EB-5: The Risk of Delay (Retrogression)
10,000 Visa Annual Cap Worldwide = 700 Visas per country

• When applications exceed available visas (“retrogression”)
• Similar concept to EB-2 (25 year queue) and EB-3 (75 year queue)
• In 2018, India filed 852 family EB-5 petitions (Form I-526)
• Place in line is determined by application date
• Unused visas are reallocated to the queue based on application date
• No effect on wait times for Indian green cards (currently two years) until estimated May 2020
