TERMS AND AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Agreement made and executed by and between _____________________, herein referred to as the RENTER and with postal address ______________________________________; and __________________, an individual duly organized and existing under and by virtue of the Philippines, herein referred to as OWNER, with postal address ______________________________________________.
WITNESSETH
The RENTER wishes to hire a vehicle for legal use from the OWNER. The OWNER hereby rents to the RENTER a vehicle with the following specifications: Make/Model: TOYOTA INNOVA 2010 MODEL, Automatic, Diesel Color: Jade Green The RENTER wishes to rent the above mentioned vehicle from ________________ to ________________. The OWNER can provide the vehicle at the specified time requested by the RENTER. OBLIGATIONS The OWNER and the RENTER hereby acknowledge and agree to the following terms and conditions: TERMS OF PAYMENT: Payment of rental fee amounting to P____________ shall be paid by the RENTER immediately upon approval by the OWNER and signing of this Terms and Agreement by both parties.
DAMAGES: All losses or damages not chargeable to insurance like radio, tools, tires, rims, mirror, and other car
accessories shall first be charged to the RENTER. RELEASE OF CAR: The OWNER shall release the car for lease to the RENTER at the specified date and time as shown above.
FOR CHANGE IN ADDRESS OR TEL. NOS.: The RENTER shall notify the OWNER immediately at the phone and address
specified on the front of the statement.

CANCELLATION: 25% percent of the rental fee shall be charged if the RENTER fails to cancel his or her reservation two (2)
days before the rental date.

RESERVATION: Reservation fee is 25% of the rental fee. EXCESS HOURS: Use of the vehicle beyond the agreed return time specified herein shall be immediately requested and
subject to approval. If approved, each excess hour shall be charged at P300 per hour. RENTAL EXTENSION: The RENTER may request for an extension to his specified return time while the rental is in progress. If the request has been approved by the OWNER and if the requested extension is between six to ten hours, the OWNER shall charge the RENTER an equivalent to one (1) day rental fee. In case of lease period of one (1) month and the requested and approved extension is another month, the rental fee for the requested extension shall be due or paid by the RENTER to the OWNER immediately upon approval of the request. PENALTY: Any delay in the return of the vehicle at the specified time without any advise whatsoever from the RENTER; The OWNER will automatically report the vehicle as MISSING to the Constabulary Anti-Carnapping Group.
WITH DRIVER REQUIREMENTS: Food and/or lodging must be provided to the driver, if out-of-town or stay in.
SELF-DRIVEN REQUIREMENTS: For self-driven, the RENTER shall drive the car and not anybody else. The following are required and part of this Terms and Agreement BASIC REQUIREMENTS:
For Local Citizens a. b. c. d. e. f. Latest proof of billing (original copy) in the name of the RENTER, such as Meralco, PLDT, Credit cards. Photocopy Lease of contract/receipt if the RENTER is leasing a place in Metro Manila Photocopy drivers license local/international Photocopy of valid ID with photo such as SSS, GSIS,PRC or Company ID RENTER should be at least 23 years old. RENTER should have at least 2 years driving experience.
IN CASE OF DAMAGE TO VEHICLE: RENTER must secure Police Report, photocopy of driver's license, and will pay
P5,000.00 Participation Fee + 10% of the total parts replacement and 50% of the daily rate, exclusive of insurance liability. In case of loss or total damage to the said vehicle, the RENTER shall shoulder 10% of the current market value, exclusive of the insurance liability, and due within 7 days from date of accident / loss. PARKING FEES / TOLL FEES / TRAFFIC FINES: For the account of the RENTER.
FLAT TIRES WHILE ON RENTAL: Flat tires incurred by the RENTER while on rental, vulcanizing charges shall be for the
account of the RENTER.

GASOLINE: The OWNER shall provide a full tank of gas to the RENTER before use. And the OWNER requires the RENTER to
return the vehicle with the same quantity of gas as indicated on the check list. Any deficiency should be charged to the RENTER.
LOST / DAMAGED KEYS: RENTERS failure to return car keys will be automatically charged with fee of P200.00. RELEASE OF LIABILITY: The OWNER shall not be liable or responsible for any loss of any valuable left in the car. Neither
shall it be liable for anything left by the RENTER in the vehicle. The RENTER hereby undertakes and guarantees that the car shall be used and operated for lawful purposes and in strict conformity with all applicable laws, ordinance, and regulations. If the Renter used or permits the use of vehicle for any unlawful purpose, he shall render the OWNER harmless from any and all connected therewith. The OWNER shall not be responsible for any unforeseen happenings beyond human control during the duration of this Contract (like broken bridges, unpassable roads, etc. caused by commotion, typhoon, or any natural calamity) that may damage or prevent the car from reaching the destination on time.
COURSE OF ACTION: In the event that the RENTER does violate a stipulation on this Agreement, the OWNER may request
and demand the restoration and the return of the car before the termination of this Agreement, it may be instituted in the city of Manila at the option of the OWNER. It is understood that the RENTER shall defray all Court's costs, attorney's fees, and legal interest. The OWNER shall charge the RENTER the interest of 5% a month for account over 30 days plus all other costs. That the parties herein agree to adopt all the stipulated terms and conditions appearing on all pages of this agreement.
