson
may prescribe or direct.

RULE VII
THE SK COUNCIL SESSION

Section 9. – The Regular Session – The Regular Session of the SK


Council of Dakila shall be held every 1st and 3rd Sunday of the
Month at exactly 5:00PM, in the afternoon to be held at the
Pamahalaang Barangay of Dakila or at such place within the
barangay as may be decided upon in the immediately preceding
session. Thus, in case of calamities or any health emergencies
that would hinder the SK council to commence their regular
sessions in person, an online meeting shall be permitted.
Moreover, if a holiday falls on a Saturday, or if there is a
necessary and official business intended for the SK Council, the
regular session shall be held on the following business day or in
any other day as approved by the majority of all the members

present. In addition, before to start the session, SK council is


required to place their cellphone in respective place to avoid
distraction.

Section 10. – The Special Session – As often necessary, when


public interest so demands, special sessions may be called by the
SK Chairperson or a Majority of the regular members of the SK
Council.

Section 11. – Call to Order – The presiding officer shall open


the session by calling the SK Council to order. In every session,
such shall be opened by prayer or mediation and shall be followed
by the singing of National Anthem.

Section 12. – Attendance of the Regular Members – Every regular


member shall be present during the session of the SK Council
unless expressly excused or necessarily prevented from attending
so on reasonable and legal grounds, provided that notice in case
of the latter shall be sent to the SK council through the SK
chairperson or Secretary.

The SK Secretary shall circulate an attendance sheet during the


plenary, and he shall assure that the regular members signed such
form. This has been made to certify the attendance of the regular
members and for future references.

In case a member of the SK Council arrives during the Item III of


the deliberations of the agenda of the SK Council, he shall be
considered as late.

Amassed numbers of absences and tardiness of the regular members


of SK Council in sessions, including those appointive members,
not due to official business and health reasons, shall be posted
and might be a subject for the following disciplinary actions:

(a) Suspension and removal from office of the SK


Chairperson if the latter commits:
(1) Absence from the regular SK meetings without
valid cause for two (2) consecutive meetings or
accumulated absences of four (4) days within a
period of twelve (12) months. Valid cause includes,
but is not limited to, illness as certified by a
public health officer; natural or human-induced
disaster; and attendance to trainings, seminars, and
workshops related to her/his duties and functions as
an SK official.

(2) Failure of the SK Chairperson to convene the


regular assembly of the KK for two (2) consecutive
times;
(3) Failure to convene the regular SK meetings for
three (3) consecutive months in the case of the SK
Chairperson;

(4) Failure to formulate the CBYDP and the ABYIP, or


approve the annual budget within the prescribed
period of time without justifiable reason;

(5) Failure to implement programs and projects


outlined in the ABYIP without justifiable reason, as
evaluated by the C/MYDC;

(6) Four (4) consecutive absences during the regular


sangguniang Barangay sessions without valid cause in
the case of the SK Chairperson;

(7) Conviction by final judgment of a crime involving


moral turpitude; and violation of existing laws
against graft and corruption and other civil service
laws, rules, and regulations; and

(8) Failure in the discharge of his/her duty or has


committed an abuse of authority

Any elected official of the SK may, after due process,


be suspended, for not more than six (6) months or
removed from office by a majority vote of all members
of the Sangguniang Panlungsod which has jurisdiction
over the barangay of the concerned SK officiall which
shall be final and executory.

(b) Suspension, removal and other disciplinary action for


the SK Councilors or any Appointive Members if the latter
commits:
(1) Absence from the regular SK meetings and KK
Meetings without valid cause for three (3)
consecutive meetings or accumulated absences of four
(4) days within a period of twelve (12) months may
constitute Suspension from office after the
deliberation has been made the SK Council and after
the recommendation and resolution made by the
Sangguniang Barangay and Sangguniang Panlungsod or
DILG.

(2) Removal from office may constitute if the SK


Councilor or any Appointive Members has been absent
from the regular SK meetings and KK Meetings without
valid cause for Four (4) consecutive meetings or
accumulated absences of six (6) days within a period
of twelve (12) months after the deliberations of the
SK Council and recommendations and resolutions made
by the Sangguniang Barangay and Sangguniang
Panlungsod or DILG.
(3) There shall be an Honorarium deductions for every
absent amounting 300 pesos of SK Members and
Appointive Members without legal or justifiable

reason. In addition if the SK members is late up to


15 minutes, there shall be an honorarium deductions
amounting 100 pesos without legal or justifiable
reason.

Section 13. – Open to the Public – SK Council Sessions or


Meetings of any Committee thereof shall be open to the public and
all proceedings related thereto shall be captured on video and
audio for transmission via streaming on the internet and via
airwaves or cable, unless a closed session is decided or ordered
by an affirmative vote of a majority of the members present,
there being a quorum, for the public interest or for reasons of
security, decency or morality, or for reasons affecting the
dignity of the Council or any of its members or when confidential
matters are being considered.

On a motion to hold a closed session duly approved, the Presiding


Officer or the Committee Chairman shall direct the session hall
be cleared and doors closed. Only the Secretary and such other
persons, especially authorized by the Council/Committee shall be
admitted in the closed session. They shall preserve the secrecy
of whatever maybe read or said at the session or meeting.

Section 14. – Suspension and Adjournment of Session – Session of


the SK Council shall not be suspended or adjourned except by the
direction of the Majority of the Regular Members of the SK
Council, but the Presiding Officer may, in his discretion,
declare a recess of short intervals.

Section 15. – Smoking or any form thereof shall be strictly


prohibited inside the session hall and within the premises of the
Pamahalaang Barangay ng Dakila. No member of the SK Council shall
be allowed to participate in any Session or Committee
Meetings/Hearings if he is drunk or under the influence of liquor
or illegal drugs.

Section 16. – Approved SK Resolutions – Each approved SK


Resolutions shall bear the name(s) of the author and/or sponsor
and shall be sealed with the seal of the Council and recorded in
a book kept for the purpose and shall, on the day following its
approval, be posted by the SK Secretary at the Pamahalaang
Barangay of Dakila and in at least two other conspicuous places
within the jurisdiction of the Barangay.

Section 17. – Opening and adjournment to be entered in the


Journal – The exact hour of opening and adjournment of regular
session or meetings shall be entered in the journal.

RULE VIII
QUORUM AND ROLL CALL

Section 18. – Quorum – A majority of all members of the SK


Council who have been elected and qualified (suspended members
and those on official leave shall not be counted in computing the
number of all the members) shall constitute a quorum to transact
official business. The quorum shall be determined on the basis of
actual presence and a majority shall be determined on the basis
of actual presence and for this purpose, the Majority of all of
the members of this SK Council is five (5). However, if there is
an SK Member who is suspend or on official leave, the quorum
shall be determined based on the actual members present.

Section 19. – Absence of Quorum – where there is no quorum, the


Presiding Officer may declares a recess until such time as a
quorum is constituted, or a majority of those present may adjourn
from time to time and/or compel the immediate attendance of any
member absent without justifiable cause by designating a member
of the SK Council, to be assisted by a Barangay Police, to
apprehend the absent member and present him at the session hall.

Section 20. – Roll Call – The calling of the roll is mandatory


and shall be done twice during session – after the rendition of
the National Anthem and before the session or meeting adjourned.

Upon the roll call of the SK Council, the names of the members
shall be called in accordance to the order of placement they
obtained during the last elections.

Section 21. – Question of Quorum – Should be a question of quorum


is raised during a session, the Presiding Officer, without
debate, shall immediately proceed to call the roll of the members
and thereafter announce the results.

RULE IX
SK COMITTEES

Section 22. The SK Committee – A committee constitutes five (5)


persons from the regular members of the SK Council whether to be
appointed, designated or elected as Chairman, Vice-Chairman and
as Members by the SK Council to consider, investigate, recommend
or take appropriate action on matters or subjects referred to it;
a committee shall be composed of a Chairman, Vice-Chairman, and
three (3) Members from the regular SK Members as may be
determined by the SK Council.

The SK Chairperson or the Presiding Officer can no longer be a


member of any SK Committees, but he shall assure the appointment
of the members of such in orderly, just and democratic processes,
and including the overseeing the general administration of such.

Section 23. – Committee Procedure – The committee shall function


as follows:

(a) The Committee Chair shall from time to time convene the
committee to a meeting or hearing, provided, however, that
if the Chairman is absent or shall neglect or decline to
convene such meeting, the Vice-Chairman or Members
constituting a Majority shall proceed therewith.
For this purpose, the Committee Chairperson shall act as the
presiding officer and can only cast his vote to resolved
certain matters in any case that there will be a tie.

Any person shall have the right to listen and appear to the
Committee Hearing or Meeting and present his view on the
matter before it at such reasonable time and upon request,
as the committee may schedule.

(b) During final deliberations, no person shall be present


except the committee members and other necessary invited
guests.

(c) All questions before the committee shall be put into a


vote unless otherwise previously agreed upon.

(d) After final deliberations and voting, the Chairman of


the Committee shall prepare, for submission to the SK
Council, a report to be signed by its Chairman and Members
recommending either to file it in the archived or to
calendar the measure for second reading presenting all
amendments tackled during the hearings. Any member
dissenting therefrom shall submit in writing his reasons,
provided, however, that if by reason of urgency, a verbal
report is submitted by a Chairman to the SK Council, such
verbal report shall be considered the report of the
committee unless objected to by at least 3 members of the
Committee.

Section 24. – Creation of Standing Committees – The SK Council


shall create standing committees each composed of Chairman, Vice-
Chairman and three (3) members. The standing committee may from
time to time be re-organized by a two-thirds (2/3) vote of all
regular members of the SK Council.

Section 25. – Creation of Special Committees – The SK Council may


opt to organized special committees as it may deem necessary. The
officers and members of special committee committees shall
likewise be elected by the majority of all members present. The
special committees shall cease as soon as the body shall have
received their reports unless new assignments are given to them.
They shall be subjected to the same rules governing standing
committees. The committees and assigned SK Councilor are as
follows:

a) Committee on Education and Culture- HON. JOEVETH BANAWA

e) Committee on Anti- Drugs and Social Protection- HON. DANICA
MANALAD
f) Committee on Sports- HON. SHELALIN TRINIDAD
g) Committee On Gender and Development- HON. JOHN GABRIEL TAMAYO

Section 26 – The Standing Committees – The Standing Committees


and their functions are as follows:

(a) Committee on Education – Matters related to the


educational concerns of the Katipunan ng Kabataan in the
Barangay, including but not limited to: 1.) Development of
policies or resolutions addressing the educational needs of
the youth in the community, 2.) Advocate for the improvement
of educational facilities, access to quality education, and
other relevant issues affecting the youth, 3.) Work closely
with local schools and educational institutions to
understand the needs of students and ensure that the SK is
aware of and involved in educational initiatives, 4.)
Responsible for proposing and implementing programs that
contribute to the educational and personal development of
youth within the community, 5.) Disseminate information
related to educational opportunities, scholarships, and
other relevant matters, 6.) And other significant work and
activities to empower the in-school youth and to lessen the
number of Out of School Youth in the Barangay.

(b) Committee on Health and Sanitation – Matters related to


addressing youth-related health issues and promoting the
well-being of young people within the community, including
but not limited to: 1.) Providing information and education
to youth on various health topics, including reproductive
health, nutrition, hygiene, and the prevention of diseases,
2.) Creating programs regarding health programs and
initiatives that benefit the youth such as vaccination
campaigns, awareness programs, and health promotion
activities, 3.) Work closely with local health agencies,
clinics, and medical professionals to address the specific

to the said committee.

(c) Committee on Environment and Disaster Preparedness –


Matters related to the environment, natural disasters, and

as tree planting activities, clean-up drives, and other
initiatives aimed at preserving and protecting the local
environment, 3.) Working on disaster preparedness
initiatives to ensure that the youth are informed and
prepared for various natural disasters that may affect the
community, 4.) Coordinating with local government units and
relevant agencies to implement environmental conservation
programs and disaster risk reduction measures, 5.)
Conducting programs and activities to build community
resilience in the face of natural disasters, including
training sessions, workshops, and information campaigns, 6.)
Implementing or supporting initiatives related to proper
waste disposal and recycling to promote a clean and
sustainable environment, 7.) And other significant work,
activities, projects and programs related to the said
committee.

(d) Committee on Youth Employment and Livelihood – Matters


related to youth employment, livelihood opportunities, and
economic empowerment within the community, including but not
limited to: 1.) Facilitating programs or initiatives that
connect young people with employment opportunities,
including job fairs, skills training, and networking events,
2.) Developing and promoting livelihood programs that
empower youth to create their own sources of income, such as
small businesses, cooperatives, or entrepreneurial ventures,
3.) Organizing training sessions or workshops to enhance the
skills of young people, making them more competitive in the
job market or better equipped to start their own businesses,
4.) Collaborating with local businesses, non-governmental
organizations (NGOs), and other stakeholders to create
synergies that support youth employment and
entrepreneurship, 5.) And other significant work,
activities, projects and programs related to the said
committee.

(e) Committee on Peace and Order and Anti-Drugs Abuse -


Matters related to maintaining peace and order within the
community, as well as implementing programs aimed at
preventing and addressing drug abuse among the youth,
including but not limited to: 1.) Ensure the safety and
security of the community by collaborating with local law
enforcement agencies and promoting initiatives that
contribute to a peaceful environment, 2.) Implementing
programs and campaigns to raise awareness about the dangers
of drug abuse and addiction among the youth, and promoting a
drug-free lifestyle, 3.) Community involvement in
maintaining peace and order, which may include organizing

drug addiction, including access to rehabilitation services,
6.)Providing local policies and initiatives that address
issues related to peace and order, crime prevention, and
anti-drug efforts, 7.) And other significant work,
activities, projects and programs related to the said
committee.

(f) Committee on Gender and Development – Matters related


to gender equality, women's rights, and promoting the
development of all genders within the community, including
but not limited to: 1.) Developing and implementing programs
that promote gender sensitivity and awareness among youth
members, ensuring that they understand and respect diverse
gender perspectives, 2.) Creation of policies and
initiatives that promote gender equality and protect the
rights of all youth, regardless of gender identity or
expression, 3.) Providing programs and projects that empower
young women, including skills development, leadership
training, and educational opportunities, 4.) Working to
prevent and address gender-based violence by promoting
awareness and education on the importance of respectful and
healthy relationships, 5.) Ensuring that the SK Council is
inclusive and supportive of LGBTQ+ youth by implementing
initiatives that address their unique challenges and
concerns, 6.) Conducting training sessions for SK members
and the community on gender mainstreaming, which involves
integrating gender perspectives into policies, programs, and
activities, 7.) And other significant work, activities,
projects and programs related to the said committee.

(g) Committee on Sports Development and Empowerment –


Matters related to promoting sports, physical fitness, and
recreational activities among the youth in the community,
including but not limited to: 1.) Organizing and supporting
sports programs and events that encourage youth
participation in various sports and physical activities, 2.)
Providing development of young athletes by providing
training opportunities, coaching, and access to sports
facilities, 3.) Facilitating intramural sports competitions
and tournaments within the community to foster camaraderie
and healthy competition among youth members, 4.) providing
accessible and well-maintained sports facilities for youth
to engage in physical activities, 5.) Using sports as a tool
for youth empowerment, leadership development, and character
building, 6.) And other significant work, activities,
projects and programs related to the said committee.

(h) Committee on Finance – Matters related to ensuring the


proper management of funds allocated to the SK, including
but not limited to: 1.) Participating in the preparation of
the SK budget, which involves assessing the financial needs
and priorities of the SK Council for the upcoming fiscal
year, 2.) Developing financial plans and strategies to
effectively utilize the allocated budget for the
implementation of programs and projects that benefit the
youth in the community, 3.) Reviewing budget proposals and
recommending adjustments as needed, 4.) Ensuring accurate
and timely financial reporting, including the preparation of
financial statements and reports that detail the SK
Council's expenditures, revenues, and financial status, 5.)
Promoting fiscal responsibility and accountability within
the SK Council, including adherence to financial regulations
and transparency in financial transactions, 6.) Regularly
monitoring the disbursement of funds to ensure that
expenditures align with approved budgets and are used for
the intended purposes, 7.) eveloping and implementing
fundraising initiatives, when allowed by local regulations,
to supplement the SK budget and support additional programs
and projects, 8.) Coordinating with internal or external
auditors to conduct financial audits, ensuring compliance
with accounting standards and identifying any irregularities
or discrepancies, 9.) Managing any grants or external
funding received by the SK Council, ensuring that funds are
utilized in accordance with grant requirements and
guidelines, 10.) And other significant work, activities,
projects and programs related to the said committee.

(i) Committee on Rules and Decorum – Matters related to


ensuring that the proceedings of the SK meetings are
conducted in an orderly and respectful manner, including but
not limited to: 1.) Developing and proposing rules of
procedure that govern the conduct of SK meetings, 2.)
Planning and organizing the agenda for SK meetings in
collaboration with other SK officials and committees, 3.)
Ensuring that the rules of procedure are followed during SK
meetings, 4.) Facilitating the resolution of conflicts or
disagreements among SK members during meetings, ensuring
that discussions remain constructive and focused on the
agenda items, 5.) Promoting respectful and professional
conduct of SK members in public interactions, both within
the SK Council and when representing the SK in the
community, 6.) And other significant work, activities,
projects and programs related to the said committee.

(j) Committee on Good Governance – Matters related to


transparency, accountability, and ethical conduct within the
organization, including but not limited to: 1.) mplementing
good governance practices within the SK Council, including
adherence to principles such as transparency,
accountability, and inclusivity, 2.) Taking measures to

prevent and address corruption within the SK organization,


including the establishment of internal controls, reporting

transparency in financial transactions, budgeting, and
expenditures, and making financial information accessible to
SK members and the community, 5.) Ensuring that the SK
Council operates in compliance with local laws, regulations,
and guidelines governing youth organizations and local
government units, 6.) And other significant work,
activities, projects and programs related to the said
committee.

(k) Committee on History, Arts, Culture and Tourism –


Matters related to promoting and preserving the cultural
heritage, artistic endeavours, and historical awareness
within the community, including but not limited to: 1.)
Working to preserve and promote the cultural heritage of the
community, including traditional practices, customs, and
cultural artefacts and remnants, 2.) Initiating and
supporting programs that promote the arts, such as art
exhibitions, cultural performances, and workshops to
showcase the talents of youth in the community, 3.)
Promoting awareness of local history and heritage,
organizing events or campaigns to educate youth about the
historical significance of their community, 4.) initiatives
that promote tourism within the community, showcasing its
cultural and historical attractions to others, 5.)
Supporting local artists by creating platforms for them to
showcase their work, organizing art festivals, and providing
opportunities for artistic expression, 6.) And other
significant work, activities, projects and programs related
to the said committee.

(l) Committee on Active Citizenship and Youth Empowerment –


Matters related to encouraging civic engagement, social
responsibility, and active participation among the youth in
the community, including but not limited to: 1.) Conducting
voter education campaigns to inform and educate youth about
the importance of voter registration, civic responsibility,
and participation in the electoral process, 2.) Implementing
programs that enhance the civic awareness and knowledge of
youth regarding local governance, civic rights, and
responsibilities, 3.) Facilitating programs and workshops
that develop leadership skills among youth, empowering them
to take on active roles in community development, 4.)
Engaging with the community to identify its needs, concerns,
and aspirations, and facilitating youth involvement in
addressing these issues, 5.) ollaborating with non-
governmental organizations (NGOs), civic groups, and other
youth-oriented organizations, 6.) Encouraging youth

(m) Committee on Active Citizenship and Youth Empowerment


– Matters related to for addressing issues related to
justice, human rights, and legal matters within the
community with a focus on the youth, including but not
limited to: 1.) Upholding the rights and welfare of youth
within the community, especially addressing the issues
related to discrimination, abuse, and social justice, 2.)
Conducting programs and campaigns to educate the youth about
their human rights, responsibilities, and the importance of
upholding human dignity, 3.) Collaborating with legal
organizations, NGOs, and human rights advocacy groups to
address legal concerns and provide support to the youth, 4.)
Implementing campaigns and initiatives to prevent and
address bullying among youth, fostering a safe and inclusive
community environment, 5.) And other significant work,
activities, projects and programs related to the said
committee.

(n) Committee on Review – Matters related to assessing the


performance, efficiency, and effectiveness of the SK
Council's activities and initiatives, including but not
limited to: 1.) Regularly assessing the performance of the
SK Council in terms of achieving its goals and objectives as
outlined in its programs and plans, 2.) Reviewing the
effectiveness of the SK's programs and projects in
addressing the needs and concerns of the youth in the
community, 3.) Reviewing the accuracy and completeness of
records, minutes of meetings, and other documentation
maintained by the SK Council, 4.) Providing recommendations
for improvements in SK programs, policies, and procedures
based on the findings of the review, 5.) Assessing the level
of the SK Council's participation in local governance
structures and processes, including collaboration with
barangay officials and engagement with the community, 6.)
And other significant work, activities, projects and
programs related to the said committee.

(o) Committee on Awards and Recognition – Matters related


to acknowledging and celebrating the achievements,
contributions, and positive endeavours of youth members
within the community, including but not limited to: 1.)
Identifying and recognizing outstanding achievements of
youth members in various fields, such as academics, sports,
arts, community service, and leadership, 2.) Developing a
nomination process or criteria for individuals or groups to
be considered for awards and recognition, 3.) Planning and
organizing events, ceremonies, or programs to formally

recognize and celebrate the accomplishments of deserving

(p) Committee on Grievances – Matters related to addressing


and resolving grievances, complaints, or disputes raised by
youth members or within the SK Council, including but not
limited to: 1.) Serving as a point of contact for youth
members who have grievances, complaints, or concerns within
the SK Council or the community, 2.) Investigating and
resolving grievances through a fair and transparent process,
ensuring that all parties involved have an opportunity to
present their concerns, 3.) Handling grievances with utmost
confidentiality to protect the privacy of individuals
involved and encourage open communication, 4.) Maintaining
records of grievances, actions taken, and resolutions
reached for reference and accountability, 5.) Soliciting
feedback from the community to identify potential grievances
and areas of concern, proactively addressing issues before
they escalate, 6.) And other significant work, activities,
projects and programs related to the said committee.

RULE X
SK COMMITTEE MEETINGS, HEARINGS AND REPORTS

Section 27. - Committees shall meet at the call of their


respective Chairmen, provide that due notice is serve upon each
and every member thereof. A majority of the members of the
committee shall constitute a quorum to do business.

The calling of the roll is mandatory and shall be done twice


during the committee hearing or meeting – after prayer and before
the adjournment of the meeting or hearing.

In case of the failure on the part of the chairman to call a


committee hearing or meeting within 30 working days from the
receipt of the referral from the SK Secretary, a majority of the
members of the Committee may call hearing and written notices
shall serve upon each member and author/s of the proposed
measures.

Absences and tardiness from committee hearing or meeting, not due


to official business and health reasons shall be posted.

Unexplained and unjustifiable absences in three (3) consecutive


committee hearings or meetings shall relinquish membership
therein.

Section 28. - The preparations of invitations, notices, agendas,


reports, and other matters shall be prepared by the Secretary to

the SK Council one (1) day after referral or receipt of the


business or subject matter for legislation.

The distribution of the invitations, notices, agendas, reports,


and other related matter shall be made at least three (3) days
before the scheduled committee or public hearing. In case of
emergency or urgency, the distribution thereof can be made at
least one (1) day before the scheduled committee meeting or
hearing.

Section 29. - The standing committees and special committees


shall hold hearings to discuss, decide and submit a report on all
matters transmitted to them.

The regular committee member shall be presumed to have concurred


in the report and shall be preclude from opposing the same unless
he enters his objection thereto or files with the SK Secretary to
the SK Council his dissenting vote within two session days after
the committee report is included in the Order of Business or
unless, upon satisfactory, explanation made by the member
concerned, the Presiding Officer should allow otherwise.

Any committee, in aid of legislation, request through the


Presiding Officer, the appearance before it of any official of
the City Government, Sangguniang Barangay, or any significant
person to testify, give statement, or answer questions or issues
or matters referred to or pending with the committee. All
invitations shall be signed by the SK Secretary for and in behalf
of the appropriate committee.

Any member proposing any measure, ordinance, or resolution


referred to a committee, may appear before the committee only in
so far as the consideration of said measure, ordinance, or
resolution, or such matter is concerned. Any member of the SK
Council may also appear in the Committee’s hearing or meeting as
observer, but he shall not participate in the committee’s
deliberation unless consulted by members of the committees.

Section 30. - Committee Reports – The different standing


committees, within fifteen (15) working days from receipt of any
matter referred to them for any action, comment, and/or
recommendation shall prepare for submission to the SK Council a
report together with the proposed amendment to be filed by the
Chairman, Vice –Chairman, and majority of the Members thereof.

A Member of a Committee, who dissents from the report, may submit


a separate one in writing stating his reasons therein.

Where the completion of the said report could not be accomplished


within the original period allotted for the said purpose, due to
insuperable or extreme difficult nature of the matter involved,
the committee to whom the same is referred, may request the SK
Council , through the SK Secretary, for an additional period of

time within which to submit its report. Such extension period


will not be permitted except for meritorious reasons. The
privilege to request for an extension could be availed of by the
committee concerned only once and for the period not longer than
the original period. After the lapse of the extended period, the
author of the measure or any member of the council, if he so
desires, may move that the committee be discharged from further
consideration of said question and that the same be assigned to
another committee or submit the question to the council for
disposition. If no report is submitted after the lapse of the
period, the Chairman of the Committee on Rules and Decorum shall
calendar those matters not acted upon under UNFINISHED BUSINESS.
Committee reports together with proposed measure, if any, shall
be submitted to the Committee on Rules and Decorum for agenda of
the SK Council. The Committee report shall be signed by the
members of a particular committee submitting the same.

RULE XI
ORDER AND CALENDAR OF BUSINESS

Section 31. - The order of business and calendar of business for


each session of the SK Council shall be as follows:

I. Call to order
II. Prayer/Singing of the Philippine National Anthem
III. Roll Call of the Members and/or Acknowledgement of Guests
IV. Certification of Quorum
V. Reading and Approval of the Minutes of the Preceding
Sessions
VI. Privilege Hour of the SK Members and Presiding Officer’s
Time
VII. First Reading and Committee Referrals:
a. Proposed Resolution(s)
b. Proposed Programs, Projects or Activities
c. Referrals to the committee from the Privilege Speech or
from Presiding Officer’s Time
VIII. Committee Reports and other reports from SK Members

Section 32. - Calendar of Business – The Calendar of Business


shall consist of the following parts:

a. Special Business or Order – requires an immediate

reading of proposed ordinance(s) or resolution(s)
submitted for discussion.
c. Business for the Day – proposed resolution(s) and other
measures set on the Calendar for consideration on that
day shall be considered in order in which they are
listed in the Calendar.
d. Unassigned Business – pending matters or measures
including new one’s arising out during deliberations
but not yet assigned or referred to any committee.

Section 33. - Privilege Speech – Any member may avail of his


right to a privilege speech to a maximum of two (2) separate
issues during plenary and shall be allowed to speak without
interruption until such speech has been delivered in full.

RULE XII
SK JOURNAL

Section 34. - The SK Council shall keep a journal of its


proceedings which shall contain an accurate account of what has
taken place in every session.

RULE XIII
PASSAGE OF RESOLUTION

Section 35. - Proposed resolution shall be typewritten and


prepared in as many copies as necessary. The original of the
proposed resolution shall be submitted by its author to the SK
Secretary who shall include the same in the agenda of the next
meeting for reference to the proper committee. The remaining
copies shall be distributed to the members of the Sangguniang
Kabataan.

Section 36. - Proposed resolutions shall contain an assigned


number, a title or caption, name of author(s) or sponsor(s).

Section 37. - Debatable proposed resolutions or any subject


matter such as proposed projects, programs or activities which
involve public interest and which require further study of the SK
Committee shall be subject for a Committee Report which bears:
Committee Number, the name of the committee, the subject matter,
the findings of the committee, and the committee recommendation
either to approve or disapprove said subject matter. In case the
report is favorable, the proposed resolution as recommended by
the committee shall be calendared for discussion during the same
meeting or in the next meeting. If the report is unfavorable, the
matter shall be laid on the table for further study and revision
by its author.

Section 38. - The passage of the proposed resolution shall be:

a. Proposed resolutions which need to be studied by any of


the committees in the Sangguniang Kabataan shall be
calendared under First Reading and Referral to
Committees.
b. There must be an application of Two-Reading Rule of
Sangguniang Kabataan Resolutions. Hence, generally, no
resolution shall be passed without passing the two
readings, after the same is thoroughly studied by the
committee concerned.
c. Immediate Approval Rule shall be applied if the
proposed resolutions are (i) non-debatable resolutions,
and (ii) debatable but urgent resolutions. Both shall
be calendared under Presiding Officer’s Time for
regular SK meetings, or in the agenda during special SK
meetings due to its urgency.
d. The committee which studies the proposed resolution
shall render a committee report incorporating therein
the findings and recommendation of the committee for
the Sangguniang Kabataan to act on it. The result of
the meeting/hearing should also be included in the
committee report.
e. Proposed resolutions supported by a committee report
shall be calendared on Second Reading. Non-
controversial proposed resolution may need not be
supported by a written committee report. An oral report
on the matter may be done during its deliberation.
f. The affirmative vote of a majority of the Sangguniang
Kabataan members shall be necessary for the passage of
a proposed resolution.

Section 39. - Each approved resolution shall be stamped with the


seal of the Sanggunian and recorded in a book kept for the
purpose. Thus, there must be an online safe-keeping of such for
convenient references.

RULE XIV
MINUTES OF THE MEETINGS

Section 40. - Contents of the Minutes of the Meetings – The


Minutes of the Meetings for regular or special session of the
Sangguniang Kabataan, KK Meetings, or Committee Hearings or
Meetings must clearly show:

a. The date, place and time of holding.


b. The kind of session, regular or special.
c. The names of members who are present and those who are
absent.

d. The correction or approval of the minutes of the


previous session.
e. The approved barangay resolution/s, in full.
f. The reasons for its approval or disapproval, and any
other important matters raised during its
deliberations.
g. The original copies of the minutes must be signed by
the members of the Sangguniang Kabataan present in the
meeting.

Section 41. – Numbering of Resolution – Resolutions of the


Sangguniang Kabataan shall be numbered consecutively throughout
the calendar year. The numbers of resolutions should be written
in the center and immediately above the first line of the
resolution. The number of the pages should be written in the
middle of the top of the page.

Section 42. – The Minutes of the Meetings shall be prepared by


the Secretary to the Sangguniang Kabataan and must be kept
safely, orderly and in organized manner.

Section 43. – The Minutes of the Meetings shall be available to


the public upon request.

RULE XV
DECORUM AND DEBATE

Section 44. – Manner of Addressing The Chair – When a member


desires to speak, he shall rise or raise hand and respectfully
address the Presiding Officer as “Ms. Chair” or “Ms. Presiding
Officer”. The member who obtained the floor shall address all his
remarks to the Chair.

Section 45. – Sponsor to Open and Closed Debate – The member


reporting a measure from a committee or delivering the
sponsorship speech of a proposed legislation may open and closed
debate.

Section 46. – Decorum to Open and Closed Debate – After three (3)
have spoken in favor and two (2) against a question, or only one
(1) speech shall have been delivered and none against, a motion
to close the debate shall be in order. If said motion is
approved, the Sanggunian shall proceed to consider amendments to
the question. Remarks on each amendment by any member shall not
exceed five (5) minutes.

The Sanggunian, may, by majority vote of the members present,


close debate on any question, upon motion for the previous
question and proceed to vote on the main question without debate.
This, does not, however, preclude further amendment should be
decided.

After a general debate is closed, the amendments disposing of the


main measure shall be voted upon final approval.

Section 47. – Recognition of a Member to Speak – During debates,


a member shall confine himself to the question before the body
and shall avoid personalities. He shall observe propoer decorum
during the entire proceedings.

In referring to another member, the latter shall always be


referred to by his official title or “as the member who spoke
last” or “the gentleman from…”

For the purpose of obtaining the floor, a member shall rise and
then address the presiding officer, “Ms. Chairperson” or “Ms.
Presiding Officer”. The member can do so only after a member has
yielded the floor.

The presiding officer shall be the only authority to recognized


any member by announcing the latter’s name as a sign of
recognition to the floor.

Section 48. – Conduct During Session – During sessions of the


Sangguniang Kabataan, the members shall observe proper decorum.
They shall remain in their seat during roll call or when the vote
is being taken and no one shall pass between a member who has the
floor and the chair and while the Presiding Officer is addressing
the Council, no member shall walk-out of or across the session
hall.

Any member who is permitted to go out of the session hall is


obliged to return within ten (10) minutes.

Section 49. – Dress Code – To reflect sanctity and credence to


parliamentary proceedings during each Sagguniang Kabataan
Sessions and Meetings, each and every member must be in proper
attire befitting his status as a legislator. To this effect, the
following rules which shall govern:

a. Each and every member is required to wear the prescribed


uniform for the said session or meetings as agreed upon
before the commencement of such by majority of the SK
Members, and it must be partnered with formal pants, denim
pants, or pants with minimal ripped only.
b. No other footwear shall be allowed in any session or
meetings except for closed shoes, rubber shoes, or
appropriate sandals.

RULE XVI
VOTING

Section 50. – No motions except on the presence of a quorum shall


be entertained during the voting.

Section 51. – Any member may explain his vote when voting for a
debatable motion. When the motion is not debatable, no other
remarks will be entertained by the Chair when a member casts his
vote.

Section 52. – On a vote where the affirmative and negative are


equal in numbers, the motion shall be declared lost.

Section 53. – If a tie has taken place, the Chair, at his


discretion, cast the deciding vote, except if the motion is to
appeal from the decision of the Chair, in which case the tie vote
automatically sustains the decision of the Chair.

Section 54. – A two-thirds vote is required to pass any of the


following motions:

a. To limit, extend or close a debate.


b. To amend any part of the adopted Rules.
c. To suspend the Rules.
d. To suspend or recommend the expulsion of any member for cause.

Section 55. – No member could be compelled to vote; he may,


however, abstain.

Section 56. – The motion to reconsider can be made only by the


member who voted on the prevailing side. Any member who abstained
from voting shall have no right to ask for reconsideration.

Section 57. – No member can vote on a question in which he has a


direct or personal pecuniary interest.

RULE XVII
HONORARIUM OF SK COUNCILOR AND APPOINTIVE MEMBERS

Section 58. – The honorarium of the SK Councilor and Appointive


Members shall be allotted from the Sangguniang Kabataan Funds,
and such allotment shall not be greater than 25% of the annual
funds thereof.

Section 59. – The honorarium of the SK Councilor and Appointive


Members shall be given in every 16th day of the month, and it
must be prepared and disbursed by the Treasurer to the
Sangguniang Kabataan Council.

Section 60. – absences of SK Councilor and Appointive Members


without justifiable cause shall be fined Php 300.00, per absence
during sessions or committee meetings or hearings, and it must be
automatically deducted by the SK Treasurer. If the sangguniang
kabataan member is absent or excuse in the session for a valid
reason, he/she is required to send a formal letter to SK Chairman

3 days before the session. If the sangguniang kabataan member is


absent for 3 consecutive meetings without valid reason he/she
will receive a memo from SK Chairman.

RULE XVIII
SUSPENSION OF RULES

Section 61. – Any part of this Rules relating to the order of


business, business procedure, and like procedural matters, may be
suspended unanimously or by majority vote of all members present.
Once the business for which rule has been suspended is dispose
of, the suspension loses its effect and the rule becomes
effective again.

RULE XIX

Section 62. – The provisions of RA 7160 and RA 10742 as amended


by R.A 11768, including its Implementing Rules and Regulations
shall govern in case of conflict with these rules.

RULE XX
FINAL PROVISIONS

Section 63. –Any rule of order or procedure being adopted by


other parliamentary bodies not incompatible with the
aforementioned rules may be resorted to and considered supplement
to these.

Section 64. –These Rules of Procedure shall take effect on the


date of their adoption and shall remain in force until repealed
or amended.

RULE XXI
AMENDMENTS

Section 65. – Any amendments to these Rules shall be presented in


writing and shall be adopted by a vote of two-thirds (2/3) of all
the Members of the Council; Provided, however, that no amendment
to these Rules shall be presented within three (3) months from
their promulgation.

RULE XXII
DATE OF EFFECTIVITY

Section 66. – These rules shall take effect immediately upon


approval.

RULE XXIII
SEPARABLITY CLAUSE

Section 67. – if, for any reason(s), any part of these rules
shall be held unconstitutional or invalid, other parts or

provisions hereof which are not affected thereby shall continue


to be in full force and effect.

Let copies of this resolution be furnished the Honorable Members


of the Sangguniang Kabataan Council including the SK Secretary
and SK Treasurer, as well as the Office of the Sangguniang
Barangay of Dakila and other offices concerned for their
information and guidance.
