Introduction
In pursuance of the complaint application made by the above-mentioned applicant to this office on
27.07.2012 regarding the organization, the joint hearing of the applicant and the respondent was
held on 23.08.2022 and the final hearing on 12.10.2022 as per the hearing notice dated 08.08.2022.
The holder has been closed by order. In the said hearing, the applicant Smt. Seema Rai was present,
while the secretary, Mr. Vikram Singh Rawat, was present on behalf of the respondent organization.
1. The Society had a total of four feeding points for stray dogs, after the new committee started
functioning of the society, one feeding point has been continued. Also, since it is at the back of the
gate, it is not practical to feed 33 dogs at once.
2. 500/- fined by the organization for feeding the dogs outside the place prescribed by the
organization
4. The organization should give permission to start feeding points at four places as before.
The written statement of the responding organization is briefly as follows
1. There are a total of 35 stray dogs in the institution and since January 2021, 25 people have been
attacked by dogs.
2. As the menace of stray dogs has gone out of control, Stray Management Group has been
established and according to their suggestions, decisions regarding stray dogs are taken and
implemented in the organization.
Observation
1. Jal Vayu Defence Enclave Co Op Housing Society Ltd. Plot No. 20, Sector 20, Kharghar, Navi
Mumbai 410210 is registered under Section 9(1) of the Maharashtra Cooperative Societies Act, 1960
and its registration is No. NBOM / CIDCO / HSG / (OH) / 3194 / JTR / 2009-2010. Also, the said
organization is coming under the statutory scope of this office.
2. The Wildlife Board of India (Ministry of Environment, Forest and Climate Change, Government of
India) has issued the following guidelines as per circular dated 26.02.2015 regarding stray dogs.
1. There are many people in India who feed stray and ownerless animals. Some dispose off their
leftover food in this manner, and others compassionately prepare food for them. Those who
feed street dogs are advised to participate in their sterilization, and yearly vaccination too. Since
they win the trust of the dogs through feeding them. They are also advised to provide, or to
assist animal welfare organization in providing health care to them.
2. Care-givers are advised not to feed stray dogs close to residences not their own. They are also
advised to avoid feeding street dogs immediately adjacent to areas in which children play or
people take walks or that are otherwise crowded. Moreover, feeding must not to be done in a
manner that contributes to littering, or dirtying any feeding site. Care-givers are advise to clean
up feeding sides after feeding is over.
3. Care-givers are advised to keep the sterilization and vaccination status of the dogs, they are
feeding and caring for, updated and readily accessible. Sharing the same with their residents
welfare associations or other residents, generate positivity, and greater acceptability of the dogs.
4. Care-givers cannot control the defecation habits of the strays. However, they are advised
text/participate in other solutions for maintaining cleanliness.
3. As the said guidelines are issued by the Boards under the Union Ministry, follow the same it is the
duty of individuals in all parts of the country to do so.
Estimate
Taking into consideration the above mentioned observations, being convinced that it would be
justified to order to act in accordance with the guidelines issued by the National Level Animal
Welfare Board of India (Ministry of Environment, Forest and Climate Change, Government of
India) vide circular dated 26.02.2015 . Dongre, Joint Registrar, Co-operative Societies, CIDCO, Navi
Mumbai, passing the following order
ORDER
Jal Vayu Defence Enclave Co Op Housing Society Ltd. Plot No. 20 Sector 20, Kharghar, Navi
Mumbai 410210 is hereby ordered that the National Level Animal Welfare Board of India (Ministry
of Environment, Forest and Climate Change, Government of India) dated 26.02.2015 regarding
stray dogs in the organization. Work should be done as per the guidelines given in the circular. In
case of default on the part of the organization in complying with the said circular, the applicant
will be allowed to appeal to the competent authority. The said order was given today dated
15/12/2022 with my signature, seal and seal of office.
