Consumer protection Acts

Rights of consumers
Right of protection-against hazardous
goods
Right of Information-
quality,quantity,purity,potency,price
Right to choose
Right to be heard
Right to seek redressal
Right to education
Consumer disputes redressal
forum
These are constituted to give relief to the
consumers who are not in a position to go to regular
courts because of high cost of litigation. it provides
three tier quasi judicial redressal machinery
1.District consumer redressal forum
2. The district consumer redressal forum
3.national consumer disputes redressal forum
Empowered to award compensation and penalties
The district consumer redressal forum(Sec.9)

By notification by state Govt.(More then one forum may be


established)
composition:
A person who is or is qualified to be a district judge(President)
Two members (one should be a woman)
Not less then 35 years of age
Bachelor’s degree from recognized university
Be a person of ability ,integrity, standing and having an adequate
knowledge and experience of 10 years in dealing problems
rele. To law, economics,commerce,industry public affairs etc.
Disqualification as a member
• Has been convicted and sentenced to imprison
ment for an offence involving moral turpitude.
• Undischarged insolvent
• Unsound mind
• Removed or dismissed by the govt or govt body
• Having financial or other interest which affects his
performance as a member.
• Has some other qualification as prescribed by the
state Govt.
Jurisdiction of district forums(sec.11)
• Value of goods & services and compensation
doesnot exceed rs. 20 lakh(sec.11a)
Territorial jurisdiction:
Where the opposite party or any of the oppsite
party resides or carries the business or having
branch office.
Or permission of the district forum is given
acquiescence in such institution.
Where the original cause of action arise.
Complaint procedure
1.Complaint in relation to the goods or services sold or agreed to be sold
• Complaint may be filed by
• Consumer
• Recognized consumer association
• One or more consumers where there are numerous having same interest.
• Central or state govt.
2.Complaint shall be accompanied with the fee
3. The D.F. may allow the complaint to be proceeded or reject
(shall not be rejected unless the opportunity of hearing is given to the complainant)
( admissibility of the complaint is decided within 21 days after receiving of the
complaint)
4. Where the complaint is allowed the under sub sec 3 it is proceeded further in a
manner provided in this act.
