EVIDENCE AFFIDAVIT
I, AATEEF AKHTAR SAYYED, Age 36 years, Residing at - A-
1/66/3, Sector-21, Turbhe, Navi Mumbai the Applicant in the above case,
do hereby state on solemn affirmation as under :-
1. I say that, the Son of deceased LATE. SHAMEEN AKHTAR
SAYYED @ SHAMIM AKHTAR SAYED, she expired on
29/07/2020 at A-1/66/3, Sector-21, Turbhe, Navi Mumbai, State –
Maharashtra.
2. I say that, Dr. (Mrs.) Saira L. Shaikh (Medical Practitioner Regd.
No.-14606) has issued a Medical Certificate in which time & cause of
Death was mentioned. Hereto annexed and marked as Exhibit ‘B’ the
contents thereof are true and correct and it be admitted in evidence.
3. I say that, due to lack of knowledge and ignorance of me or any of my
family member could not registered the Death of my Mother in the
department of N.M.M.C. I have submit that I am unfamiliar of the
rules and regulation of law therefore I could not apply for the
registration of Death Certificate till date.
4. I say that, now I intend to register the Death of my Mother in
concerned department of N.M.M.C., Navi Mumbai. Present day I
required the Death Certificate for legal procedure at various
department of Govt. as per requirement I have approached to the
Muncipal Corporation office for registration of Death and issuance of
Death Certificate of my Mother who died on date 29/07/2020. I came
to know regarding the delay. The ward officer of Muncipal
Corporation directed to me for inability Court order for registration.
5. I say that, Today I approach to the Hon’ble Court to issue an order to
the N. M. M. C. ‘D’ ward Turbhe to register the Death & issue Death
Certificate of my Father. Hereto annexed and marked as Exhibit ‘A’
Letter of N. M. M. C. ‘D’ ward.
6. I say that, as per the Hon’ble Court orders the Public Notice has been
issued in local news paper Dainik Jan Khulasa on dated /0 /2023
and even after one month from the publication and notice nobody has
been raised any objection.
7. I say that, I have submitted my Aadhar card, Pan card, Ration card &
verified copy of Affidavit on dated _________ with this application.
Hereto annexed and marked as Exhibit ‘__’ the contents thereof are
true and correct and it be admitted in evidence.
I say that I am making this affidavit to filed in the Court at
Belapur, CBD-Belapur, Navi Mumbai.
I say that If any thing goes wrong I will be held responsible. I
say that whatsoever stated above is true and correct to the best of my

The Applicant Aateef Akhtar Sayyed, Age 36 years, Residing

at - A-1/66/3, Sector-21, Turbhe, Navi Mumbai, Solemnly & most
respectfully submit as under:-
1. That the Applicant is Indian inhabitant & permanent resident of Navi
Mumbai. Applicant is the Son of deceased LATE. SHAMEEN
AKHTAR SAYYED @ SHAMIM AKHTAR SAYED, she expired
on 29/07/2020 at A-1/66/3, Sector-21, Turbhe, Navi Mumbai, State –
Maharashtra.
2. The Applicant states that, Dr. (Mrs.) Saira L. Shaikh (Medical
Practitioner Regd. No.-14606) has issued a Medical Certificate in
which time & cause of Death was mentioned.
3. The Applicant states that, due to lack of knowledge and ignorance of
Applicant or any of his family member could not registered the Death
of his mother in the office of N.M.M.C. Applicant submits that he is
unknown of the rules and regulation of law therefore he could not be
applied for the registration of Death Certificate till date.
4. The Applicant states that, now the Applicant intends to register the
Death of his mother in concerned N.M.M.C. office, Navi Mumbai.
Present day the Applicant required the Death Certificate for legal
procedure at various department of Govt. as per requirement
Applicant approached to the Municipal Corporation for registration of
Death and issuance of Death Certificate of his Mother who died on
 dated 29/07/2020. The Applicant came to know regarding delay. The
ward officer of Municipal Corporation directed to the applicant for
inability Court order for registration and therefore Applicant today
approaches to the Court for issuance of order for Death Certificate.
5. That the cause of action for this Application First arose at Turbhe
Navi Mumbai and Hence, this complaint filed today is well within
limitation. The Applicant states that he is residing at - A-1/66/3,
Sector-21, Turbhe, Navi Mumbai. Therefore, this Hon’ble Court has
jurisdiction to entertain and dispose of this Application.
6. Applicant paid Court fee of Rs.____/-.

7. The Applicant therefore pray that :-

a) Direction may kindly be given to the Municipal Authority for
registration of the Death of his mother who died on dated
29/07/2020.
b) Direction may please be given for issuance of the Death
Certificate handover to the Applicant.
c) Any other order may pass deems fit to the Applicant.

Navi Mumbai. the Applicant in the above case, do hereby state on
solemn affirmation as under :-
1. I say that, I am Indian inhabitant & permanent resident of Navi
Mumbai. I am the Son of LATE. SHAMEEN AKHTAR SAYYED
@ SHAMIM AKHTAR SAYED, she expired on 29/07/2020 at A-
1/66/3, Sector-21, Turbhe, Navi Mumbai, State – Maharashtra.
2. The Applicant states that, Dr. (Mrs.) Saira L. Shaikh (Medical

Navi Mumbai and Hence, this complaint filed today is well within
limitation. I am residing at - Room No.380, Ambedkar Nagar, Pfizer
Road, Turbhe, Navi Mumbai. Therefore, this Hon’ble Court has
jurisdiction to entertain and dispose of this Application.
I say that, the contents of main application are true and correct and I
repeat, reaffirm and reiterate the same. I say that same may be treated as part
and parcel of this affidavit.
