Humble surrender cum bail application on


behalf of above named sole accused Md.
Arif @Asif @Ashique, son of Late Abdul
Rashid, aged about 48 years, resident of
Asnabad, Jhumri Telaiya, P.S.–Telaiya,
District–Koderma, Jharkhand.

Most respectfully sheweth:

1. That the above noted FIR was lodged by informant namely


Sultana Parveen against the sole accused above named and
the matter is pending adjudication before this Hon’ble Court.

2. That the matter was fixed for the examination of the accused
as per the provisions lay down under section 313 of the code,

and during course of the trial, the accused remained absent


and this Hon’ble Court to compel the presence of the
accused, pleased to cancel the bail bonds vide order dated
10/06/2024. In consequences thereof non-bailable warrant
got issued against the accused person and he is
apprehending his arrest. However, it is pertinent to mention
here that non appearance of the accused was neither
intentionally nor deliberately but due to some unavoidable
circumstances occurred to him.

3. That the informant and the accused are spouse and during
pendency of this case both parties due to intervention of
friends, relatives and co-villagers have amicably
compromised this case outside the Court and to substantiate
the same both parties have entered into joint compromise
and put their signatures respectively, a copy of the said
compromise petition is also attached herewith this bail
application for the kind perusal of this Hon’ble Court.

4. The accused/applicant is permanent resident of the above-


mentioned address, which is under the jurisdiction of this
Hon’ble Court and there is not any chance of absconding or
flee from the court of justice.

5. That due to reconcile, the parties do not want to proceed with


the case and seeks permission with this Hon’ble Court to
compromise their case.

6. That the accused undertakes that he will not fail to appear on


subsequent hearing dates.

7. The accused/applicant is ready to furnish suitable bail bonds


to the satisfaction of this Hon’ble Court.

8. That the other grounds shall be urged at the time of hearing.

PRAYER:
It is, therefore respectfully prayed that this
Hon’ble Court may kindly be pleased to
grant bail to the accused/applicant till the
final trial of this case and thus renders
justice.
AND
For this part of kindness, the
accused/applicant shall ever pray.
