    hereby institute action against the defendant in which action the plaintiff claim the relief and on the grounds set forth in the Particulars of Claim annexed hereto marked Annexure "A". INFORM the Defendant further that if Defendant disputes the claim and wishes to defend the action, shall: (i) within 10 days of the service upon the defendant of this Summons file with the Registrar of this Honourable Court at THE HIGH COURT, PRETORIA notice of intention to defend and serve a copy thereof on the Plaintiffs Attorneys, which said notice shall give an address (not being a post office box or a post restante) referred to in Rule 19(3) for the service upon the defendant of all notices and documents in the action; (ii) thereafter, and within TWENTY (20) days after filing and serving notice of intention to defend as aforesaid, file with the Registrar and serve upon the a plea, exception, notice to strike out, with or without a counterclaim.

    INFORM the defendant further that if she fail to file and serve notice as aforesaid, judgment as claimed may be given against her without further notice to , or if, having filed and served such notice, fail to plead, except, make application to strike out or counterclaim, judgment may be given against . AND IMMEDIATELY THEREAFTER serve on the defendant a copy of this Summons together with the particulars of claim annexed hereto, and return the same to the Registrar with whatsoever you have done thereupon.

The Parties were married to each other on 5 JANUARY 2008 at MMAKAU, GA-RANKUWA, RSA in Community of Property , with no contract, which marriage still subsists. 4. Both Parties are domiciled within the area of jurisdiction of this Honourable Court. 5. The marriage relationship between the parties has broken down irretrievably and there is no reasonable prospect of the restoration of a normal marriage relationship between them due to the following reasons: 11.1 11.2 11.3 There is no meaningful communication between the parties. The DEFENDANT abuses the PLAINTIFF emotionally and psychologically. The Parties have drifted further and further apart.

    6. Due to the above the PLAINTIFF has lost his love and respect for the DEFENDANT and no longer wishes to continue with the marriage relationship.
