The much awaited procedure for availing benefit under section 128A (aka Amnesty for FY 2017-18 to 2019-20) has been notified. We have encapsulated the applicability, conditions and procedure applicable for availing benefit under the aforementioned provision. The much-awaited judgment in the GST era has arrived, shedding light on critical interpretations such as ‘Plant and Machinery’ vs. ‘Plant or Machinery,’ the term ‘own account,’ and the distinction between Sections 17(5)(c) and 17(5)(d) of the GST law. The Hon’ble Supreme Court, in a significant observation, recognized that a ‘building’ can be a ‘plant’, and in each and every case ‘functionality test’ has to be applied to determine whether a building qualifies as a plant. Basis the same, the Court has remanded back the matter to the Orissa High Court and directed to apply Functionality Test on the facts of the case.
