INTERNATIONAL NATURE OF AERODROMES


ROLE OF ICAO:A specialized agency of the United Nations, ICAO was created in 1944 to promote the safe and orderly development of international civil aviation throughout the world. It sets standards and regulations necessary for aviation safety, security, efficiency and regularity, as well as for aviation environmental protection. LEGAL FRAMEWORK
THE CONSTITUTION OF INDIA INCLUDES AERODROMES IN ITEM 29 OF THE UNION LIST, WHICH IMPLIES THAT THE CENTRAL GOVERNMENT ALONE HAS THE LEGISLATIVE AND EXECUTIVE POWERS RELATING TO AIRPORTS. THE UNION ALONE HAS COMPETENCE TO LEGISLATE IN RESPECT OF: AIRWAYS, AIRCRAFT AND AIR NAVIGATION;

PROVISION OF AERODROMES; REGULATION AND ORGANIZATION OF AIR TRAFFIC AND OF AERODROMES; PROVISION FOR AERONAUTICAL EDUCATION AND TRAINING AND REGULATION OF SUCH EDUCATION AND TRAINING PROVIDED BY STATES AND OTHER AGENCIES

THE BASIC LEGISLATION


A) THE AIRCRAFT ACT, 1934B) THE AIRPORTS AUTHORITY OF INDIA ACT, 1994, AS AMENDED BY AMENDMENT, ACT OF 2003. SECTION 5(2)B OF THE AIRCRAFT, 1934 EMPOWERS CENTRAL GOVT. FOR THE LICENSING, INSPECTION AND REGULATION OF AERODROMES, THE CONDITIONS UNDER WHICH AERODROMES MAY BE MAINTAINED, THE PROHIBITION OR REGULATION OF THE USE OF UNLICENSED AERODROMES IN EXERCISE OF THESE POWERS CENTRAL GOVERNMENT HAVE MADE RULES IN PART XI OF THE AIRCRAFT RULES , 1937 . (RULES 78-92) THE AIRPORTS AUTHORITY OF INDIA ACT, 1994, AS AMENDED BY AMENDMENT, ACT OF 2003 AIMS AT BETTER ADMINISTRATION AND COHESIVE MANAGEMENT OF AIRPORTS AND CIVIL ENCLAVES WHEREAT AIR TRANSPORT SERVICES ARE OPERATED OR ARE INTENDED TO BE OPERATED AND OF ALL AERONAUTICAL COMMUNICATION STATIONS 1FOR THE PURPOSES OF ESTABLISHING OR ASSISTING IN THE ESTABLISHMENT OF AIRPORTS* AND FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.

LICENSING OF AERODROMES
INDIA IS ONE OF THE 190 MEMBER STATES OF ICAO. ALL THE MEMBER STATES ARE OBLIGED TO FOLLOW THE STANDARDS AND RECOMMENDED PRACTICES DEVELOPED BY ICAO. EARLIER THE INTERNATIONAL AIRPORTS WERE DIRECTLY UNDER THE GOVERNMENT OR GOVT. BODIES. -THERE HAS BEEN SPURT TOWARDS PRIVATIZATION, PPP, AND OTHER FORMS OF OWNERSHIP AND MANAGEMENT PATTERN WORLDWIDE. -IRRESPECTIVE OF OWNERSHIP AND MANAGEMENT PATTERN, IT IS THE GOVERNMENTS IN MEMBER STATES THAT REMAIN RESPONSIBLE FOR ENSURING THAT SARPS ARE ADHERED TO. HENCE ICAO HAS COME OUT WITH PROVISIONS FOR CERTIFICATION AERODROMES. INDIA HAS IMPLEMENTED THESE PROVISIONS IN FORM OF LICENSING.

LICENSING OF AERODROMES cont.


INTRODUCTION :. THE RULE 78 REQUIRES THAT NO AERODROME SHALL BE USED AS A REGULAR PLACE FOR LANDING AND DEPARTURE BY A SCHEDULED AIR TRANSPORT SERVICE OR FOR A SERIES OF LANDING AND DEPARTURES BY ANY AIRCRAFT CARRYING PASSENGERS OR CARGO FOR HIRE OR REWARD UNLESS IT HAS BEEN LICENSED. . GENERAL :THE AERODROMES SHALL BE LICENSED IN ONE OF THE FOLLOWING CATEGORIES, NAMELY: I. FOR PUBLIC USE; THE AERODROME, WHICH, WHEN AVAILABLE FOR OPERATION OF AIRCRAFT, SHALL BE SO AVAILABLE TO ALL PERSONS ON EQUAL TERMS AND CONDITIONS. II. FOR PRIVATE USE; THAT IS TO SAY, FOR USE BY THE LICENSEE AND BY INDIVIDUALS SPECIFICALLY AUTHORISED BY THE LICENSEE. (NOTE : USAGE OF PRIVATE USE AERODROMES EXCLUDES THE OPERATION OF SCHEDULE FLIGHTS THERE FROM )

PROVIDING ROUTINE AND SPECIAL METEOROLOGICAL REPORTS AND FORECASTS FOR SAFE AND EFFICIENT CONDUCT OF FLIGHT. THESE SERVICES MAY BE PROVIDED TO AIRCRAFT OR AIR TRAFFIC SERVICES OR TO THE AERODROME ADMINISTRATION. AIRLINES OPERATIONS DEPARTMENT


ASSIST THE PILOT- IN COMMAND IN FLIGHT PREPARATION AND PROVIDE THE RELEVANT INFORMATION. ASSISTING THE PILOT-IN -COMMAND IN PREPARING OPERATIONAL AND ATS FLIGHT PLAN, SIGN WHEN APPLICABLE , AND FILE THE ATS FLIGHT PLAN WITH APPROPRIATE ATS UNIT. FURNISH BY APPROPRIATE MEANS WITH INFORMATION NECESSARY FOR SAFE CONDUCT OF FLIGHT. IN EMERGENCY: A)INITIATE PROCEDURES OUTLINED IN OPERATIONAL MANUAL WHILE AVOIDING ANY ACTION THAT WOULD CONFLICT WITH ATC PROCEDURES. B)CONVEY NECESSARY SAFETY RELATED INFORMATION TO PIC INCLUDING AMENDMENT TO FLIGHT PLAN, IF ANY. FLIGHT OPERATIONS OFFICER SHALL BE LICENCED AND SHALL HAVE COMPLETED APPROVED COURSE OF STUDY.HE SHALL BE FAMILIAR HE IS EXPECTED TO SUPERVISE.
