Öz Şikâyet, kişi veya kişilerin haksızlığa uğradığı veya uğradığını düşündüğü bir konuda bu durum... more Öz Şikâyet, kişi veya kişilerin haksızlığa uğradığı veya uğradığını düşündüğü bir konuda bu durumdan kurtulmak için sorunun ilgili kurumlara iletilmesi şeklinde tanımlanabilir. Osmanlı Devleti'nde adaletin sağlanması yönetimi sağlamlaştırmak olarak da görüldüğünden şikâyet hakkının kullanımı noktasında gerek askerilere gerekse de reâyâya önemli haklar tanınmıştır. Toplumun her kesimi en yakınındaki adli mercilere başvurabileceği gibi Divân-ı Hümâyûn'a da şikâyetlerini iletebilmektedir. Bu çalışma da 3 numaralı Bosna Ahkâm defterinden yararlanılarak Bosna'daki kadınların şikâyetlerini Dîvân-ı Hümâyun'a nasıl ve ne şekillerle ilettiklerini, hangi konuları şikâyet ettiklerini, sürecin nasıl işlediğini, kadınlar açısından neleri getirdiğini ve sorunun çözümü noktasında neler yapıldığını incelemektedir. Bu amaçla 3 numaralı Bosna ahkâm defterinin belirlediğimiz yıl aralığını kapsayan hükümleri taranmış ve içlerinden kadınlarla ilgili olan hükümler seçilmiştir. Tespit ettiğimiz hükümlerde kadınların sırasıyla en çok miras, arazi gasbı, gasp (mülk) ve alacak-verecek konularındaki şikâyetlerini Divân-ı Hümâyûn'a intikâl ettirdikleri görülmüştür.

Osmanlı Devleti, dinamizminde kendisine intikâl eden devlet geleneği ve yönetim anlayışını birleş... more Osmanlı Devleti, dinamizminde kendisine intikâl eden devlet geleneği ve yönetim anlayışını birleştirmiştir. Bu anlayışta devletin devamı için adâlet her şeyin temeli kabul edilmiştir. Adâletin sağlanması için reâyâya en yakınındaki adli mercilere başvurma hakkı tanındığı gibi Dîvân-ı Hümâyûn’a da başvurma hakkı tanınmıştır. Adâletin sağlanması noktasında kayıt altına alınan şikâyetler, şikâyet defterlerinden önce mühimme defterlerine kaydedilmiştir. Mühimme defterlerinde şikâyetler yanında siyasi, askerî, ekonomik kayıtlar birlikte kayıt altına alınmıştır. Zamanla devletin sınırlarının genişlemesi ile şikâyetler artmış ve bürokrasinin uzmanlaşması ile farklı defter serileri ortaya çıkmıştır. Bu defter serilerinden olan şikâyet defterleri, 1649 yılında tutulmaya başlanmıştır. 18. yüzyılda ise şikâyetler eyâlet temelli oluşturulan ahkâm defterlerine kaydedilmeye başlanmıştır. Ahkâm defterleri oluşturulmasına rağmen şikâyet defterleri de tutulmaya devam etmiştir.

The Ottoman Empire united the state tradition and management approach that came to it in its dynamism. In this understanding, justice has been accepted as the basis of everything for the continuation of the state. In order to achieve justice, the people were given the right to appilication to the nearest judicial authorities, as well as to the Divan-ı Humayun. Complaints recorded at the point of ensuring justice are recorded in the mühimme books before the complaint books. In this books, ın addition to complaints, political, military and economic records are recorded together. Over time, complaints increased with the expansion of the borders of the state, and different series of books emerged with the specialization of bureaucracy. The complaint books, one of these book series, began to be kept in 1649. In the 18 century, complaints started to be recorded in provincebased books. Although the creation of the Ahkam books, the complaint books continued to be kept.
In this study, which was prepared as a master thesis, the first 100 pages of Bosnia Ahkam Book number 3 were transcribed. The number of documents transcribed in the study is 269 and the year range is 1765-1767. The whole book covers Hijri 29 Şaban 1178-29 Cemaziye’l-ahir 1192, AD 1765-1778. In this book, complaints received from the Bosnia province to Divan-ı Hümayun were examined, classified and analyzed according to their subjects. In addition to complaints, the ledger provides information on political, economic and administrative issues. Our aim is to shed light on a three-year section of the Ottoman State, specific to Bosnia, with this study.
