This Memorandum of Agreement
1. PARTIES
1.2. Angel Moyo ("Tenant"), residing at 513 Lilian Ngoyi Street, Pretoria.
2. SUBJECT PROPERTY
2.1. The subject of this Agreement is the townhouse owned by the Landlord located at [Townhouse
Address] ("the Property").
3.1. The Tenant agrees to rent the Property at a monthly rental amount of R 11,000.00 (eleven
thousand rand).
3.2. The Tenant shall pay the first month's rent of R 11,000.00 on or before 31 October 2024, upon
arrival at a clean and empty Property.
3.3. No security deposit will be payable by the Tenant, as per the conditions outlined in this
Agreement.
4.1. The Landlord will not advertise the Property to the public as the Tenant will be the new
occupant.
4.2. The Property shall be vacated and made available to the Tenant by 31 October 2024, one week
before the official move-in date of 7 November 2024.
4.3. The Landlord agrees to ensure that the Property, including the courtyard, is clean before 31
October 2024. This includes the removal of any refuse, cutting of the grass, and cleaning of the
windows, toilets, and other areas as necessary. The Landlord shall be responsible for hiring cleaning
staff to perform these tasks.
5.1. The Tenant agrees to perform the following repairs and maintenance in lieu of paying the R
11,000 deposit:
5.1.1. *Painting:* The Tenant will paint the interior walls of the Property white using Dulux paint as
specified by the Landlord.
5.1.2. *Kitchen Door Replacement:* The Tenant will replace the existing rotting kitchen door with a
solid wooden door, as requested by the Landlord.
6.1. The Landlord shall ensure that the Property is available for access by the Tenant from 31
October 2024, and is clean, vacant, and in a state suitable for the repairs and maintenance to be
carried out by the Tenant.
6.2. The Landlord agrees to all terms related to the Property's maintenance and preparation as
outlined in Clause 4.
7.1. The Tenant shall be entitled to move into the Property on 7 November 2024, provided that the
terms of this Agreement have been met.
8.1. This Agreement constitutes the entire understanding between the parties concerning the
subject matter herein and supersedes all prior negotiations, agreements, and understandings.
8.2. Any amendments or modifications to this Agreement must be made in writing and signed by
both parties.
8.3. This Agreement shall be governed by and construed in accordance with the laws of the Republic
of South Africa.

*WHEREAS*, Jane Mofokeng and Yemi Baráky desire to establish an agreement regarding the rental
of the townhouse located at [Townhouse Address], and to outline the responsibilities of each party
concerning the occupation, maintenance, and preparation of the townhouse.
*NOW, THEREFORE*, in consideration of the mutual covenants and agreements contained herein,
the parties hereto agree as follows:
### *1. Scope of Work*
1.1. The Tenant agrees to rent the townhouse at a monthly rental of R 11,000.00.
1.2. In lieu of paying a deposit of R 11,000.00, the Tenant will undertake the following work:
- Paint the interior walls of the townhouse in white using Dulux paint.
1.3. The Landlord agrees to ensure the townhouse is vacated, clean, and accessible by 31 October
2024, allowing the Tenant to perform the agreed-upon work.
2.1. This agreement shall commence on 31 October 2024 and shall remain in effect until terminated
in accordance with this MOA.
2.2. The Tenant shall move into the townhouse on 7 November 2024, provided all conditions of the
MOA have been met.
3.1. The Tenant shall pay the first month’s rent of R 11,000.00 on or before 31 October 2024,
contingent upon the townhouse being clean and vacant on that date.
3.2. No deposit is required from the Tenant due to the agreement that the Tenant will perform the
necessary painting and door replacement.
- Ensure the townhouse is not advertised to the public and is reserved for the Tenant.
- Make the townhouse available by 31 October 2024, fully vacated, cleaned, and prepared for
painting and repairs.
- Pay for cleaning staff to remove any refuse, cut the grass, clean the windows, and ensure the
courtyard and interior are ready for the Tenant.
- Paint the interior walls of the townhouse in white using Dulux paint.
5.1. Both parties agree to keep the terms of this agreement confidential and not disclose them to
any third parties without prior written consent.
6.1. Any disputes arising from this MOA shall be resolved through mediation. If mediation fails, the
dispute shall be referred to arbitration in accordance with the laws of the Republic of South Africa.
7.1. Any amendments to this MOA must be made in writing and signed by both parties.
8.1. This agreement may be terminated by mutual written consent of both parties or by either party
upon breach of the terms herein, provided a written notice of termination is given.
